      The company was contracted to install exterior siding on my home. I requested that all colors to be the same: including boxes and gables. the rep stated that is all included in the trim work. I asked the rep via text and verbally that all colors will be the same before signing contract. He mentioned the gutter did not come in the requested color so I conceded to for a different color option. Work was going well until they started to install white trim on boxes and Gables. I stated that not what was discussed. The corrected the problem with the boxes and the sales rep the color for the ***** isn't in yet. Meanwhile the trim around my garage door was supposed to be in the same color ( Mocha ). I was also that he is working on that. After the siding was up the trim around the garage doors was filled in with brown trim. The rep stated the colors only come in Brown ***** and White. I stated when were going through negations that color of this home is supposed be Monochromatic. He stated " i assumed our suppliers would have the colors" I advised you can make assumptions when it comes to business. At the time they closed up the my ***** opening completely. The rep stated they don't have the color in Mocha and said we can paint it. I agreed as long as the color matches. the came back in put in place a ***** that the color did not match. The next problem was with the gutter topper they stated the toppers don't come in that color ordered. after about 3 weeks of trying to get me to accept an offer. I asked for a 4k discount and on that same day with an hour of my conversation with the rep they found the gutter topper color. The whole time i talked about the ***** color he stated that we dont have the color so i asked for the discount they were offering for the inconvience of not getting the color i want. 11/4 was the last day worker were at my home. 11/6 they charged my CC for ***** totally with out getting back to me. they said my account was past which is was never.

      Although it saddens us that homeowners are sometimes overwhelmed with contracts and details, all items in the contract are and have been completed.  Regarding offering a inconvenience discount, that just was not possible at the time.  Regarding the screenshot of a text. The text is from the homeowner asking about the trim being included and in the text the homeowner themselves says its not checked off and the following text says no

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

      The text says it all the rep is on board stating in the text that all colors are supposed to be in " Mocha" He also states that he doesnt need check of the trim.  **** has failed to do that includes the Trim around my the garage door too which is not. Also the Gables. The text is not left up to interpretation, it is a matter of fact.  it is an unfair business practice by **** stating they will fulfill the obligation to get the contract and not follow up. This is more than inconvenience **** never even esponded to until in the previous message, to say a discount could not be done. 

       

      I would like to ask ****: are all the colors in "Mocha" besides the gutters?

      On June 2nd, 2022, the homeowner called our firm for an estimate on replacing the siding and gutters on entire home.
      On June 7th of 2022 we had a technician visit the property to take some pictures and measurements before we sent out the estimate. We sent the estimate the same day with all details and information on the estimate.
      On July 12th, 2022, the estimate was revised and sent to the customer.
      On August 1st, 2022, the estimate was revised a second time.
      On August 23rd, 2022, the estimate was revised for a third and FINAL time before both parties came to an agreement.
      On August 24th, 2022, the agreement was signed by the homeowner.
      On September 26th, 2022, the project began .
      On October 1st, 2022, the project was completed.

      Upon completing a final walk around with the homeowner, he had a few issues and a small punch list for our guys to complete with the project. We sent our guys back immediately to address the homeowners concerns.Upon completion of the punch list, we tried to reach out to the homeowner several times for final payment and he refused to pay the final balance.Homeowners reasons for not paying the final balance were suddenly not having the ***** vents in a specific color that he assumes he requested our firm to install which we have checked the agreement and nowhere on the agreement it mentions that color that he is requesting to be installed.
      The homeowner had an issue with 2 Plastic ***** vents that cost no more than a couple of hundred dollars if that. (Let me remind you the homeowner is holding a final payment of $********)

      With all due respect to the homeowner, we have revised the estimate multiple times and if at any point of time something was not right on the estimate, we could have addressed it and revised it before the project began.
      Unfortunately, this was not the case.

      We tried numerous times to work with the homeowner and produce a resolution, but it seemed to us that the homeowner was not willing to work with us besides to reduce the final bill by ******** with no explanation behind it. (Our firm did NOT agree to this)

      We were going back and forth with the homeowner for a few weeks and eventually we acknowledged it was going nowhere.
      On November 7th, 2022 (well past 30 days of completion date) we charged the remainder balance of ******** with the credit card we had on file.
      On the agreement signed by the homeowner we have very specific work terms and disclosures that were accepted by the homeowner.
      Line number 6 specifically states 6) All open balances will be charged to credit card on file after 7 days. (This was well passed 7 days)

       I never refused to make payment. The ***** color was an issues from the beginning once I was told they didnt have the color. I was promised everything was going to be in Mocha the ***** was not something that came up last minute  Also who from the company  who tried to contact me? Because I only spoke to the salesman the whole time  and he will tell I never refused to make payment  I advised him that the gutter were not completed and still have the problem with the ***** color  we talked about working out a number for the ***** not being completed in the color he asked what I thought was fair  I have home a number he said he will see if t  works  I never heard from him after speaking to him again on 11/7/22  on 11/1 the gutter topper were installed  on 11/5 workers came back to the home   My account was never past due  again to complete some work on the front of the house  technically, my account would of been past due7 business days after the 11/5/22  but the company disregarded contact me about anything a charged my account way before the past due due  so they are in fact breach of the contract
