    I visited Tommys Tavern on Sunday September 18th with my family, party of 8. We ordered food as usual. We requested the check at the end. To my greatest surprise there was an additional tax of 2.9% to be added to my total bill of $185.00 for using my credit card. I asked to speak to the manager and she said that she will talk to the general manager. The general manage ************************* came by and spoke to me. I asked him under what ** law is the establishment empowered to add a 2.9% additional tax? His response was this was above his pay scale and blamed it all on corporate. His sole responsibility was to ensure that the bill was paid. He stood firm on his inability to either explain the reason for the additional tax and his inability to resolve the matter. I agreed to paid for the food we ordered ONLY and not the tax. I presented my credit card and the tax was added to my amount despite my opposition. I was like my 2.9% returned to my account.

    Hello Allister. We charge a ****% Service Fee to all checks to cover the increasing costs of accepting noncash payment methods. As an incentive for a customer to pay cash, we give customers a 2.5% discount off the total check including the service fee if they do indeed pay with cash. The entire ****% service fee is only paid by the customer if they choose to pay their bill with a card. The ****% Service Fee is by no means a tax and we do not attempt to mislead anyone to believe it is a tax. We have discussed this incident with our General Manager and retrained the entire team on how to properly explain this charge to customers in the future to avoid confusion.
