On May 30, 2022, I purchased a truck shell for my truck. I put a $300.00 deposit down as it would take a few weeks because it was being ordered new form the Manufacturer ****. I received a call a couple of weeks later and was told my shell arrived and it could be installed. When I went to have it installed I noticed they had put a riveted placard on the back of the Shell reading Camp-Out Inc. I told them I would like the advertising placard to be removed and they said they would not remove and that if I paid $100.00 more they would send it back to the dealer and get me a new one without it. I told them it did not have that advertising placard in their **** catalogs in the store. I was told they do that with all their shells. I told the owner Chris I was not going to pay an extra $100 when it never should have been on it in the first place. He denied me my $300 deposit. The owner Chris was very unprofessional on the phone and I told him I did not want to argue with him and left. I attached a similar placard I found online so you can see what I am explaining.

      Business Response

Business Response /* (1000, 5, 2022/06/30) */ On May 22nd 2022, Mr. ****** purchased a **** Truck cap for his pick-up truck from our dealership. We spent some time going over the whole order and the specifications to his request. He left a $300.00 deposit, verified the order was correct, and signed off on the contract. A couple weeks later the cap came in and we notified Mr. ****** and scheduled an appointment for installation. On the day of his installation Mr. ****** came in and refused installation after looking over his cap. He stated his refusal was because our dealership logo was installed on the rear door. We told him it was a standard practice in the industry and pointed out all the caps on our lot, the same caps we showed him on the day he purchased his cap, have the same logo on them as well. Mr. ****** is not the first customer to request no logo and we mentioned this to him that this would not have been a problem at the time of purchase and would have been noted on his contract as all the other requests were made. We do charge $100.00 more for this request as we give our customers that keep our logo a $100.00 discount. It's in the same vein as the auto industry that logos all of their vehicles. Mr. ****** has his dealer logo currently on the back of his truck where he purchased it from. When I brought this to his attention he said that was ok as well as the **** sticker on the cap, but he is prejudiced against my dealership name on the unit. In an effort to resolve this issue, I offered Mr. ****** the same $100.00 that would be charged prior to me ordering his cap and to order him a replacement door that would have cost me in excess of $400.00 even though it was something that should have been requested at the time of purchase. He responded he would split it 50/50 but I told him that wasn't acceptable because it was something that should have been requested at the time the cap was ordered. But I was still willing to offer the replacement door at the $100.00 charge. Even though Mr. ****** only placed a $300.00 deposit to order this cap, I paid in excess of $2,000.00 the day it arrived from ****. If he chooses not to go through with this special order purchase, there is a 40% restocking fee that will be charged to my dealership and in turn will be charged to Mr. ******. The clock is ticking and we need a decision to be made in the near future. Mr. ****** mentioned the **** catalog does not show the Camp-Out Inc. logo. He did not purchase the cap from ****. He purchased it through Camp-Out Inc. **** only sells caps through a dealer network. Enclosed is a copy of the signed contract. There is no mention of a request for no logo at the time of purchase. ***************************** Consumer Response /* (3000, 7, 2022/07/07) */ (The consumer indicated he/she DID NOT accept the response from the business.) As you can see the owner is inserting many items that are not in the contract. 1st, I purchased the LEER shell through Camp Out who was purchasing it directly from the manufacturer. I did not purchase one of their shells that was In the showroom. Per their contract, under section #9 it states, "Buyer has examined the product and finds it suitable for buyers particular needs. Buyer has relied upon buyer's own judgement and inspection in determining that it is of acceptable quality. On the unit ordered, buyer has relied on buyer's inspection of the display model(s), THE BROCHURES, and bulletins and /or the floor plan provided to dealer by the manufacturer, in making buyers decision to purchase the unit described on the reverse side of this agreement." As Chris admits I did rely upon his BROCHURE in the showroom which none of the brochures show the LEER shell being modified with a CAMP OUT INC placard riveted into the shell. I do not want a shell that has been damaged with rivets or screws put into it. It does not state in the contract about a company placard being placed on the shell. Had it mentioned it, I would've spoke up at the time of purchase. It did not show it on the brochures in his showroom OR IN THE SIGNED CONTRACT. The argument made about my truck having the manufacturer name on it is ridiculous! Of course it will have the manufacturers name but not the dealership I purchased it from riveted into the steel of the truck! Example- If I purchased a pair of **** shoes from ******* they Will not come with the ******* logo or name directly on the shoe. I tried to be reasonable with the owner Chris and even offered to split the 100.00 between us 50/50 and he refused and said I was prejudice against his dealership. After he spoke those words, I did not want anything to do with his business and walked out. I'm sure I'm not the only complaint with this business as I can see now how they operate! He mentions a $400 restocking fee. Where is that in the contract? Its not in there. Nor does it state I authorized him to damage the shell by putting rivets/screws into it!
