      As per the documented agreement before payment with the original creditor, the ********** ** *** ****** (***), the collection account shall be removed from my credit report. I confirmed this information with a Conserve supervising representative on a recorded call on 03/29. The Conserve supervising representative stated that the collection account would be removed from my credit report with the permission of the original creditor ***. The *** Bursar's office has sent Conserve a request to remove the collection account from my credit report. I did not receive any pre-collection information from Conserve, due to the company having an incorrect address on file. The account was originally disputed due to not receiving information about the account. To remedy this situation, the managing representative at the *** Bursar's office agreed to the account being removed from my credit report after payment and has requested Conserve to remove the account from my credit report. The collection account is updated as paid and not removed as promised.

      On April 10, 2024, ConServe received a complaint from your offices, on behalf of the Consumer identified in ID ******** (the “Consumer). ConServe provided a response to the stated concerns on April 15, 2024. The Consumer has submitted an additional response, received on 4/16. Therein, Consumer again indicates she was told by ConServe that this would be removed from her credit report. The Consumer advises she was not provided information this account before it was reported on her credit report, and indicates if an unverified caller placed a call she would not answer. The Consumer again requests that credit reporting be corrected and removed. Please accept ConServe’s apologies for the Consumer’s ongoing concerns.
      As previously advised, ConServe’s records reflect that the corresponding account was placed by or on behalf of the Creditor with ConServe on February 6, 2024. Following placement, ConServe’s records reflect that an initial validation notice for the account was mailed to the address of record, as provided by the Creditor, on February 7, 2024, with no indication of a mail return. Again, ConServe’s records reflect numerous efforts to reach the Consumer by telephone, with at least 20 outbound call efforts made since February 8, 2024, without successfully reaching the Consumer.
      All available call recordings were reviewed, and ConServe’s records do not reflect the Consumer was advised by any ConServe representative that the account would be deleted from her credit report upon submission of payment. Rather, the Consumer was advised repeatedly regarding the non-deletion of this account from credit reporting.
      As previously advised, regardless of any misinformation that may have been provided by the Creditor to the Consumer, it would be impermissible for ConServe to request that the account be removed from credit reporting, and ConServe cannot agree to do so. Pursuant to the FCRA, as a data furnisher, ConServe is required to accurately report credit information and, in fact, the Consumer’s payment of the account balance occurred after the account entered collections. Accordingly, the trade line was properly requested by ConServe to be updated in order to reflect
      as paid rather than requested to be removed, and based upon the information provided by the corresponding credit reporting agencies, the account is accurately reflected at this time as a paid and disputed collection account. For any further inquiries regarding the manner in which the account is reported, the Consumer is encouraged to contact the corresponding credit reporting agencies.

      Better Business Bureau: Dishonest response, the call was recorded and easily verifiable. It’s shameful that ConServe  operates with such low moral standards.  I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.       I dropped on 08/01 and the deadline with refund on the other screenshot is 08/26. i was way within deadline for my refund and they want to charge me which is false and the proof is right there.

Therein, the Consumer states he is not liable for the debt and does not have a contract with ConServe and not provided with the original contract as requested. The Consumer requests that credit reporting be corrected and removed. The Consumer also indicates he dropped the course within the deadline for refund. Please accept ConServe’s apologies for the Consumer’s concerns.
      Upon review, ConServe’s records reflect that the corresponding account was placed by or on behalf of the Creditor with ConServe on February 3, 2023. Following placement, ConServe’s records reflect that an initial validation notice for the account was mailed to the address of record on February 6, 2023, without any indication of return mail.
      Regarding the request for a copy of the contract with ConServe, please note the Creditor has always remained as the owner of the corresponding account, and the account was never acquired by ConServe. To the contrary, the account was placed with ConServe for collection purposes only, and thus of course ConServe does not have a direct contractual relationship with the Consumer. In that regard, based upon its collection efforts, ConServe is fully authorized under the Fair Credit Reporting Act (FCRA) to credit report the corresponding collection account on behalf of the Creditor.
      Please note that the corresponding account was closed in ConServe’s office and returned to the Creditor on March 26, 2024. In that regard, the Consumer is encouraged to contact the Creditor for any further account inquiries. ConServe will request that the account be removed from the Consumer’s credit report so that it will no longer be credit reported by ConServe.

      I have reached out to conserve asking for a contract and proof of the balance that I owe but they decided not to respond. I would like this to be removed from my credit report as soon as possible. I also have attached a photo from ****** ***** showing Account information disputed by consumer, meets FCRA requirements

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  15 U.S. Code 1681b.  This is an unauthorized inquiry and my personal information is inaccurate per FCRA. My consumer report and everything that is furnished on my consumer report is supposed to be fair and accurate.  I did not give permissible purpose for this inquiry to be posted on my consumer report. 15 USC 1681b does not say that CONSERVE is allowed to furnish anything on my consumer report without my authorization. Also CONSERVE does not have authorization to report on my consumer/credit report on behalf of my school (as they claim) because I have a private contract with my school in which my information, privacy and business SHOULD be kept private and confidential under federal law 15 U.S. Code 1681a #2 ai.  To conclude, this account is inaccurate and I demand this be removed from my credit report or I will take legal action to resolve this matter. Regards,  ******** *****

      On January 24, 2024, ConServe received a complaint from your offices, on behalf of the Consumer identified in ID ******** (the “Consumer”). Therein, the Consumer states he is not liable for the debt and does not have a contract with ConServe. Additionally, the Consumer advises they were not provided with the original contract as requested. The Consumer requests that credit reporting be corrected and the removal of the account from his credit report. Please accept ConServe’s apologies for the Consumer’s concerns.Upon review, ConServe’s records reflect that the corresponding account was placed by or on behalf of the Creditor with ConServe on November 16, 2023. Following placement, ConServe’s records reflect that an initial validation notice for the account was mailed to the address of record on November 17, 2023, without any indication of return mail. ConServe’s records reflect the Consumer called ConServe on November 20, 2023 and expressed interest in paying the balance, but no specific arrangements were made at the time of the call. Additionally, please note the Creditor has always remained as the owner of the corresponding account, and the account was never acquired by ConServe. To the contrary, the account was placed with ConServe for collection purposes only, and thus of course ConServe does not have a direct contractual relationship with the Consumer.As a result of the present complaint, ConServe requested additional account documentation information from the Creditor. In response, the documentation provided by the Creditor, includes a letter of explanation from the Creditor, a Student Account Statement, biographical information, enrollment information, past due notice, Terms of Use, acceptance page for electronic acceptance of Terms and Conditions, and Delinquent Account policy information. A copy of this account documentation, supplied by the Creditor, will be mailed to the Consumer under separate cover.200 CrossKeys Office Park ? PO Box 7 ? Fairport, NY 14450 ? ###-###-#### ? ###-###-####In that regard, based upon the account documentation provided by the Creditor, it is clearly indicated that the Consumer is responsible for the corresponding debt. As a result, it would be impermissible to request that the account be removed from credit reporting, and ConServe cannot agree to do so.       Dear Sir or Madam: I am a victim of identity theft. I recently learned that my personal information was used to open an account at your company. I did not open or authorize this account, and I therefore request that it be closed immediately. I also request that ******** ********** and ******* absolve me of all charges on the account, and that you take all appropriate steps to remove information about this account from my credit files. Enclosed is a copy of my Identity Theft Report supporting my position, and a copy of my credit report showing the fraudulent items related to your company that are the result of identity theft. Account name: CONSERVE Account number: ******** Date opened: 08/18/2022 Also enclosed is a copy of the CFPB’s Notice to Furnishers of Information, which details your responsibilities as an information furnisher to credit reporting agencies (CRAs). As a furnisher, upon receipt of a consumer’s written request that encloses an Identity Theft Report, you are required to cease furnishing the information resulting from identity theft to any CRA. The Notice also specifies your responsibilities when you receive notice from a CRA, under section 605B of the Fair Credit Reporting Act, that information you provided to the CRA may be the result of identity theft. Those responsibilities include ceasing to provide the inaccurate information to any CRAs and ensuring that you do not attempt to sell or transfer the fraudulent debts to another party for collection. Please investigate this matter, close the account and absolve me of all charges, take the steps required under the Fair Credit Reporting Act, and send me a letter explaining your findings and actions.
