      This Collection agency has been sending me texts about an account and person who is not me. Their text messages indicate to stop receiving texts from them to reply with STOP. I've done this several times and they simply send a text from a new number and don't actually stop the texts. The latest one was today 6/2/2022 at 10:58 AM CST and it looks like the texts started on 5/12/2022. Since following their instructions is not halting the communication harassment (it is harassment due to them having the incorrect person) I'm submitting this complaint in hopes this will stop the communication and the agency will remove my number from the account.

      Capital Link Management (CLM) is sorry to hear this individual is getting unwanted texts. CLM uses a third-party vendor for this process. We will look into the allegations and find out why this number continued to send messages. Meanwhile, CLM has removed the number from the account. The consumer will receive no further texts or calls from CLM.

      This collection agency has called and texted my phone about a person named "***** *****" (that is the name in the texts; I have not received a voice mail, only calls/hang-ups). I do not know who this person is. I have had the same phone number for several years. Do not contact me further.

      Capital Link Management (CLM) is sorry to hear that this consumer had a negative experience. However, CLM returned the account that this number was attached too, back to our client, ****** **** nearly two months ago. CLM has not sent any calls or texts since then. CLM will forward this request to our client. If he receives any further contact, he will need to contact them directly.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      The response from CLM says that they haven't sent any texts in over 2 months. I have attached a screen shot of my phone showing one of the texts, from 10 days ago. I called that number, and it is CLM.

      CLM would gladly supply documentation to support our claim of the account being returned. However, since the complaining party is not the consumer on the account, providing this document would be a breach of that individuals privacy. CLM would gladly provide the proof in court under subpoena. CLM no longer has the account, will not be making any further calls on the account. If this person is continuing to receive calls, I suggest contacting the account owner of **********

      Calls and texts falsely stating they have legal obligation to locate me. It’s a debt collector and I understand one call a day but more than 5 calls plus text messages while I’m at work is borderline, if not full blown, harassment.

      Capital Link Management (CLM) is sorry that this consumer feels he is being harassed. However, the Fair Debr Collection Practices Act (FDCPA) and Regulation F provide for a collector to be allowed 7 attempts within a 7-day period. A review of the account notes and call logs show this limit was not exceeded by CLM. Also, the text that the consumer himself provided does not state CLM has a legal obligation to locate him, it states we are trying to locate him to provide a legally required required notice. This notice is a 1692g notice as outlined by the FDCPA which debt collectors are required to provide which includes the consumer's right under that law. CLM has performed within the limits of federal law and not committed any violations. CLM has closed the account within our office and will return it to our client at the end of May. Please note the client will be reassigning the account with another agency at that point.
