    14.6.3.8(A)(1) NMAC "To act in the capacity of a contractor asdefined in Section 60-13-3 NMSA 1978, an entity must be issued a license."

     

    60-13-3 NMSA1978  "Asused in the Construction Industries Licensing Act, "contractor":

    A. means any person who undertakes, offers toundertake by bid or other means or purports to have

    the capacity to undertake, by himself or throughothers, contracting. Contracting

    includes constructing, altering, repairing,installing or demolishing any:

    (1) road, highway, bridge, parking area or relatedproject;

    (2) building, stadium or other structure;

    (3) airport, subway or similar facility;

    (4) park, trail, bridle path, athletic field, golfcourse or similar facility;

    (5) dam, reservoir, canal, ditch or similar facility;

    (6) sewerage or water treatment facility, powergenerating plant, pump station, natural gas

    compressing station or similar facility;

    (7) sewerage, water, gas or other pipeline;

    (8) transmission line;

    (9) radio, television or other tower;

    (10) water, oil or other storage tank;

    (11) shaft, tunnel or mining appurtenance;

    (14) air conditioning, conduit, heating or othersimilar mechanical works;

      ******************* of TLC( Trinity Legacy Consortium LLC) was hired to build a house by a river. ******* claimed to be a custom home builder for 25 years and a civil engineer. Shortly into the project we discovered ******************* did not know even the basic requirements to build by a river. TLC abandoned the 12 month project after 10 months completing only ***** % while collecting 92 % of the contract price. We were forced to *** in court and were awarded almost 100% of our lawsuit. Breach of contract, duplicate billing ,building defects and improper use of change orders by **** and ***************** were identified by the court. We only received 16 cents on the dollar as the Swifts filed bankruptcy with a long trail of other lawsuits and numerous unpaid creditors. I can not stress enough that you do not want to use *******************, Trinity Building Systems, Trinity Legacy Consortium, TLC Log Homes, etc.
