      Business Response

      Date: 03/21/2024

Mr. ****** engaged with CNY Fire because we were sent out by ********* to assist him with repairs as a result of his insurance claim. We prepared an estimate for the damages and submitted the same. The original estimate was rejected by ********* for the deck replacement with a response that they only owe for direct damages and not pre-existing design or wear/tear related issues. The deck estimate was revised to repairing the deck vs. full replacement. ********* informed Mr. ****** of the estimate approval and provided him with copies and payment from the same. We agreed to start the repairs and on 11/29/2023 he issued payment to CNY Fire for $3,321.89 which represented a 50% deposit for the entire job of $6,643.79. The approved amount from ********* which he received payment on was $7,082.09. We removed the painting of the deck from the total as he stated that he would complete that part himself.

We began the deck repairs as estimated and go to the point where the deck was completed and we were to start the roof repairs. Mr. ****** informed our crew on site and called our office that he was not happy we were not replacing the entire deck. We advised him that our estimate was for repair only. We contacted ********* for direction and guidance and they responded that they will not agree to any further repairs to the deck other than what was already approved. Mr. ****** then requested that we stop and stated he will do the deck himself. We agreed to stop and informed him we would review what was paid and compare to what work was completed.

We revised the estimate to reflect only the work that was done. A copy of that is attached. That total is $3,479.30 for work completed. His payment to us was $3,321.89 which is an underpayment of $157.41. We have chosen not to request the additional amount owed from him. There is no refund due to the customer. We have attached several photos of the work as we completed it. At this time we do not feel this complaint is warranted and we have satisfied our work as requested by the customer. Our file was closed.
