In the spring of 2021, we were preparing to list our house in ************ **. During a storm, a tree hit a section of the house and we needed to have the roof replaced and a section repaired. We set-up a contract with Jason ****** and Home Solutions to do the work. The contract was established March 8, 2021 with a quote for $9848.00 with an additional $421.68 needed (materials) for a total of $10,269.68. We issued a first payment of $5901.00 to start the work and then had planned to pay the balance on completion of the work. The shingles were replaced but the trim and damage repair were not completed. Since we were in the process of listing the house, we needed to have an inspection completed which meant the trim and damage needed to be repaired and completed. After emailing/texting them of when they were coming to complete the work, we received no response and communication stopped after April 12, 2021. I was forced to hire a second contractor (***** *******) to complete the work for an additional $1088.85 so we could pass the inspection for listing. Since that time I have never heard from Home Solutions and we've relocated for my job to ****** in June 2021. This week I received an email from Home Solutions seeking full payment of the balance of the work for $4068.00 and claiming "bad accounting" for the lapse. This is almost 2 years later and the original work was never completed as per the contract. I would like to understand what rights I have in coming up with a solution to this situation. I feel the contract was never fulfilled fully and I was forced to hire a second contractor to finish the work.
