      I was In the process of purchasing a vehicle , no where in the contract does it say I only have a certain amount of time to finish the down payment . They harassed me for multiple days saying they were going to sell the car to someone else, if I couldn’t come up with the money by a certain date. I explained that I could not do it. Fred left a voicemail and Michele called me screaming at me , stating they will not give me my money back . That is theft of my money , I am disabled and they took advantage of me . I filed a police report and reached out to my bank and put in a claim to be refunded from Latham autos, they have not contacted my bank back at all! I gave them two payments totaling 1595.00! How can you keep someone’s money and they are not purchasing a vehicle . This is merchant fraud! I just want my money back ! I will also be reporting this to the ADA, to see if they can help me !

      BBB spoke to the owners of the business and the following was relayed: This customer came in on February 24th and picked out a ***** ******* to purchase.  She paid a $1,095 deposit for us to hold the vehicle for 2 weeks for her.  We did not hear back from her, we called and called her for 2 weeks.  Then on March 10th the consumer finally called us back and decided to pay an additional $500 deposit for us to hold the vehicle for her for an additional 2 weeks.  It was explained to her that if she wasn't going to purchase the vehicle, do not put down a 2nd deposit because that would not be in her best interest.  She said she absolutely was purchasing the vehicle and she just needed one more week to get everything figured out with her insurance company.  We did not hear back from her again after March 10th.  Again, we called and called and called her- nothing.  In this meantime, we were turning away other interested buyers for the ***** ******* and we even went ahead and got the vehicle ready for pick up - we did an inspection and all of that.  Vehicle was inspected and ready for pick up on March 10th.  Fred finally got a hold of her and told her that we're giving her until May 26th to come and pick up the vehicle and finalize the payment.  That is 3 months after the initial deposit.  Our policy is that we only hold vehicles for 2 weeks and there are big signs all over that say deposits are non-refundable.  This is also explained verbally and she signs saying she understands too.  On top of that we held it for her for 3 months!  Well, May 26th came and we didn't hear from her again.  Then next thing we hear is this BBB complaint.  I am attaching pictures of one of the huge signs that says deposits are non-refundable and also paperwork that she signed as evidence of all of this.  Thank you.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  They had no signs that say no refund!! They are taking advantage of the community!  You will not just take my money that’s 1500.00 down the drain for nothing!!!    Michele and Fred absolutely have no communication together.  One says one thing and another person says something else!   This is high way robbery! And you know it !  I will proceed with speaking to the media and consulting with my attorney!  And the Ada and ******* police department!     Regards,  ******* ******

      I was sold a vehicle that won't won't pass inspection 7 months later and what is wrong has been wrong much longer the entire frame is shot and very unsafe as I am a single father of 4 little girls this is very unsafe

      Mr. ****** bought the ***** ***** on 10/7/2021 and it was inspected at the tire warehouse. After few weeks, he called stating that he heard a noise and we sent him to our mechanic and there was a piece that needed to be welded, so we sent him to ***** ******* to take care of it but he never showed up to his appointment to take care of it. ***** ******* #********** and you can check with the owner George.  If you have any questions plz call me back or email me.  Thank you  Michella
