As a school psychologist who does contract work on the side, I have had a policy with APA for about 4 years now. I had it as a ***** contract employee at a rate of $125.00 per year. I have renewed the policy for 2020, 2021, and 2022. In 2022, I asked for coverage also as both a ***** and a W-2 employee as I now also worked full time for a homeschool, and my rate did not change even with the additional W-2 coverage.This August 2023, when my policy was expiring, I informed APA that I only needed the ***** coverage. This time, APA came back with a rate of $185.00 for one year. When I inquire about the significant increase, I get no answer.This is really unacceptable for a long time customer. Because you cannot speak to anyone on the phone, I suspect they are quoting me for both a W-2 employee and ***** contractor coverage which I don't need both. I only need the ***** overage, as I am back to working for a public school which already provides coverage for me.Business Response

NOTE: Complainant's requested relief is to renew her policy with us. She was offered renewal on several occasions, yet has refused renewal. She has replaced her policy elsewhere. Her complaint should be closed as unfounded. The body of her complaint contains multiple factual misrepresentations. This was all explained to the complainant via e-mail and telephone discussions, yet she refuses to appreciate the fact that her policies were issued based on her written and sworn statements in the applications, attached here.
Complainant alleges that she is aware of another insurance company that issues a ****** Made Professional Liability policy that does not have step rate (Rates that mature over time starting at the lowest point in year one until mature, typically in year five).****** Made PL policies by design have step rate factors. This is a universally applied industry practice.
The below E-mail was sent to the insured explaining, in detail, the history of her account with us. Contrary to her assertions that she had a policy with us for 4 years, she in fact only had two, one year policies with us. Contrary to her assertions that she asked for coverage as a ***** and a W-2, the attached sworn and signed applications from complainant show that she specifically stated she DID NOT need ***** coverage. Contrary to her assertions that she "get no answer" as a "long time customer" I have numerous e-mail strings between our underwriters and the complainant explaining her account and how second year ****** Made policy pricing is higher than first year.

As denoted in the attached three applications (New Business 2019; New Business 2022 and Renewal 2023) the first time that you disclosed ***** work outside of your W-2 employment, was on 09/11/2023. As such, you were issued Exclusively Employed coverage for the 2019 and 2022 policies which specifically state, at your request, that you are only covered for Professional Services rendered while acting on behalf of your employer (see *** ***** **).
Our thorough review of your account shows that we acted in your best interests and specifically at your request in issuing coverage to you. Your signed, dated applications are material to the risk and the underwriting process. As such, the information contained therein, forms part of the policy and weighs heavily on the decision making process in underwriting your account.
As my colleague ******* advised you on 09/25/2023, we can renew your policy for the additional premium of $54 (We have received your check for $138 with your renewal application). This would result in changing your account to a part-time policy covering you for any ***** work or self employment, outside of your W-2 employment which would be specifically excluded, up to 20 hours per week. If you are interested in proceeding with the renewal, please remit that amount. If you have already replaced your coverage elsewhere, we thank you for your past patronage of our program.
As an aside, you had mentioned that you either currently have or previously had a ****** Made professional liability/malpractice insurance policy that DID NOT change premium from year one until mature. I advised you that I am unaware of any carrier in ***************** that has fixed rates on a ****** Made policy. I would encourage you to fact check me on this point. ALL ****** Made professional liability policies have a lower year one rate and gradually step up to the mature rate, typically over 5 years. I know of no carrier exempt from such a practice in the malpractice arena (Step rate factors do not apply to Occurrence based policies which charge higher premium from year 1).
As you can see from the documentation I am providing to you here, the BBB complaint is factually inconsistent with what was submitted to us by you. To that end, I would respectfully request that you withdraw same at your earliest convenience.

I was insured (physician professional liability insurance) by American Professional Agency (contracting through ******************************* through my previous employer. In order to obtain liability insurance through a new provider, I have to obtain a claims history report from my old provider to prove to my new insurer that I have no claims against me. I reached out to Allied World requesting an urgent claims history report as I CANNOT work as a physician without liability insurance and I CANNOT be insured without a claims history report. A very helpful and responsive employee (not involved with providing these reports) has been facilitating my contact with *** in order to obtain the report. *** have been unresponsive both to my emails and those from Allied World. Speaking with an *** agent over the phone, I was assured my claims history report would be fulfilled ASAP. It has not been fulfilled, and the *** employee responsible for claims history reports did not accept my call, return my voicemail, or respond to my emails. Then, the Allied World employee informed me that *** require an authorization form from me before a claims history report could be processed--a fact that was not relayed to me in any of my interactions with ***. They still have not delivered the claims history report despite my sending my authorization as demanded. Beyond this, my former employer requested a tail coverage policy on my behalf, which *** refuse to enact until they mail me a physical form that I must sign and return; they refused to deliver this form to me virtually to expedite the process. American Professional Agency and its employees are holding my future employment hostage and will not respond.
