I was contacted from SW Mediation from an ********************* stating that there will be a civil action being filed against me from a magazine company back in 2015. She was calling to settle the debt and said that I would be taken to court and that they will play a recording that I am in breach of contract. I do not remember this subscription and this was back in 2015. The business I had I closed at the end of 2014. she said that she has payments made by me in 2015 which again, that business was closed at the end of 2014. I filed bankruptcy twice and any and all debt that I owed was on my bankruptcy.

My family was contacted by **** from SW Mediation prior to her calling my phone number. I immediately called and she mentioned that she was trying to discuss my account from 2017 *********** and how it would go on my credit report as a negative item. I told her that this was an alleged debt and to send proof. She said the statue of limitations to collect had expired and she was trying to negotiate an agreement to keep it off my credit report. I told her the statue of limitations according to the **** had passed and that she couldn't and that it was also shady as h*** And also she was in violation by contacting my parents. And in violation of FDCPA and 15 U.S Code 1692d. I told her again to send me proof, to cease all communication with me or anyone associated with me and remove me from their list due to these violations. I will be notify all credit bureaus about this and filling a civil suit against the mediation company if this is not rectified. I will also notify ****************.

****************, ********** contacted you as a third party Mediation Service and not an attempt to collect a debt. Those options and regulations expired under the fair debt collection practice act.  Our documentation has a family member as a reference you used when applying for a monetary loan. We used the information provided to us from the client and no other information was used at that point. Per this BBB complaint we are instructed to return this delinquent account back to the chain of title owner as a refusal to pay and you will not hear from our office moving forward.

I have received a call from an ****** stating that she needs to speak with me about a civil action suit but used my old last name. I have not had the name she is using in a long time now. I have yet received any type of bill in the mail as again the last name she is using is old and has not been used in a while. My last name has changed due to marriage, therefore I have no idea what could be owed.

A women from this company contacted me stating that I owed a magazine company 23 payments of $39.99 from a contract I verbally agreed to from ************************************************************************************* full and if I don't pay the balance the company intended to file a civil suit. I requested the name of the company and reached out to them directly for further clarification. They were unable to find me in their system and stated that no such lawsuit was being filed and if someone was contacting me on their behalf I would need to request debt validation via U.S. mail and to call them back with any reference or case numbers I was given. I have not yet received anything via mail regarding this situation. Be very careful if they contact you for payment!

****************** was contacted by our office regarding a Magazine service contract that she entered into while residing in *******, IL the service provided US Weekly, Marvel Super ************** Junior, Cosmopolitan, Every day with *******************, & ********************** Yes the service was $39.90 for the first 23 months and the next 24 months the magazines are paid. She made 3 consecutive payments then stopped. The collection process started in house with Prime Time Readers Service and eventually this delinquent account was sent to our office for mediation. If ****************** did in fact contact a sales office they would not have the account active in their system as we have it so she would be correct. That being said this account and ******************** complaint will be forwarded back to the company that owns this outright and ****************** will not be called from us again as we have sent it back for review.

This company is leaving threatening messages stating that I owe money to a company but fail to supply any supporting documents that I requested. I told the mediator if its mines i will agree to the plan if provided the right documentation. They said a civil suit will be filed against from 2018. I told them I am unaware of this company. I contacted the company and spoke with Supervisor **** and customer ********************** rep **** from the company they said I owe and they said they are not filing a civil suit nor do they have knowledge of said loan. South West have my personal information and said they received it directly from AWL in January. The company said that's not true.

**************, Our office follows a strict policy when leaving a message regarding a settlement or unpaid balance on a contractual agreement. The Fact that you contacted a client outside of mediation only leads this account back to the owner and our power is removed over this account. We have forwarded this matter back to title owner on May 25th, 2024 and you will not hear from SWMS again as all information was removed at that time.

My family was contacted by an agent named *************************** from Southwest Mediation Services. I was not contacted. I called to see what this was in reference too and how they got my parents information, when Im 48 years old. She claimed that I am being sued for $2100 by a cash net company for an alleged debt from 2017, related to a company with which I have never entered into an agreement, neither with my signature nor any other documents. I asked for proof and she told me they dont have to send me proof. She said its going to be filed on Monday I informed her that this constitutes a violation of the Fair Debt Collection Practices Act (FDCPA), the Fair Credit Reporting Act (FCRA), as well as 15 U.S. Code 1692d regarding harassment or abuse, and 15 U.S. Code 1125 concerning false designation of origin, false descriptions, and dilution forbidden. I also stated that there is a statute of limitations on debt collection and she said that this was a civil suit that they were requesting the $2100 plus $3500. I again said I never signed anything. I had identity theft back then. They even had my employment. I said there is a statue of limitations on civil suits and that is 3 years. She kept saying they dont have to send me proof and that it was going to be filed Monday. I requested that they send me proof and cease all communication with me and remove me from their list due to these violations. This company has been calling from the phone number ************. I will be notifying all credit bureaus about this and filing a civil suit against the mediation company if this is not rectified. I will also notify the *** and Clark **************

    Business Response

    Date: 04/19/2024

****************, As indicated in the phone call after we properly ID yourself this was not an attempt to collect a debt but rather a chance to mediate a settlement outside a potential legal setting as the lender is seeking compensation for a loan you did not honor. In doing so that call generated this BBB complaint and at this point we must send the communication and account back to the our client as a refuse to pay. In closing all of your information is removed from the data base and no further contact will be made.

This company reached out 4/17 regarding a complaint in their office that was apparently filed against me. Stating a case of ******. They then followed through to call family associated with me with in minutes of missing me. I did my research and have no desire to speak or work with a company with predatory tactics and unprecedented procedures. Whatever they are reaching for needs to be marked as a refusal or this will be deemed harrasment.

I had receive a call today by this company Southwest mediation. When answering the call, I was automatically told I owe a debt by a loan company and also told that I was going to be sued. I didnt verify anything but my name. I let representative know That I dont owe no debt or remember any obligations at all. I told the representative to submit over the original documentation that shows I owe that debt from the Original creditor. Representative is very Unprofessional, Rude, Not knowledgeable of any of the laws. I told this representative to stop calling my phone until I get the original documents that I supposedly signed this loan. The representative stated that she will continue to call my phone . I also was told that I must had a brain injury because how I didnt remember. I deal with chronic depression and anxiety that is nothing to play with. I also let them know I did record them being unprofessional stating these things to me and also not giving me the original documentation that I requested. I do not like being harassed and I do not like being talked to unprofessionally. I let them know to cut all communications off because the Original documentation from the original creditor was not shown or proven.

******************, Our office will answer a complaint vigorously as we have been instructed to make contact with you for a Bank Transaction loan you did not honor. The validation of debt was provided by two collection agencies who also mailed out ******* letters to two addresses on file. After those unsuccessful attempts they opted for mediation and our office received the account for processing on 04/04/2024.  This complaint will address the reason for the call not the back and forth between our mediation staff and yourself. Once we verified the debtor of this account with information you provided to this company in including your social security number, driver licenses, Bank information for  educators credit union and deposit of funds provided by the lender we in turn made the phone call to address this outstanding balance that you claim you don't remember. In closing we have sent this complaint and account back to the lender for processing per office procedure and you will not hear from SW Mediation again.
