My family and I attempted to rent a home from Lakeview properties / Vatao Holdings LLC. I paid a $1000 holding fee and received no documentation or receipt. The holding deposit was necessary to remove the listing as no lease was available for us to sign. The business owner/property manager verbally agreed that the holding deposit was part of the security deposit/move in costs, which should be refundable. It should be noted that the business owner provided only a lease template for us to sign, and never made edits we agreed to verbally. After two weeks of waiting for an updated lease, we decided not to move forward with the rental due to the business owner's lack of effort and attention to detail, which was concerning to us as prospective renters. I've asked for the $1000 back, to which he promptly refused. I would like to get the money back as no service, or work for that matter, was performed or rendered. The owner has provided no receipt of the transaction, there was no signed documentation between us about the deposit, and no documentation of lost business as a means to charge the deposit has been submitted by the business owner.Business response

Business Response /* (1000, 5, 2022/01/31) */ The $1000 deposit was non-refundable and mentioned in the communications with him. I have promptly responded to all their questions, and sent them the edits yesterday for them to review. Do not agree with their comments that i have been irresponsive and that is evident with the email and text exchanges with Mr.******. Consumer Response /* (3000, 7, 2022/02/04) */ (The consumer indicated he/she DID NOT accept the response from the business.) I do not accept the business resolution to the initial complaint, as the complaint is neither concerning Mr. *****'s responsiveness (he was responsive, professional, and courteous at the time) or how he describes the $1000 "deposit". The $1000 was given to Mr. ***** in good faith, and he promptly abused the trust of our family after being paid. He did so by failing to provide a legally viable lease document. Twice he submitted to us a generic template with language that doesn't even pertain to the property of interest. After asking for a revised edition of the lease for a third time, he gave us the notes version, in which some issues we agreed upon were addressed in the side notes. Even the third version contains some of the same typos and errors that were unaddressed in the first two versions, and required provisions are ignored. Other required documentation was missing in the process. After our exchange with Mr. *****, we concluded that renting from him could potentially jeopardize the health and safety of our family, as it appeared to us that he maintained a process of cutting corners and underdelivering. Each of the three versions of the lease (1/24, 1/27, and 1/30) are attached. It should be noted that the first two versions are the exact same document. The business should have the opportunity to act with integrity and return the $1000 to the ****** family. Business Response /* (4000, 9, 2022/02/07) */ The rental lease agreement was requested to be amended with some unreasonable demands made by Mr.****** such as allowing him NOT to give a 60 day notice and the security deposit paid the same day when they leave. These were non-negotiable and hence the entire process was delayed. He made several corrections. He was informed that the final version will be sent over. Attached is the final version sent. This has nothing with the "NON-REFUNDABLE" deposit paid to "HOLD" the property. I had 5 more potential residents willing to occupy the premises in the month of February. Due to Mr.******'s indecisiveness, I have lost a months worth rent in the amount of $2900 and believe that $1000 is still a loss. Attached is the amended version sent over on the morning on Jan 30th. Note that the lease start date was 02/15. At this time, I think its best for both parties to settle in between. I am willing to offer $500 back to the ****** Family.
