I entered into a timeshare contract with *****************, which I legally canceled within the required 28-day period. Despite assurances at the time of signing that reservations could be made freely except during Christmas and New Year, we have been unable to use it since 2004. Unavailability has made booking impossible. High fees contradict the original promise of minimal increases during this agreement. I live on retirement income, and I can't afford this. The co-owner is no longer able to contribute, as a medical condition prevents her from traveling and working. Despite these hardships, they refused to provide any resolution. I was informed in June that my request had been forwarded to their legal department. I was told a letter had been sent on August 28th,which I never received. Only after further complaints was I informed that my hardship request had been denied, despite over 19 years of highly limited use of the timeshare. I am rejecting this response because:We are rejecting this response because we have already attempted to contact the resort directly and we were completely ignored.
We tried mailing the resort at *************************************** **********************************. We have tried emailing *****************************************************. We finally received a response back stating that they forwarded our concerns to their legal department and after months and months of follow-up last year, we finally learned our request had been denied. Even getting that response was a hassle. They claimed to have mailed a letter to us, we never received it, and then they didn't want to provide us with the information that was in the letter! It is obvious that they are not interested in helping us. This matter is not resolved, and that is why we are reaching out via the BBB. We need their assistance and hope that they can work with the resort to bring us an amicable resolution.

I am writing to file a formal complaint against **************************** regarding my timeshare contract. Despite my repeated attempts to contact the company, I have received no response or acknowledgment regarding my requests to cancel my timeshare.Over the past several months, I have sent multiple correspondences to **************************** asking for information on the process and procedures to cancel my timeshare. In 2019 I met with a salesman that told me I could sign up for a vacation membership. He communicated this was not a conventional mortgage and as it was not, wouldnt be on my credit. This conversation was started because I said I dont have the credit to make a conventional mortgage purchase. Things seemed to line up as I paid some many down was making some monthly payments, and nothing was on my credit. When COVID hit, like many Americans, my business crashed and closed. I was communicating to them that I cant continue to participate. Again nothing on my credit, so I did not think there was an issue. This year, everything changed and suddenly there is a conventional loan from then on my credit report, now beginning to show as delinquent. In addition, my friend also tried to get a membership but was told she doesnt make enough. He said she could be added to mine without even using her info, just as a second ***** I did that and theyre also reporting on her credit, and it wasnt even hers. BACK IN 2021, WE DID INFORM THE RESORT WE DID NOT WANT TO PARTICIPATE IN THIS OWNERSHIP BACK IN 2021 DUE TO IT WAS NOTHING HOW THE SALESMAN SAID IT WOULD BE, WE DIDNT EVEN GET ACCESS TO THE ACCOUNT UNTIL 2-3 MONTH AFTER OUR INITIAL VISIT TO THE RESORT. ONCE WE GAINED ACCESS, NOTHING WAS HOW THE SALEMAN SAID IT WOULD BE. THEN UPON RECENTLY CHECKING MY CREDIT REPORT, THERE IS AN ACTUAL CONVENTIONAL MORTGAGE ON IT. WE WOULD HAVE NEVER SIGNED FOR A MORTGAGE FOR A TIMESHARE THAT WE CAN ONLY USE FOR 6 DAYS EVERY EVEN YEAR. IF ANYTHING WE WOULD HAVE BROUGHT AN ACTUAL HOUSE. AND WHO WOULD AGREE TO SPEND $118 PER MONTH FOR THE NEXT 99 YEARS KNOWINGLY.THIS WHOLE PROCESS WAS EXPLAINED AS IF, WE WERE GETTING INTO A PROGRAM WITH THE RESORT WHERE, IF PAID OFF WE WILL HAVE ACCESS TO A TIMESHARE AND OUR KIDS TOO AND SO ON. ONCE WE GAINED ACCESS TO THE ONLINE ACCOUNT WE FOUND OUT THAT USING POINT ON HOTELS CARS ECT. WAS A SCAM. THERE IS A *** WEBSITE THAT WE ARE INSTRUCTED TO GO TO FOR DISCOUNTS ON THINGS LIKE CARS OR HOTELS. IF YOU ENTER POINTS TO BE USED TOWARDS THE ***** PRICE, IT MAKE IT LOOK AS IF YOU ARE GETTING A DISCOUNT. HOWEVER, IF YOU GO TO THE ACTUAL COMPANIES WEBSITE LIKE ENTERPRISE OR A SEPCIFIC HOTEL YOU FIND OUT THAT THE PRICES ARE THE SAME OR EVEN LOWER THAN WHATS ON THE *** SITE.WE HAVE NEVER USED THIS RESORT OR ANY PARTS OF IT OR THE PROGRAM. I am rejecting this response because: On page 2 you state The company has reason to believe that we have obtained the service of a exit firm or consumer advocate attorney. I don't see how you can believe this when we have not had anyone reach out to you on our behalf, we communicate to you on our own. That *** be the normally route others go through to get out of the misrepresented time share you offer but we didn't. On page 3 you keep speaking as if you were the sales representative or you were there through the presentation with us, by making statements like 'Please be advised no representation would have been made in term of the value and projected investment in return. Or you were also advised the *** was a independent exchange company.... No we was not the representative talked about them as if they were apart of your company. You cant speak on what was told to us if you wasn't there.You mentioned your company does not offer resell programs of offer owners assistance in reselling, but the representative told us that we would be getting the timeshare from a military family who does not want it anymore and they are trying to sell their timeshare to get out of the program, so if we got approved we would be taking over their share. Guessing that was a lie too.
You mentioned Foreclosure: Timeshares don't qualify for traditional mortgage loans because you're purchasing a share of ownership with usage rights to the property. The timeshare company *** offer its own financing, at which we were made to believe that's what we were approved for. A financing for a program the company was offering. but on our credit reports it is listed as a conventional mortgage, we would have never agreed to sign for a mortgage where we do not have physically keys and/or unlimited access to the property.
There was no income, employment or previous housing verification things usually needed to apply for a MORTGAGE. per page 2, where you spoke on the contacted area for the amount and time frame of the contact, if the contact say installments for 120 months, why does our credit reports state different. Transunion $191 for 144 years, Equifax $191 for ************************************************ September 2021, why did it take until July of 2023 to show up on our credit reports, especially since payments were not made and you have listed this contact as a mortgage.
Also we didnt wait 2 years to complain about the ownership as you tried to make it out to be. we complained in 2021. We are reaching out now because in 02/2024 we have just seen this pop up on our credit reports, Years after no payments, communication and multiple cancellation requests.
You also stated you have no complaints from us, that's what all untruthful company reps. say when the customer is complaining and you are the first one to work the account. However in 2021 when we finally got access to the program after multiple weeks, could of even been 2 months after signing ( Check your records) we complained immediately and told them we did not want to participate in the program. So the statement made about having a Welcome call after and no complaints were made. This is because we didn't even have access to the program to really see what it was all about.
Bottom line is we did not apply for a Mortgage and it should not be listed this way. in 2021 once granted access the program and determined it was not how it was explained to us we requested cancellation for misrepresentation.

We are contacting your company in hopes to have you cancel both contracts we have listed in the top of this letter. Back in June of 2021 we were called to an upgrade meeting we were told would take 45 minutes but ended up taking closer to 3 hours. On top of already being frustrated about being told we had to attend this meeting, the both of us, we feel were lied to about numerous things. To list a few, our cancellation period was not once pointed out or made aware to us, we were told it was an investment which it was not, they told us we could resell or rent our timeshare but failed to make us aware of how difficult that even is, and lastly, we were not made aware of any additional fees we had to pay.We feel the cancellation period should have been considered pertinent information for us to have been made aware of especially when making a purchase of a timeshare for the price we paid for it.We feel we are entitled to a cancellation and full refund of all the funds we have put into this timeshare since mistakenly signing up as we were taken advantage of and pressured into doing something we didnt really want to do. Had the cancellation policy been made aware to us we would have cancelled within the realms of what was described in the contract, but unfortunately that did not happen. Yet another disappointing time for us to realize as well. We have remained current on all of our payments if you would like to do us a favor and cancel our contract.We were told buying this timeshare would be an investment, and if we wanted to, we could resell or rent out our timeshare for additional funds when we were not making a turn of profit. Yet Im sure your company is aware of how difficult it is to actually rent out a timeshare or even resell it for that matter. Thus, we are stuck in this current circle of feeling like we were lied to at every turn and has made us very regretful for even listening to the sales rep you had out there selling these timeshares to people as well. This has been everything but an investment so far, we have been constantly investing in points,and investing in maintenance fees, annual fees and none of that seems to drop the price down by much. We simply cant afford continuing to invest in something not really worth investing in if all we have at the end of the month is another hole in our pockets that seems to never end. At this point all of the fees and money we have invested seems like a huge waste of our time and money since we cant sell it and no one wants it, and we cant rent it because no one wants to pay what we pay so that we can recoup some of the funds we wrongfully were convinced we were investing in.Lastly, we are very upset about the fact that one upgrade meeting that was supposed to take up only 45 minutes of our time ended up being 3 hours long, only for us to feel pressured and forced to sign the contract when all was said and done. If I didnt know any better, I would think that it was all a ploy to get us all buttered up and tired from all the talking that we would just sign. Seems like it had worked if that was the case. We are very disappointed with how your company representatives had handled themselves and the meeting we had with them. A lot of the presentation was just someone going over all of the things I pointed out to you earlier in this letter and how much they have been proven to be lies since. How can you take up 3 hours of someones time only to lie to them, I dont think I could ever work for or do business with a company that delves in schemes such as these. Which brings us to writing this letter to begin with. This timeshare has not only proved to us we were sold a bunch of lies, but that it is nothing but a headache to own or have under our belts. It is not an investment, it is not resalable, it is not rent-able, and last of all it is a waste of money to even be associated with having one. All of the information we have, we dont mind moving forward with complaints and getting attorneys to settle this.A timely response would be appreciated as we know most companies like to take their precious time in saying no to the cancellation. We are willing to work with you on whatever you can offer us, but we would like a response in return. The Asny company is hard core pressure sale's and there is no way to get out of this horrible timeshare. They pressured us into buying through complete lies about points and vacations and now were stuck. I talked to them multiple times and explained the situation and they are unwilling to do anything. we paid 1000s of dollars for something we cant even use because there is never anything available. I went to a timeshare presentation in August 2023. The salesmen used deceptive tactics to get me and my children's father to purchase a timeshare. I told the salesman that I could not afford to get the timeshare. Because, I would be having surgery in September and would not have the income that I reported to them. Because, I would not be working anymore. He told me and my kids dad that we would have to purchase the timeshare now in order to get the deal and that the company would work with me in anyway because, they in house finance and not through a creditor. I told him it would be a 100% chance that I wouldn't be able to make payments he told me and my kids dad that all I had to do was call them and they will work something out with me. They would do whatever they had to do so, I can have this timeshare even if it meant him coming out of his pocket. I also, had my mother listening in on the the line because, I was doubtful about getting into such contract without the approval of my mother and children's father who would have to make majority of the payments until I start back working. I could not afford to make the payments I called to speak with ******* and she basically said if I don't come up with the money they will cancel the contract and keep all the money. The last payment was due on December 28, 2023 on January 5, 2024 they sent me letter saying they cancelled the contract and are keeping all the money I paid. If this is not resolved I WILL BE FILING IN SMALL CLAIMS COURT.NEVEDA LAW STATES:****** law prohibits timeshare developers or salespeople from engaging in unfair or deceptive acts in a timeshare transaction, including: misrepresenting or failing to disclose any material fact concerning a timeshare.Business Response

This company is running a travel club membership fraud. I initially signed up with The Ansy Company LLC in August 2022. As my contract states Im entitled to exchange my 10k points yearly for different vacation properties across the ************ Since paying for this membership Ive called and tried to book a property at least 10 times. Every single time I try and call to book something they have absolutely nothing available and like I said this happens every single time I try and use what Im paying for. This company is an absolute fraud. Ive even had certain employees with their company tell me this is normal and tons of costumers are upset. Since August 22 Ive paid roughly $1400 in payments and Ive gotten absolutely nothing out of it. They are in breach of our contract as well.Business Response
