      Hired & signed contract with Southers construction to do an entry door and vinyl side my house. Signed contract April 2023 & wrote deposit check for $24,707.05 and was told work would be done in within 8 weeks. 5 months later nothing done or material ordered, so I canceled contract and asked for refund. Said you’ll have your refund within a month they lied. It’s now November and I am still without siding & my refund check and the company will not give me any answers about it

      I hired Souther’s Construction to put on a new roof. The roof was completed at the end of May 2022. They had permission, with my advance approval, to fix what was needed while replacing the roof. After spending time on my roof, the only communication was that some sections over an addition had rot and needed replacement. That was approved, and fixed. I was told that was the only issue, nothing else was needed, they finished up, confirmed I was “all buttoned up” and everything was perfect. They left. Just two months later, ceiling staining on my second floor stairwell was visible. Calls to the company were all unanswered. It was a lot of work to figure out who to reach out to - I’d talk to one person and then they were gone. Then another, then another. Chaos to just have a conversation about this. A few months later, black mold appeared through the ceiling sheetrock and adjoining wall sheetrock. Still no response, still chasing them. in approximately July 2023(?) I learned they now had their office set up in Epping. I went to their office to discuss this. Again, lots of promises. “Oh, no problem, we’re sorry, we’ll take care of it.” It again took a significant period of time to get them to my house. The mold kept growing. They did show up (or claimed to have shown up), the only problem was it was without discussing an appointment with me and I was at work both times. They never left their truck. Is this so their records say I didn’t show up? I would never had scheduled a time in the 1pm timeframe working in Concord. It would have required taking vacation time and that did not happen and I had no notice. Finally a representative came out (late Oct/early Nov) and basically totally denied any responsibility (of course, standard operating procedure). No damage and no issue occurred until such time as the Souther’s roof was done. Now, it’s a nightmare and I’m living amongst black mold.

      Southers Construction did a project at my home which included installing siding and a covered deck (porch). The roof of the deck was too short, allowing rain to fall on the rails & floor of the deck. Two months ago a representative of Southers came out and said they would install a gutter under the porch roof at no charge. I have tried to contact Southers dozens of times over the past two months via telephone, email and messenger but have received no reply. I paid $55,000 to Southers for the project for which there is a 50 year warranty.

      10/18/22–At my request, Southers Construction provided a quote for multiple projects on my house. The quote was very expensive, so I asked for a quote for the French doors only. 11/2/22–Contract sent to me for new French doors. Total cost $6845, 50% deposit required. Contract cancellation language - Cancellations after the third business day may incur a fee if any actions have been taken to order materials or any costs have been paid by SOUTHERS CONSTRUCTION, INC. 11/4/22–Mailed signed contract to Southers. My check for $3422.50 cleared on 11/15/22. 12/29/22 –No word from Southers, contacted my salesman. They then sent someone to measure the existing door. 1/27/23–Called Southers to check on progress; was told door hadn't been ordered. Woman said she would order the door that day. 5/12/23–Called Southers again. Woman said she couldn’t locate the door. I said I wanted my money back. She said I’d have to speak with the production manager and she’d have him call me Monday. No call received. 5/22/23–Sent email to [email protected] requesting cancellation and my deposit back. No response. 5/26/23–Called Southers again, told woman email sent, but received no response. She again said I had to speak with production manager and she would have him call. She said I should email him with my request to cancel and gave me his email address. 5/30/23–No call so I emailed production manager requesting cancellation and return of deposit. No response. 7/28/23–Sent email to CEO asking him to resolve the matter. No response. Have tried calling 3 times since then; always get voicemail. 9/18/23– Sending certified letter via snail mail to Southers so I have proof my cancellation request is received. I told them in that letter that I would also be processing a claim with the BBB. They have now had my money for 10 months and done nothing except send a guy out to measure the door (a 30 minute visit). I want the contract cancelled and my deposit back.

      While I appreciate your response to this BBB complaint, no one has attempted to contact me directly since 10/10 and when I reached back out to that person this week, they said they were no longer with the company.  I have no confidence that you will actually respond and get the job done and quite frankly, I don't want to give you any more money after this year of frustration.  I want the contract cancelled and my money refunded. If someone would actually contact me directly about this, we could discuss it further.

      On Apr. 12, we gave Southers Construction, Inc. a $20,000 deposit to remove our old deck and build a new 420 sq ft. deck on our home. They told us they would have it done in 9-12 weeks at the latest but most likely 6-8. Since then, they hired a subcontractor who attempted to do the work but they began work with no blueprint and no permit for the deck they were supposed to build. They made multiple errors up front and even built the wrong size frame for our deck (12x25) and built over critical infrastructure that we discussed moving on multiple occasions, even with the CEO of the company. All work to date was done without a permit, although they secured one at our demand when we realized they didn't have one after they built the wrong deck. We asked them to reconsider the $56,000 price tag due to the fact that they offer a veterans discount that wasn't on our original contract and my husband and I are both retired from the Army (we were first told 10% and then they tried to offer 5%), we had to supervise subs as they failed to provide any supervision on site while subs were at our home, and they failed to obtain a permit prior to initiating construction. We now have a deck frame that is not to code hanging precariously off the side of our house that does not meet specifications of the current permit and it poses a safety risk. They dug up and installed cement footers which are unusable a s our whole back yard is now a mudhole with .y landscaping destroyed. During the work, the subcontractors were digging footers and building the frame with no shirts and NO SHOES, all without a permit. I have photos to prove it. We lost a whole summer on this deck and we have nothing to show for. The company will not return emails, texts, or phone calls at this time.

      When it comes to the timeline we have been pushed back on a lot of our builds and construction and we work to stay to these timelines. We had an agreement on the deck and the size and we began to build to this size and we have had many changes at your request which we happily changed. We added things that were discussed and not in contract that was signed from military discount (much deserved), electrical work, moving pipes, moving vents and to forth all going to be done and within contract at no additional cost because those are items that were needed in order to build the deck. The yard is a mudpit and diggin holes is dirty and messy on the dig phase requiring a lor more work then going straight down four feet. Hot days and outside these guys are hard workers and moving to get the job done and we had a project manager with them there everyday to work through thse changes and get the deck erected. Once the crew was demanded to be replaced we stopped production and got another crew that could start within a weeks time. Before the work restarted you wanted us to agree to a 43k total price which with everything else we were not able or willing to do. There are a lot of moving parts when it comes to these decks and to jump through all these obstacles and be blockaded by a 13k discount from a signed contract we stopped work. We are still more than willing to complete the deck at the agreed upon price with all the additionals and we are happy to work through the details to make this hapen. We have communicated this to you and even though we dont agree on the terms does not mean we are not communicating. Your demand to get your full deposit back and for us to buy all of the materials is unrealistic and not accepted. We hope to hear from you soon to resolve this matter.

      We DO NOT accept Southers Construction Inc.'s response to our complaint because their answers are, as usual, nothing more than factually inaccurate gaslighting. Southers Construction Inc. has a revoked BBB rating because they often act fraudulently and in poor faith, using every protection afforded to them as an LLC to avoid creditors and angry customers. In 2021, they paid $107,000 in back wages and liquidated damages to 52 workers shortchanged by their illegal pay practices (see attached article). The NH Attorney General has 10+ complaints filed against them in 2023 alone (see attached photo). We're deeply disappointed as veterans that Southers Construction Inc. acts in a manner that brings discredit on other legitimate, reputable veteran-owned businesses. we are disgusted, disappointed, dismayed, and extremely angry at the time, money, and emotional energy stolen from us by these slippery, disreputable, unrepentant charlatans. 

      We started this debacal with Southers Construction when they took our $20,000 deposit on April 11th 2023 -- and then they didn't start work until July 18th, 2023. To put it in BBB terms, "This business has a pattern of complaints concerning extreme delays in promised work completion following the acceptance of monetary deposits for work and poor quality of completed work."  "Poor quality" barely scratches the surface of the problem; by July 20th 2023 -- two days after we started the project-- we had to ask Southers Construction to stop work on our deck because it was obviously incorrectly performed and damaging our home. We asked for prompt resolution, and spent weeks working one-on-one with their site lead to help them fix the problems they created. All work they performed on our property was WITHOUT A PERMIT–despite a contract that said THEY would pull all permits. Furthermore, we have proof that a Southers representative lied to our Town's Code Enforcement officer in order to belatedly obtain a permit for this project-- blaming their shoddy work on other contractors. We terminated our contract with them on August 31st and other than the snarky, poorly written response to this complaint, they have ghosted us. 

      We have DOZENS of time-stamped photos as evidence of Southers Construction Incs. misconduct, along with hundreds of text messages showing our constant efforts to remedy the conditions caused through their improper and poorly-supervised work. All work they performed on our property was WITHOUT A PERMIT – despite a contract that said THEY would pull all permits. Furthermore, we have proof that a Southers representative lied to our Town's Code Enforcement officer in order to obtain a permit for this project-- blaming their shoddy work on other contractors, when it was THEIR work. 

      We have retained legal counsel-- for the first time ever, in our entire lives!-- and we now must urge everyone reading this to file a Consumer Protection Complaint with the State of New Hampshire or State of Maine Attorney General. We also urge everyone to avoid this unscrupulous dumpster fire of a company before you are embroiled in a tragic fiasco like ours. We are ashamed that we were flimflammed by these crooks, and we suspect we'll never see a dime of our money returned by this shameless, pathetic group of fraudsters until the State of NH and/or State of Maine Attorney General take them to court with a large group of other consumers (like us) as victims in a multi-party, State-led lawsuit. I fully expect they will seek the protections of bankrupcy to avoid the Court's judgement, and will try to slither away to avoid the shameful, well-deserved ignominy of their reputation.

      I contracted with Southers Construction to complete a siding repair job on 3/16/23. They accepted my deposit and advised the work would be done in 5 weeks. We are now more than 5 months out, the work has not been done, they have consistently been rude and dismissive, refusing to commit to an installation date or return my deposit. This delay has caused additional damage to my home and will result in more costly repairs. I notified Southers Construction of this on multiple occasions; each time I was given a different excuse for why the work has not been completed. The contract was signed on 3/16/23 for a total cost of $2,000. I paid a 33% deposit by check ($667), which they deposited on 3/20. By 5/11, I hadn't heard anything and when I tried to get in touch with them I found their phone was disconnected and they had relocated from Dover to Epping. Between 5/12 and 8/24 I have reached out on at least 20 occasions by phone, text message, email, Facebook and certified mail. Each time I was assured they would get to my job and was given an installation date, but they failed to show up to do the work, citing various reasons. I raised concerns on multiple occasions about the worsening damage to my home and on 8/2 Raf Llorens, the director of operations, agreed that a temporary fix should have been done in March to avoid just this. On 8/14, I sent a formal request for the return of my deposit by certified mail, citing a breach of the terms and conditions as Southers Construction failed to complete the work in a timely manner. As of 8/24 I haven’t received a response, my deposit hasn’t been returned and they have stopped responding to me completely. I understand I’m not the only one in this situation as their BBB accreditation was revoked, but I am hoping for assistance in raising this complaint and want to share my experience so others know to avoid Southers Construction and not get caught up in their bad business practices too!

      My wife and I hired Southers Construction to swap our front entranceway door, and to install a new side door for our walkout basement. In March, we provided Southers with a check for half the project (quoted) cost to book the work. We were told the project would be scheduled in two weeks, no problem. It’s now late June and have never received a call to schedule the work. I’ve called Southers Construction multiple times requesting a call back from the phone attendant, but have yet to receive a call. At this point Southers as stolen our half down payment for our home project. They can’t be bothered to call a customer back after paying over thousands to book a project. Extremely frustrating. Would like our money back to hire another contractor. Thank you

      On September 14, 2022 I signed a contract for replacement of siding on two dormers and replacement of a skylight. I paid a 50% deposit of $3600.00 at that time. I have been told on several occasions that they are scheduling the work and no one shows up and there is no communication to follow-up. Today, April 19, 2023 a crew was to arrive at 7:30 and no one has come and I have called the office 3 times and no one answers. I have left a message with the man who signed the contract that I want my deposit back. Having just discovered they have been suspended by the Better Business Bureau, I think I am justified in seeking return of my money.

      I do not accept the business's response as a resolution to my complaint because: The "communication" issue did not just develop in the last 2 weeks. There has been next to no communication from this company from the very beginning, and after scheduling a date and time with me, they still failed to show up an failed to get in touch with me. Until I filed my complaint with the Better Business Bureau, they made no effort to reach me. I have no reason to think that they will ever show up to do the work.       7/5/2022 signed a contract with Southers to replace existing roof and to provide prints for an addition. addition would be done at the same time as roof if it was decided to be cost effective. workers showed up unannounced prior to prints being viewed for addition. Workers didn't speak English, so we could not communicate, The Project manager had left the site. Roof was incorrectly installed underlayment's missing etc. We called Ricky S******* for a personal visit on 09/24 and he then verbalized to us that he was disgusted with the workmanship and said he would make it right. He also stated that he really wanted to do the addition and show us how great his company was. So, naive us signed another contract on 10/7 for the addition. It took them 4 tries to get the contract right, as wording in contract was not what had been discussed. The build went horribly wrong. Framing issues, roof leaks, egress windows wrong size as well as the wrong windows from the contract where installed. We communicated this several times through several emails, text messages, and phone calls with no response from Southers. We contacted the loan company to be sure Southers would not be paid because of the unfinished project and all the code violations which were explained in detail with the loan finance company. To our surprise Ricky had somehow forced the funds through and received 100% of the funds one week prior to our inquiry to Service Finance Company, no communication, no notification from either company, to us. The Town of York Me. is requesting an Architectual Engineer to check and sign off their work. *Tells you something there. Did he do work? YES. Is it correct and to code. NO Did he follow the contract NO Southers ultimately put three roofs on this house because they all had issues of leaking incorrect nailing and ridge cap issues. They are crooks, liars and thieves. I would not trust them on my property to finish any work. We have had several contractors check the work and they all said the same thing, it needs to be redone to Maine code.

      We did your roof in two phases because you were moving forward with the addition in the back. I was not disgusted with the work but I explained to you the areas that would be ripped back off during the next phase of the work, in which it was done. Our workers do not speak gret english on certain crews they each have a point person and you have a project manger assigned to you on site who you refused to talk to. We built your estimate in several different ways for you because you wanted the price to be in a certain spot that originally it was too high so we took items out, then added back in and this should have been our first sign. We ultimately settled for a bare eshell with exterior siding and the roof. There are several things were not doing inside because of the choices made to keep the price down. Our issues with the install relative to code was the inside ceiling which was not included and you asked my crew to hang to make it easier for you to hang the ceiling. our contract was for exterior shell only now thise needed to be beefed up which we agreed to do for you if you bought the lumber where you said yes then the day of cancelled. The windows had two wrong egress size windows that we made the mistake on and said that we would replace the windows. We needed you to agree on the replacement and we have a signed agreement for you to release the funds while we wait for the two new windows to come in. In this time we offered to do several other items for you some which you agreed to pay and some which we included to include the siding on the other side of the chimney, eliminatiing the vent on the other side you were going to cover up, replace the trim on the windows and wrap the sills to give it a finish look. The job was done, minus replace the two windows to larger egress and installing the larger framing in the ceiling. all the issues were to be taken care of they just needed time to get here for the replacement. My project manager was in contact with you and since you didn't hear from me directly on new years eve the world was ending. Now you have a full build with roof windows and siding that you only paid 10k for and that doesnt even cover the materials. I have Never taken a customer to court but you did this knowing full well what you were doing and you had intended to take advantage before we ever started the dormer and that was my mistake in trying to do whats right and get your dormer built in a timely fashion. You are now working with my prior employees that you wanted nothing to do with before because you are getting a smoking deal and we will not let that go.

      Southers, you did not provide the work as per contract. The work that was performed was not to code and needed to be corrected per the town CEO.

       We requested for you to provide us with Documentation of the correct windows (per Contract) on order. In which you could never provide. Please reference your emails and text messages.

      To install American Craftsman windows when the contract clearly states Harvey, along with the plans for window sizes submitted to the town you dont have a clue. I informed you of the dissatisfaction at the time and you tried to tell me how much better the AC windows are.

      Your rebuttal is quite a fabrication from the truth. My attorney has already contacted you but you have refused to indulge her. 

      At the moment we are over $15,000 in fixing your mistakes and counting. Let's not even get into how you did not even register the roof with Owens as you are supposed to have done on the original scope of work.

      So just to recap to remove and replace the windows and framing to bring this project to code. We have found issues now that have to be addressed the Hardie siding and the Zip Systems sheathing.

      To tell me there are quality issues and that you our have fired your subcontractors and not to let them back onsite speaks volumes about their work. To have their insurance adjuster come to see all the damages that had been caused is also a huge concern. 

      Please respond to my attorney she is waiting for you. She has all the documentation with photos, so I urge you to contact her. You know here well you have already lost a judgement to her.

         The work is completed and when the inspection was done you refused the work to be completed. You agreed to the change in windows based on the timeline to get the windows. I did make the mistake of not getting this in writting from you which I will not let happen again. The multiple quotes came from us trying to work with you to fit into the budget you had taking and removing items and also requiring contracts to be re written. you needed to fit into a budget and a time frame and we made it happen and now that the work is done and it is to a manageable project for yourself you conveniently hodl our money and refuse to let me guys work.  You will not get your roof registered under a warranty without it being paid for John. You never paid for the first roof portion as it was a part of the dormer build and we allowed and now again conveniently you thought it was included when clearly theres two seperate contracts. On the windows you recieved the specs on the windows and refused them because they did not match the contract when you know good and well what our agreement was. Even still I offered to replace all 4 windows and the interior framing which needed to be corrected after the framing and the cost is far from what you listed here to complete. You sent me a copy of your attorneys card since you stopped communicating and we will be pursuing further action on this. there has been no attempt on your attorney to reach out to me because you hold all the cards right now because your holding over 30k of our moneys. We did not fire our subcontractors we still use the often, we just pulled them off of your job because of your request and quite frankly the way you treat them. Your a predatorial customer who is taking advantage of my trust in you as an honest person and not getting everything in writing to move this project along for you. My mistakes on the install of the code compliance you are mentioning were to be replaced and fixed on the timeline we agreed upon and we had to wait on materials before work could be completed after we got on the same page to try and stop this from happening.

The details are in the proof. I have the contracts, emails, text messages from both you and your lead person at the time of the project.

       The roof as you mentioned was two separate contracts. The first roof contract was paid for, so it should be dealt with and treated separately. So yes, we should have a warranty. The dormer roof WAS included in the dormer contract, please read your contract. You have replaced the roof several times and it still is not correct.

      The contract had to be re written many times because of your inability to properly produce a correct contract for my project. You had the wrong siding on contracts, the wrong materials the wrong windows etc.etc.etc. That is the reason why they had to be rewritten so many times.

      Yes, I do have the emails about firing the sub-contractors not letting them back on site and to call the police if they show up and not to let them in the house to regain control of their tools. This is all from your office.

      You sir are a predator. You are feeding off of the honest people like me. Your track record speaks for itself with the legal actions taking for nonpayment of workers subcontractor and vendors. I wish that I had done better research on you and what you are trying to peddle as a roofing and remodeling contractor.

      I challenge you to bring in certified Owens Corning rep to verify that the roof you installed is done correctly. I also challenge you to bring in a Hardy siding rep to certify that the siding was installed correctly.

      You have threatened me that you are seeking legal action, you have sent various emails that a lien would be put on my property, you have had your subcontractors that you have not paid, threaten me. 

      I am done with your threats your illegal practice and poor workmanship. I am not the only one that you have scammed. the noose is tightening. You have my attorney's information so bug off.

      Southers Construction LLC and I both signed a work contract on 7/29/2022 for roof repair. Two areas of the roof would be repaired: chimney reflashing and re-shingling a valley within the roof. For the valley roof repair the work contract stated, "Remove and asses the current rubber roof. Remove flashing along siding. Remove siding. Assess damage that current system has done. Then properly tie in rubber roof, siding flashing, re-side, and reshingle areas needed. If repair is done sooner than 8 hours, and chargeback will be given." The chimney reflashing work agreement stated, "Grind out old lead from chimney and install new 12" roll of lead step flashing. Install ice and water shield around chimney. Seal each step of lead flashing. Remortar sections of the chimney that we grind out the old lead from." A fifty percent deposit was given to Southers Construction on 7/29/2022 for the work they agreed to complete. The check was cashed by Southers Construction on 8/01/2022. A project manager was assigned to our job on 8/10/2022. The Project Manager came to the house and checked out the job. He suspected the chimney itself needed attention and contacted a mason to inspect it. The mason, not a Souther's employee, said the chimney needed to rebuilt from the roof line. A new chimney was built 9/29/2022. Work began on our roof project on 10/07/2022. Subcontractors, not Southers Construction Employees, were assigned to our job. These subcontractors completed the job that day with a couple quick onsite check-ins, from the ground, by our assigned Southers project manager. On 10/08/2022, the Project Manager came to the house to inspect the work. The job in the valley of the roof was deemed incomplete and unsatisfactory by the Project Manager and would be assigned to another subcontractor for a future date. The chimney work was inspected from the ground, the Project Manager had an injured knee and was unable to climb. We assumed the chimney was completed satisfactory. On 12/17/2022 the repair around the chimney leaking. A replaced interior ceiling was showing a large water mark. Immediately Southers Construction was called; the receptionist said an urgent message would be forwarded and we would hear back from someone. No one returned the call. Subsequent calls were left on Southers voicemail for the following two days. On 12/20/2022 I requested to speak with the owner, I explained the situation. He said he'd have a project manager call me that day. No one called. Southers Construction LLC does not live up to their agreement. The job was not completed in a skillful manner. Souther's subcontracts out the job and does not adequately supervise. Through negligence, Southers Construction, is liable for repair work and interior damage. They will not return my call.

      When it comes to repair work and what was done on this area prior you don't always get the issue solved the first time. The chimney is in rough shape or appears to be with the coatings that are applied as seen in the pictures. The rubber area was tore apart and put back together. We do use install crews and our in house crews and we bring in experts in each field if it doesn't align with ours its how were able to inspect and diagnose many areas of the exterior. The additional moneys for the rebuild werent an option so we we repaired where and how we could. When the leaks came we inspected and repaired the areas we belived them to be coming in. The project manager you had initially left to go to Florida for the sotrms and it wasn't until you called the office we were able to assign a new project mager who came out to inspect. We warranty even our repairs and the additional work was completed at no additional charge. I understand how repairs and leaks can be frustrating and were glad we were finally able to resolve the issue. You can reach us anytime at the office at ###-###-####.

      I do not accept the business's response as a resolution to my complaint because because the insulation and interior ceiling around the chimney had to be replaced after your work. Your company did send representatives to the house to redo the job three occasions. The chimney was replaced from the roof line up with a licensed Mason your company suggested. Following the chimney rebuild, Souther's applied new lead sheeting into the asphalt shingles. Not long afterward the leaks down the chimney ensued. At this time, Souther's sent, Tim C******, to the house to correctly replace the lead flashing and appropriately tie it into the new shingles. C******, took photos and an agreed upon sum of $1000 was to be paid to us for the interior damage of the destroyed insulation and new ceiling. I have continuously called, left messages, and text messages since 12/27/2022. The last time anyone (Paul L****)  responded to me was 1/7/2023. The agreed upon sum of $1000 is well overdue.
