  On October 12, 2023, BBB contacted the business regarding its website stating the following:

  1. Prime Deals up to 40% sitewide

  2. Up to 40% Off

  3. Lowest Prices Guaranteed

  According to the BBB Code of Advertising, "Up to" price savings claims

  Where a savings claim (for example, "save up to 40%") covers a group of items with a range of savings, the number of items available at the maximum savings must comprise a significant percentage, at a minimum 10%, of all the items in the offering, unless local, state or provincial law requires otherwise.

  • To avoid confusion or any possible deception, an advertiser should consider including a disclosure of both the minimum and maximum savings available under the offer. In such an instance, the advertiser must avoid any undue or misleading display of the maximum.

  Lowest prices, underselling claims

  Despite an advertiser's best efforts to ascertain competitive prices, the rapidity with which prices fluctuate and the difficulty of determining prices of all sellers at all times preclude an absolute knowledge of the truth of unqualified underselling/lowest price claims.

  • Advertisers must have proper substantiation for all claims prior to dissemination.
  • Unqualified underselling claims must be avoided.
  •  

  Claiming "lowest prices" means that a business constantly monitors the prices of all their competitors and they adjust all of their prices regularly to ensure their prices are always lower.

  Unfortunately, the business failed to respond to BBB's request to modify or remove the claims.
