    Saturday 12/16/2023 I went to look for a vehicle with my friend. Worked with *************************** *************). Advised I can't pay more than $250/month. **** tried to connect me with his insurance broker and quoted me over $500/mo for insurance. I never brought the car home because it wasn't insured. They were closed Sunday 12/17/23. Emailed and called Gabe on Monday 12/18 to get other quotes for insurance, and I called at least 8 other insurance companies - price was the same and told Gabe I can't afford this. Requested he cancel the transaction as insurance was over $500 plus car payment of $262. I put a stop payment on my down payment check of $,2500.00 posted-dated 12/21/23 which he was aware of. I emailed **** to advise of this, and he later asked me if he could deposit it the following week. Advised Gabe again I can't afford the vehicle and stop payment issues on check. He said the car is yours, come pick it up but couldn't take it 12/16 without insurance card and binder, but wanted me to pick it up now. Loan included price of vehicle registration. Unsure if this vehicle is registered to me or not. I emailed Gabe over 18 times. After New Year, noticed the same Jeep for sale on their website with a bow on it, and a button to schedule a test drive. Confronted **** and he said after it's sold he could cancel my loan. Captial One (loan lender) stated dealer has to cancel the loan themselves and requested that Gabe do that. I'm paying for a vehicle they still have in their possession, as listed for sale. Their website shows no employee directory. I want the transaction canceled as requested, loan canceled and reversed as *********** advised, and the hard inquiry on my credit reporting reversed and eliminated. My 1st payment to *********** is due 1/16/24 for a car I do not have. My *********** account # is listed as *************. Vehicle VIN ***************** for a 2012 Jeep Patriot 4WD Latitude in Bright White/Dark ***** Grey interior.

    *********************** did in fact come with her friend and purchased a 2012 ************ on 12/16/2023. She came in, test drove the vehicle multiple times and decided to move forward to the next step which to help her get financed. After a lot of going back and forth with the bank to get her approved with a payment that she's comfortable with despite having challenging credit, we were able to work out a deal. I asked her twice before we finalize the deal if getting full coverage insurance would be a problem, because if it is, then we can't move forward. She confirmed twice with me and her friend that it won't be a problem. Based on that, we signed the contract and had the vehicle sold and scheduled that I deliver the vehicle to her on Monday morning once she gets the insurance. In **, there's no cooling off period. What that means is, once a contract is signed, it can't be cancelled unless it was a fraudulent deal with an identity theft case. So cancelling the deal because her insurance premium was higher than she anticipated isn't a reason. I tried to explain that to her, but she wanted to hear nothing and kept calling me a fraud after I did my absolute best to help her with any concern that she may have had. I was able to convince the bank to have the deal cancelled even if a fee was to be paid. After a lot of going back and forth with her, she wasn't willing to pay the cancellation fee. Keep in mind, that any cancellation that happens, hits the dealer's portfolio with the bank. I was willing to take that hit but I wasn't going to pay out of my pocket a cancellation fee due to her actions by confirming that insurance wasn't going to be a problem and to have the contract signed. She finally paid the cancellation fee after almost 40days of going back and forth and the deal was cancelled on 01/22/2024. It does take **** business days for it to clear from her end. Nice lady, but unfortunately every action has consequences. *****, if you read this, it was a pleasure trying to assist you with your purchase. Next time you buy a vehicle, kindly check insurance rates first and make sure that combined with the car payment, it is something that you can afford. A lot of other dealerships would have told you there's no cancellation and to pound sand and escalate this and get court involved.

    I am rejecting this response because:

    Gabe at Prime *********** mentioned in a prior BBB response (see attachment) that he was "willing to take the hit" on a canceled loan transaction with his dealership and ******* One (lender of the loan). The loan had not been canceled within the promised 7-10 business days so I was not able to file a rebuttal dispute by one day, to the BBB for the $495 I paid to him by ***** which I thought was odd for a business. The BBB file said that the claim was closed at that time however the loan was not yet canceled at that time. I still am requesting the $495 back that **** said he took the hit on. Please see the attached documentation of ****'s statement to the BBB that he took this hit, however, I was not reimbursed for the $495 to date that I paid him for a loan that wound up being canceled. He took the $495 supposedly to cancel the loan yet ******* One told me there was no penalty.

    Again, you can be as difficult as you'd like. The only solution to your issue was the cancellation fee or you keeping the loan. I wasn't going to pay that cancellation fee out of my pocket for your own mistake.
