This company is the holder of I debt from a BOA credit card and they put a lien on my home. I took a small loan and paid off over $6300. All the funds have cleared my bank account and I am looking for them to take the lien off my home as I have a P&S for my home on July 23rd. They keep telling me I have to wait 2 weeks to get a paid in full letter to give to my closing attorney. They will not help me move this process quicker, and I even offered to paid for over night shipping for the letter. If they dont remove the lien from my home my sale wont go through.Customer Answer

I was served by this company for a **** of America account file number *******. The total amount due is approximately $3,000. I have made two good faith attempts via telephone to settle this debt with a lump sum on 6/5 with ************************* & again on 6/19 with *******************. I have found their counter offer to be quite out of the norm. I have previously settled debts with six other companies and the debts were settled for 35%, 40.5%, 50% & 55% of the amount due. Four of them I paid out in lump sums and two I entered into payment plans. These six companies were reasonable and within current market guidelines.I offered Rubin & Rothman $1685 in a lump sum which would be 55% of the total.They counter offered at $2800 which would be over 90%.They are laughable.I told them to please set a court date so we can go in front of a judge and **** said he is not a lawyer and he has no ability to do that and the call was over.So now what?Business Response

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because: they have not recognized my offers to settle the matter with a reasonable agreement nor have they agreed to set a court date. They simply end the response by saying collections will continue as if this gives them some liberty to continuously bully and harass me into an unfair settlement.The attorney willfully misrepresents the fact that I did not disclose my financials when in fact, I disclosed all of my financial information in a recorded and subsequent call prior to the filing of this complaint. I am under zero legal obligation to disclose my place of employ and given the firms history and despicable reviews, this will never happen. This firm is shameful and represents exactly why people hate attorneys.
I look forward to facing them in court if they have the courage to set a date.

August of 2023, I called ***** and Rothman, advising them of my notice they served me, as well as the fact that it was served at address where i no longer live, let alone a state, that i do not live in.With this knowledge *** ************************** advised that i get a new york address in order to prevent any furthur issues or problems. With quick rush i contacted my sister and brother who still live in ********, but NOT the 131 fox meadow address. And provided my brother's mailing address to *** ************************** *************, also insisted that my brother can sign the documents, again a questionable statement coming from a representative of ********************************** proper procedure for ************** would have been to kick back the file to ********* **** allowing a ********* to settle the debt directly with ******* for potentially less than what ****************************** stated what itcould be settled for. Albeit it would have taken time for the process to occur, it's the proper procedure which should have taken place, not the latter.Second example.******* first acknowledged there was no settlement created then late reminded her statement after finding the agreement. She said it was Null due to 2 returned payments, payments of which I told ************* I wanted to do $200 usd a month for not the ************************************** to do, just like he forced me to give an address in ********. ******* proceeded to tell me she will honor the oringal agreement settlement even created a new application, showing it was settled for $2,000 usd if I made a payment of $250 usd that day (which we did). We proceeded to make the payment of $250 usd from a **** of America **** account where ******* proceeded to say I only need to make 4 payments of $250 usd dollars toward my initial balance, and that with this $250 usd paid today I would still have another 3 payments of $250usd.Business Response

This is a debt that I've been garnished 2x's. This judgment is from 2001. This debt is over 23 years old. I was initially garnished and paid *******, **************** After I paid *******, **************** this law firm, Rubin & Rothman, LLC garnished my pay without serving me. The company is violating the New York State statute 23 N.Y.C.R.R. 1.3(b) and the new Consumer Credit Fairness Act and Federal Fair Debt Collection Practices Act 15 USC 1692e(2)(A). They are committing consumer fraud and identity theft because they are following my employment using my social security number, name, and my date of birth.Business Response

I owe a debt and I have made two payments that were past due, they never called and never sent letters and they subpoenaed my employer for my wages mind you I have tried to work with this company many times on a resolution to pay half of it and they have down right refused and now they wont even speak to me to make another payment arrangement.
