      Predatory auto lending practices, I bought my 2014 f150 and was told north state would be my finance company, I put $10k down on the vehicle made on time payments for 2 months, i was offered a new job in ******** ******* and told my finance company that I would be moving and a switching jobs and that I may be a month late on my payment this month, everything seemed fine. Then one morning i go out to get in my vehicle and its gone, I received no word that it was repossessed and no one let me know where to go to recover my personal belongings I finally got in touch with northstate to pay my past due balance to get my truck they told me I had to pay the full loan amount. I just paid a 10k down payment and 3 months of payments! I essentially paid off more than half the vehicle at this point they took it I obviously couldnt pay the remaining loan balance they sold it at auction and are now saying I owe them ***** dollars so they expect me to pay $21000 for a vehicle thats not mine (the vehicle was only $24000 when I bought it) now I am without a vehicle and its impossible to finance another vehicle due to the carnage north state has caused to my credit and finances.

      This customer purchased a truck from ***************** on 3/14/22. The cash price of the truck he purchased was $28618.82, which included a documentation fee of $499 and highway use tax of $833.56. The customer purchased a vehicle service contract of $995 and GAP of $795. The license and registration fee was *********** total price with all included was $30518.57. This customer did pay ***************** a down payment of $10,000. The amount financed with North State Acceptance was $20518.57. The total finance charge was $10511.51. The total payback to North State Acceptance was $31030.08. The payment schedule was 48 monthly payments of $646.46 beginning 4/14/22.
      Our office tried to contact this customer in April for his first payment, but he did not respond. We were unable to reach him and had to repossess the vehicle on 5/16/22. In order to redeem the vehicle, he made a payment on 5/20/22. He paid $1320, which was for the April and May payments plus a $300 repossession fee and a $15 late charge.
      This customer did not make any more payments on his loan. He made a promise to pay on 6/24/22 and on 7/7/22, which he broke.
      On 8/29/22, this customer sent an email to our company via our website:
      Good Morning, I received a letter regarding repossession of my vehicle. I understand i am 2 months behind on my payment, and intend to make my payment ASAP I recently moved to ******** ** to accept a new job and have had a slight lapse in income and while switching jobs during my move. I have also had to pay 600 plus dollars in the last month to have a coolant house on the truck replaced. I am asking for you to Please please do not repossess my vehicle. I will be making the payment for the past due payments in full the first week of September when I receive my first paycheck. Thanks!!
      He again broke his promise to pay the first week in September.
      We repossessed his vehicle on 10/7/22 when he was 4, almost 5 months past due on his payments.
      This customer only made 2 payments on this vehicle and he was aware of repossession as noted in his email sent on 8/29/22.  Due to his lack of communication, broken promises and no payments made since May of 2022, we did require the loan to be paid in full to redeem the vehicle. The pay off on 3/15/23 for this loan is $11262.64.

      My account with North State Acceptance was charged off in November of 2017. To this day, North State Acceptance continues to add to the balance every month. This is a continued violation of the Fair Debt Collections Practices Act, as a debtor may not collect any interest, fee, charge or expense incidental to the principal obligation unless it was authorized by the original debt agreement. This needs to be corrected at once.

      While investigating this complaint, I found that we were awarded a judgment but erroneously the account wasn't ever put in judgment status. The judgment rate awarded was 6.25% and has been changed to reflect such interest rate. We filed an *** **** ****** to reflect the new lower balance as well as the judgment status. We are finding that sending corrections to the credit bureau using ****** is taking weeks to show. When electronically reported at month end, the account will report correctly moving forward. The balance will go up each month as interest accrues on the balance at 6.25%. We apologize for the oversight.       I purchased a vehicle with ** **** ** ********* North Carolina . North state acceptance is the company the car loan was taken with . They have repossessed the vehicle claiming that I owed a month of payment and I didn’t have insurance with the vehicle . When signing for the vehicle the vehicle was purchased from a used car dealership ( meaning work needed to be done to the car ) the dealership purchased the car from a auction and the car had bodily damage as well. I have had the car fixed multiple times as well as paying the monthly payment on the vehicle . The payments were made on the vehicle however north state acceptance would increase the payments and not inform me . When the payment reached 707 the stated it was because I didn’t have insurance on the vehicle . The representative then tells me that I can keep their insurance and cancel mine and make a monthly payment of 707 and it would cover insurance and the monthly payment for the vehicle . They then tell me that I only paid for certain months and I was missing payments . Then after being all caught up I get another phone call saying I’m a month behind . When I tell you this company scams people . They also broke fdcpa laws in North Carolina harassing my mother at her address when my address was never on my application and they knew where the car was . They also told my mother of my payments and purchase agreements and she didn’t co sign on the vehicle and none of her information was given regarding the car . The representative told me they look up prior addresses . Why when I have been at my apartment for a whole year ! You all towed the car from my address why Harrass my mother and take pictures of her home . Breaking fdcpa laws is a lawsuit . Now they claim I owe $8,000 on the vehicle after they sold it because there was damage on the car . That’s how I purchased it ! On top of that I had gap insurance and insurance with their company so what was I paying for ? They stole funds and scamming customers .

      This customer purchased a vehicle in March of 2021 form **** **** Sales. The contract was reassigned to us. The customer paid the first 5 payments but fell behind in September. Her insurance cancelled 5/5/2021 which was shortly after she bought the car. After several attempts to get insurance information and mail which was returned to us, we force placed our own coverage. This coverage protects our interests in the event of a total loss. It does not provide liability coverage. We would always prefer customers get their own coverage and not keep force placed insurance.  Per her contract, she must keep full coverage on the vehicle or we may repossess or add our own coverage at her expense. In September she did tell us she had COVID but got paid the next day so she would pay her payment then. She did not ask for any help due to COVID. We would have gladly given her a deferment as we have numerous customers but she didn't request any help. She did not pay the next day and dropped communication with the exception to a reply to another text that read "Pay it tomorrow" but again she didn't pay. We made efforts to locate the vehicle and an address came up that matched her mothers, who was listed as a reference, was visited by our repossession vendor when she fell behind on payments again.  They left a sealed blank envelope with only our customers name on it and a business card inside asking her to call us. Pictures were taken by the repossession vendor for the file.  On October 14th of 2021, we repossessed the vehicle for non pay and non communication. The customer called us and redeemed the vehicle getting her own insurance coverage and paying the past due amount.

      Again, in December of 2021 her insurance cancelled. We force placed insurance again and the customer made the payment for a few months but then stopped paying and so it resulted in a 2nd repossession. There was no Right to Cure sent because NC is not a right to cure state. She did purchase a GAP waiver at the dealership which was not used because it's purpose is to pay the GAP between an insurance proceeds check and the balance should the vehicle be totaled. The vehicle was not a total loss and so no GAP claim was filed but we did refund the remaining portion. The initial cost was $795 and $609 was rebated. We did mail her repossession paperwork by certified mail but it was returned to us and we did not have any updated address provided by the customer. Please find attached a copy of repossession notices, auction check and deficiency letter. Most recently, we received a dispute from ****** input by the customer stating that this account does not belong to her. We updated that information as accurate as this is the customer's account.

      I am rejecting this response because:

      the details from this company is fabricated. Yet still after contacting them they refuse to give me a detailed itemization of all payments made on the account for me to match with my bank statements. Also as told by their representative I did not have to have my own insurance I could pay $707.00 with them and have insurance covered on the vehicle . (It is their job to train their employees and that information was given to me by their employee ******** ****** . Confirmed by ****** ***** as well as ****** ********. 
      This company has increased loan amounts through out the year lying and scamming their customers with out informing customers of debt increase . As you can see they broke the fdcpa laws and Harrassed my mother when they had the address to my home the entire time and didn’t speak to me not one time .

      (my car was registered to my legal address where the car was located .) 

      not one time did they knock on my door. How can you mail something to me , pick up the vehicle for repossession and not know where I live . 

      Again also increased loan amounts through out the year with out notification (scamming). 

      when asked for a detailed itemization for the entire year . As well as all receipts for all payments they failed to give it to me. 

      anything with out documentation of charges were rejected as far as my credit because they failed to give documentation and the credit company legally saw them closed the account and then days later tried to reopen it with out informing me and it was denied by the credit company .

      The original complaint did not request a listing of the account history. Please find that attached. We did not add any fraudulent charges to the loan. If a customer does not maintain full coverage insurance, per the contract, we will force place or repossess the collateral in order to protect our interest. We paid the dealer for the vehicle you purchased with expectation that it would be paid back and full coverage insurance maintained. We mailed copies of the insurance cancellation notification and the force placed notices as attached in the initial complaint. Mail was returned to us and we did not locate the vehicle at the address on file. Please review the account history. If you have any questions regarding charges, we will be glad to answer them.
