    In mid-March, my apartment building hired Central to come to my apartment and refinish/reglaze a peeling tub. Central's technician caused massive "overspray" damage, coating much of my apartment in white epoxy paint and epoxy paint dust. It got all over my furniture, electronics, bedding, clothings, personal care items, rugs, walls, and even in my vents, etc.. After causing this massive and extremely obvious damage, the technician left without saying a word to anyone. Upon my return to the massively damaged apartment the next day, I contacted my building who then contacted Central. Central sent someone out to survey the damage the very next day, and he admitted the damage was extensive. With regard to my expensive wooden bedroom furniture set in particular, he admitted it was ruined beyond repair, as you cannot remove epoxy paint without acetone or harsh chemicals, which would damage the wood. He promised me up and down that Central would make me whole and replace everything that was damaged. I was told to throw out damaged items and make an inventory. Conversations with the **** *********************************, later that week confirmed the same. I was told again that epoxy paint cannot be removed except for with harsh chemicals, and that harsh chemicals damage wood, cloth, etc. So basically everything in my apartment that got the epoxy paint glaze or dust on it was ruined, unless it was also ceramic. We also discussed the potential negative health impacts of having items with this dust all over it in my apartment. I was told to make an inventory of everything that was damaged and Central would replace everything. That was going on 6 months ago. Since that time, Central has refused to answer any of my emails or calls, and instead directed me to deal with their insurance, who has been non responsive, or made impossible demands. Central's obligations to me/my apt building have nothing to do with whether they can recover from their insurance. They need to pay me!

    It is our position that the alledged incident was likely caused by faulty equipment. Central Pro Services purchases and remits premiums to its insurance carrier to cover claims of such nature. The insurance carrier has confirmed that there is coverage for this claim, and that Central Pro Services should refrain from contacting the other party involved. At the present time Central Pro Services will defer to its insurer and its insurer's decision as we must preserve our rights and refrain from breach of contract with our insurer.

    I am rejecting this response because:

    As previously communicated to Central, Central's ability to recover from its insurance company is irrelevant to the fact that Central owes me (and my apartment building) money for the damages it caused to my personal property in the apartment and the apartment itself.  If Central can, after compensating me and my building for the extensive damage done, later get reimbursement from its insurance carrier because the damages they caused and had to pay for are covered, great.  But even if Central can't recover from their insurance, that does not mean Central does not owe me and my building for the damage done.  Neither me nor my building have any sort of contractual relationship with Central's insurance.  That is between Central and their carrier.  My building has a contractual relationship with Central, and as such Central is responsible for the damages.   

    Central destroyed my apartment.  And then walked out.  They made all sorts of promises, which they have utterly failed to live up to.  This incident happened in MARCH -- going on 6 months ago -- and I have followed their instructions every step of the way.  I did exactly what they told me to do in order to get paid, and they went *** and refused to answer.  I have been attempting to be nice and deal with their insurance carrier since that time.  *************** adjuster is disorganized, non responsive, and clearly has no intention of moving this forward in a timely manner.  And again, their ability to recover from their insurance is irrelevant for purposes of determining what they owe me!  These guys are liars and their contracting work is a disaster.  People should be aware.
