I asked the company not to contact me, and they started calling my work phone, in which I would have gotten fired. I have so much evidence that they keep calling and contacting me after I clearly said I didn’t want any contact. I even emailed the company letting them know what was going on and still it’s going on. I have an anxiety disorder and two autoimmune diseases. The out come from this harassment is that I’ve been having anxiety attacks and one of my autoimmune diseases is piggybacking off of my anxiety. So now I’m having seizures.Business Response

Upon receiving notification of the complaint, RCS Capital Partners conducted an internal investigation regarding this matter. Upon review of this matter, it was found that we had been attempting to contact Ms. ******** regarding an account that was recently placed in our office. Our office mailed Ms. ******** a letter and attempted to get in contact with her via telephone with the phone numbers provided on the account. After getting in contact with Ms. ******** she explained that it was not a good number to receive personal calls at as it was her place of employment and requested that all calls were stopped. After receiving this information our representative immediately removed the numbers on the account and placed into “Cease and Desist”. Our representative apologized for the inconvenience and explained that the numbers were removed, and her account was closed as Cease and Desist in our office and ended the call. Our company has not attempted to contact Mr. ******** after, other than to respond to her emails requesting her account be placed in Cease and Desist. We apologize to Ms. ******** for any inconvenience encountered during this matter. Thank you for your attention and cooperation regarding this matter. I have received multiple upon multiple calls from this company. I don’t answer calls that I don’t recognize so it goes to voicemail. The number that shows up has a local area code, but the number they give in the voicemail is an *** number. After researching, I have found out that the number belongs to RCS Capital. I tried calling back before and got into contact with a representative and they wanted verification of who I was. I’m not giving personal info to ANYONE I don’t know. After some back and forth, I was hung up on. Now this company is calling relatives and who knows who else. Please stop calling my phone number and quit trying to contact any relative, friend , business, associate, or anyone else that you have been harassing with unsolicited phone calls. You may contact me by email so that I can verify who you are and what you want. Also, I’ve went to your website numerous times and y’all seem to be having issues. I get an error message and my browser won’t open your site, so I checked to see if your site was up and running and sure enough, it wasn’t. Upon review of this matter, it was found that we had attempted to contact Mr. ******** as a follow-up to paperwork that had been sent to him regarding an account that was recently placed in our office. When we reached Mr. ********, and at the time he did not verify his identity so we could not disclose the account information to him, and he ended the call. We did place the account in a closed status and no more calls were made to the account. We have investigated our website for any technical issues and there are no errors popping up on our end, so we do apologize if it was down at the time. I have received serval calls from this number and now they are harassing my family and work in regards to a debt. I have not received anything in the mail like they claim. I have gotten 11 calls in the last 3 days from this company from a woman named Heather who will not tell me what the calls are regarding and threatens legal action if I don't respond to some unknown client. When I attempt to return the calls the voice-mail is for a different person. I have not received anything in the mail about any legal matters.Business Response

Upon review of this matter it was found that we had tried contacting Ms. ******** as a follow up to
paperwork that had been sent to her. We attempted to call twice and left voicemails to please call us back, back
in May and did not receive a response then. Our representative voicemails are set to go to their managers’ so
that is who Ms. ******** reached when she called us back on June 23rd.

Better Business Bureau: I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. The business'statement says they only called twice but I had many more missed calls from the same number in addition to the two when voice-mails were left. Not to mention the time I actually answered and the person could not answer my questions about what the calls were regarding. Additionally they offered no actual resolution. What I'd like to see happen is a guarantee that I will not be contacted, and whatever account or whatever they have on me be closed and no longer pursued. Regards, ******** ********Business Response

I have received several messages from a Sarah J**** claiming to be an agent of RCS. She states she is calling for A***** cell. I have repeatedly called and advised I am not the person she is looking for. On June 1st, I, along with my husband and son, received another message from the Sarah J**** regarding an individual who is not at those phone numbers. I called and spoke with a Timothy, who advised he was the senior manager. He was very rude, talked over me, wouldn't let me speak and advised if we didn't stop calling he was going to bring us up on harassment charges. I find this funny since he and his officer are the one calling and leaving multiple message for our son, my husband and myself even though we have advised we are not the individual they looking for. This is a very rude, unprofessional individual and he needs to stop harassing my family.Business Response

opportunity to respond. We are sorry to hear that Ms. ******* had a bad experience with our company. Upon
receiving notification of the complaint, RCS Capital Partners conducted an internal investigation regarding this
matter.
Upon review of this matter it was found that we placed out calls looking for a consumer and dialed the
numbers that were located on the account. When we received a call back stating that we had the wrong number
our representative apologized, confirmed the wrong number and deleted it off the account, and no more calls
were made to the wrong number(s).
We did receive many calls back in requesting information on the account which we could not provide
as no one calling was the consumer we were looking for and would be a violation to provide any account
information. As the manager was explaining that we could not disclose the information and apologized for the
calls and confirmed that the number was deleted there were people in the background attempting to speak at
the same time, making it hard and unclear to answer any questions. Our manager apologized again for the calls
to the wrong number in which he was hung up on. Immediately after this conversation we did have multiple
calls back with males and a female using profanity and threatening our representative so it was moved to
management as our policy states.
Our representative apologized in each call and assured each person calling in that the number was
already removed from the account.
We apologize to Ms. *** ******* for any inconvenience encountered during this matter, and would
like to reiterate that all numbers have been removed.
