My Silverado Truck was left there on May 21 Sunday for a body repair on Monday, when I picked up the car on Tuesday May 23, someone damaged the bumper on my car while in the care of this business. They refused to resolve the issue and when I ask for their insurance carrier info, they told me that we would be committing fraud to report it since they dont know how it happened.

    Business Response

We are an auto service repair and used car dealership.  Recently a third-party dintless body repair work was done on a costumers vehicle at our property.  Ultimately our business is not responsible for any theft, damage, or missing content. This costumer had the opportunity to pick up his truck that day and did not do so.  Therefore, we parked the truck inside the building overnight and the next morning we moved behind the building so that we could begin work.  The rear bummer of the truck where said damage is noted was backed to the dumpster. Based on where the truck was parked there is no way the truck could have been hit.  There is lack of evidence: Despite your claim, we have not found any documented evidence or witness statements linking our business to the alleged damage. Our records indicate that all necessary precautions and safety measures were taken during the time your vehicle was in our care.  That evening the costumer spent 20 minutes looking over his truck if he noticed the damaged bummer then he should have come into our shop and told us instead he left.  We are not responsible also there is no proof that the damage occurred at our shop.  A police report should have been filed but as we mentioned he left.  Later when he called to blame us for the damage the repair guy offered to fix his bummer free of charge and he refused.  As a professional business we have done everything we can to meet this customers needs. Our business has been in operation at this location for 23 years and this is the first incident where a costumer is claiming we caused damaged.   We have maintained a reputation for excellence and have not received any similar complaints in the past. This reinforces our commitment to providing a high level of service and further supports our belief that the alleged damage did not occur under our care.

I am rejecting this response because:

The vehicle was left on a Sunday evening and the keys were dropped off in the overnight box. The repair was completed on Monday and I recd a call at 4:17 that the vehicle was completed and that the shop closed at 5 and I live 30 minutes away, so I had to pick up my vehicle the next day. The auto repair was done by a third party? Please provide the third party full name and address.

B & W has neglected the responsibility and accountability in the matter and have failed to give the matter resolve without condition.

Unless the business can prove otherwise, the damage is there responsibility or that of the third party who is under the control to operate at B & W.

As of today, the small claims docket is 3 months out. My attorney and I are deciding if we wish to proceed or have my vehicle fixed and then *** them in small claims for the amount of the repair.

Please proved the third party name and address that B & W Stated in the previous message.
