Dear Sir/Madam: I wish to lodge a complaint against BSI-Enterprises, LLC, 5901 Wyoming Blvd., J-352, Albuquerque, NM 87109, and its agent, Stefan M******. I, ******** *. *****, signed a contract with this company in January, 2023, to reroof my aging tar-and-gravel roof, replacing it with TPO. Of note, I had experienced no/zero leaks since I moved to the above address six years ago. The BSI roofers began work on February 28, 2023. A series of disasters ensued (outlined below), and BSI has neglected to fulfill contractual obligations. Indeed, they have refused to answer all communications from me. My husband, ****** *. *******, spoke with BSI's POM insurance claims adjuster, Chris T*****, on March 23 2023. He had been out to our house to evaluate some of the damage, and we were trying to determine a timeline for receiving compensation for the damage that Mr. T***** had assessed. In that phone conversation, Mr. T***** revealed that he had just heard from two other BSI customers the evening before and was told that BSI was filing for bankruptcy. He promised to look into our claim, as well as the allegation that BSI was filing for bankruptcy-which he said was a total surprise to him-and get back to us the next day. Despite that promise, we have never heard back from him. Indeed, I sent a follow-up text two days ago and have received no response. To sum up our last five weeks of experience, attempts to communicate with Stefan M****** of BSI and now Chris T***** have amounted to nothing. The phone number we have for Mr. M****** is ###-###-####. The number for Mr. T***** is ###-###-####. Neither was I able to use the email address on the BSI website. It came back as undeliverable. Now to succinctly outline our difficulties with BSI: One of the roofers jumped (the word used by his coworkers) from a higher level of the roof to a lower level and fell straight through into our laundry room, bringing with him an avalanche of tar-and gravel, wiping out the insulation, and causing serious damage to our washer (inoperable no due to debris lodged in the drum), dryer (cosmetic damage), and destroying a metal shelf holding both canned and non-perishable foods. To be fair, Mr. M****** sent a fantastic interior dry wall contractor, ** ********, out the next day to repair the structural damage inside our laundry room. He did an expert job, which has been our only positive experience. I have spent the last 5 weeks carting my laundry elsewhere and patiently awaiting the insurance check that Mr. T***** said would occur. The scratched flooring where twenty-three, 4-inch screws, chunks of tar and gravel and other debris landed and rolled around and were scrunched into the floor when the other roofers ran into to check on their buddy has never even been addressed. Even more distressing to us is that one of the scuppers is tilting upward and not draining and, as the snow and heavy rain water accumulated, had leaked into our garage where we stored art. My walk-in shower in our second bathroom is full of canvases and other art work that we moved to keep from getting harmed. I stress that we have never had leaks before. In sum, our house is far worse off than before BSI reroofed it. Due to BSI's non-communication from Day 2, we have extensively documented the plethora of problems with many photos of examples of the above. We are basically a 76 year-old, retired couple living on a fixed income. I saved the approximately $13,315 for the roof, and cannot go into debt to hire another roofer repair what we were told were contractual obligations. Mr. M****** said the roof would need a permit and promised it would b einspected upon completion. My questions about this have been totally ignored. At this point, I am very concerned that if it is true BSI is filing for bankruptcy, will they be exempt from contractual obligations to its customers, or were we just scammed and they took our money with no intention of making things right? Can I make an appointment to come to the BBB office and share our pictures of damage, leaks, etc. and get some sort of direction as to what to do next? I sent a letter to the ABQ BBB outlining my complaintin more detail. On Feb, 28 th we had BSI reroof my house. A roofer jumped through the roof, destroying the ceiling in the kaundry room( ehich BSI DID repair), as well as a washer when tar, gravel, and other debris landed and stuck in the washer drum, a metal shekving was destroyed, and the dryer was cosmetically marred due to 4-inch nails scattering during the fall. Moreover, one of the five scuppers is tilted upward and thus not draining. We now have a leak where the water pools. The POM insurance company adjuster came out and said we would get a check for the laundry room damage. We were promised, both verbally and in contract, that any problems would be fixed. Stefan M****** disappeared after we paid in full and never answered our phone calls or texts ( I have an extensive record of all this). The POM insurance adjuster told us he heard BSI was going out of business and would get back to us the next day.. Now he, too, has ghosted us. I sent a CERTIFIED letter to BSI a well ss another USPS letter and never got a reply. I also sent a letter to POM insurance and have received no reply. How then do I get them to fix problems, pay up for the damage their roofer did, and honor the 5 year contract.? We are senior citizens on a fixed income and don't have money to get another roofer to fix problems that were contractually guaranteed. I am at wit's end. Please help.Initial Complaint

We engaged BSI Enterprises in January of 2023 in good faith to replace the roof on our residence and provided them per our agreement, 50% down ($20, 473.00), ostensibly for the cost of materials. We were made to believe that work would commence shortly after they received our check, but for weeks of little to no communication and purported "family emergencies" dealt to BSI Enterprises, actual demolition of the roof didn't begin until March 7. BSI Enterprises did not pull a permit for our roofing project and consequently, no inspections were conducted during the removal by BSI of the original built-up roof with gravel. An inspection would have revealed the severe damage done to the roof deck by BSI. The demolition crew was not well trained and ill-equipped with tools, resulting in damage to the home's structure. The same crew was used to install the new roof. The contractor, Stefan M******, never visited our residence as promised, during the tear down and installation. An inspection would have revealed sloppy installation of Iso-Board without any crickets or recovery boards resulting in rain water flowing and ponding (3") in the corners of the entire main roof. An inspection would have also revealed the incorrect comingling of Iso-Board and Ply-Pro Polystyrene building insulation with adhesives resulting in continuous noxious fumes in the primary dwelling persisting today. There are numerous code violations. The roof deck tongue and groove has been damaged, broken in several places as well as screws sticking out of the ceiling inside the house. The decking has been exposed to the elements for a few weeks now and some of the decking is now warping which will need to be replaced as well, since the BSI contractor refuses to inspect and rectify. In summary, this roof was installed incorrectly, not up to code requirements and it shows extremely poor workmanship. In March of 2022 I hired BSI Roofing to put à new roof on my house. In March they said everything was paid for and I didn't owe anything. Here 5 month's later (8/30/22) I get In the mail à notice of lien on my property. They are saying I owe 440.14 . I spoke to my Insurance agent he said when he did the inspection he found items that were not done and that is the différence between what the Insurance paid out and what BSI Roofing received.. they are charging for work that was not done. My Insurance has written paperwork and pictures of this. I wish to have this debt canceled and the lien taken off my propertyBusiness Response

SUMMATION: June 2021, we had an aging roof that that Ben R*** of BSI Enterprises, LLC and the AAA insurance adjuster concluded it showed hail damage and needed replacement. I must emphasize that there was no roof leak. We contracted with BSI Enterprises, LLC to replace the roof. During the construction process, that started in September, 2021, we experienced four serious water leaks that severely damaged the ceilings in four rooms. After the so-called final inspection in October 2021, we experienced three serious water leaks that damaged two more room ceilings. There were several attempts to make repairs. This is the story for all: A roofer shows up with the promise to fix everything. They leave sometime later without notice. I go on the roof to inspect their work and find workmanship defects that are new or existing that were ignored. To be specific about shoddy workmanship defects, the seams where the TPO roofing materials are joined together were not in compliance with the manufacturer’s installation instructions found on their website. ******************* Roofing material sections must be joined by a welding process. Our roof, the material sections were overlapped, and adhesive used to join the sections. Several leak patterns on interior ceilings show a long narrow stain pattern that, according to our Independent Certified Roof Inspector, indicates seam failure. December, 2021 roof leaks damaging interior ceilings and walls = 5 in 4 rooms. January 2 & 3, 2022 the snow that happened between Christmas and New Year started melting. Result, sixteen roof leaks in six rooms. BSI Enterprises, LLC made attempts to fix the leaks, same story as above. The most damaging leak result was in our office that resulted in major mold damage. That was repaired by a roofer that, according to our independent inspector, left with two voids in the roofing material that would probably leak. Fortunately, I made a temporary repair before the rain. That one room interior drywall damage was repaired to our satisfaction. This is a legal situation that does not require our response on this platform. Mr. ******** violated his workmanship warranty by having several roofers on his roof facilitating probing tests which resulted in us moving away from any assistance regarding this matter. Mr. ******** has already gotten the AG involved in which case we are prepared to provide our findings directly to them.

I am rejecting this response because: From September 2021 to May 31, 2022 BSI Enterprises failed to provide us a roof replacement that did not leak. We have lost count of the number of leak repair attempts during that 8 months. The story is the same with all: They send "roofers" to fix the leaks. They leave claiming everything is fixed....until the next rain. January 2 & 3 was the high count as the snow from Christmas time melted. 16 leaks in 6 rooms. I was wise to hire an Independent Certified Roof Inspector in November to protect our interests. Chris was invited on at least two occasions to visit our roof to see for himself the shoddy workmanship his gig workers have done. There were too many examples of glued seams and patches that are NOT included in the manufacturer's website Installation Standards, *******************
This complaint has nothing to do with litigation issues. It is simply about a contract to replace an aging roof that did NOT leak.
I must add that June 23, 2022, after a long monsoon rain, two more leaks appeared. Note attached images.
Yes, I hired a roof restoration contractor to finish the roof project that BSI has proven gross incompetence and unable to to the job.
If BSI wants to make a legal issue of their inability to install a roof that does not leak, it will be their choice. I will not be bullied by such threats.

The purpose of this message is to formally reply to the complaint brought against BSI Enterprises, LLC/Bidio Solutions, Inc. by ******* ********. Please see attached document labeled "BSI Enterprises, LLC - ******** Complaint" for reference.
Within said complaint, the customer alleges that prior to contracting us, to provide a roof replacement for his home, there were not any roof leaks present. Please see attached document labeled "******** Supplement", which is a statement of loss from customer's homeowners insurance, which lists approval for interior drywall repair from existing roof leaks, and is dated June 2021; well before any roofing work began on the customer's home.
The customer also complains about roof leaks after our roof replacement was completed; each of which we addressed by our roofing crews as needed in addition to having the roof inspected by a representative from the materials manufacturer, after initial repair(s), to assist in locating any further deficiencies. The representative stated the roof looked good, but did notice some minor issues which were immediately repaired by our roofing crew(s). However, the customer still employed a third party roofing company to provide an additional inspection and thus voided their warranties through Tortious Interference as we reserve the right of repair; please see attachment labeled "2021_12_15_******** 2nd Inspection Report" as proof of third-party inspection.
Additionally, the customer alleges continual roof leaks caused mold growth in conjunction with interior drywall damage(s). Throughout this timeframe we sent our roofing crews to inspect, and repair, any/all roof leaks as needed as we were made aware by the customer. Regarding the presence of mold, please see the attachment labeled "moldInspectionReport_01-11-22_***************" which details all mold levels were within normal limits and posed no danger to the home's occupants. Nevertheless, after the mold report was provided to us another team of ours was dispatched to the customer's home and, this time, replaced the drywall in all rooms of most concern as well as entirely replaced roof decking and subsequent roofing over the entire section of home encompassing said rooms.
After this another appointment was scheduled, for 05/16/22, to have the materials manufacturer's representative provide another roof inspection. Upon arriving at the customer's home, on the date of said inspection, Stefan M****** discovered approximately eight (8) individuals, from another roofing company whom the customer had hired, probing the roof as part of their own roof inspection. We contacted the materials manufacturer's rep and instructed them to not visit the customer's home as the customer, by employing another roofing company, had voided any/all warranties a second time and, at this point, wasn't entitled to another inspection from us.
The customer has since complained to us about all existing matters and we instructed them to pay all outstanding account balances prior to us agreeing to perform any further work.

I am rejecting this response because:1. The insurance claim for roof leaks noted above were repaired at least one year before any claim was considered. I emphasize that the roof to be replaced did NOT leak at the time of the insurance claim.
2. BDI Enterprises, LLC was selected for the roof replacement project in June, 2021. Due to the monsoon rain season word did not start until September 2021. The project should have been completed in a few days. Ben R*** and an inspector for the materials manufacturer inspected and approved verbally the installation. The next day or day after we experienced a thunder storm about noon that lasted a little less than an hour. A major leak appeared in the corner bedroom that we use as an office. It was "fixed" later in the day, Thank you Ben R***.
3. I seems during and after rain since that day, roof leaks appeared. That is eight months of roof leaks and attempted repairs. Most notable Mold developed in the office, and January 2 & 3 when the Christmas time snow melted, sixteen leaks appeared in six rooms. More repair attempts were not all successful.roo
4. April 9, Roofer sent to repair roof damage caused by mold. Repair appeared satisfactory viewed from inside.
5. May 16, Certified Independent Roof Inspection revealed two voids that would lead to leaks from the repair of April. I made emergency temporary repair because rain was forecast the next day.
May 31, Uncompleted new roof project and several roof leak stains visible on ceilings and walls of multiple rooms.

My immediate reaction is SCAM. This ends any contractual relationship with EDI.
6. Two additional leaks appeared. One where the livingroom meets the dinning room, the other over the kitchen stove. This was after a long monsoon rain.
7. I hired a roof restoration contractor to fix this shoddy example of a roof installation. No new leaks detected and I am looking forward to next week when the weather forecast predicts rain for several days.
