Kafene is a leasing third party company. I was sent an online app for auto repair, I ended up paying out of my pocket. I contacted kafene who told me they only do leaseable products and not auto repair. I ask for my money back, they ask for proof because that said the merchant sent them an invoice that I received tires. I never received tires, so kafene was supposed to put my account on hold and refund my 2 payment and void the lease. She said that they know better and have an agreement not for auto repairs and they should not have send fraudulent documentation. She said since I came out of pocket and I never received tires that his is a voidable contract. I received one refund and the other is pending, its been weeks and was told 4 days but the merchant would not reply. So this started on Dec 13th , exactly 1 month later they are using deceptive practices and saying well we finally talked to them, And they sent something about tires, even tho you paid out your pocket and I signed a lease under false pretense, even tho your a customer that has used us twice and never been late on a payment. The merchant department ******, ******* and ****** I think are there names are now trying to say they can break there prohibited terms for there partners and take my money. They know there wrong, its been a moth and they just got in touch with the merchant on Jan, 14 th, they started my refund for both payments then after one processed yesterday they said the was that back as a payment and your late because we sent this money back. Basically we here scammers. Im having to get a new car and now it makes since there partner was not authorized through Kafene todo auto repairs or cells parts? Only tires and leasable items, that is why the send in false documentation. I use there services twice and as soon as the black lady stop working the front desk they scammed me. Kafene you started to do the right thing please continue. I paid out of my pocket and no tiresBusiness Response

I made a 2 purchases at ************** which is located at ************************************** and Kafene *** was the company to finance the purchase. The first bedroom set was $1,125.00 and the second bedrrom set was $1199.00 totaling to $2324.00. The early purchase amount was $2,390.50 but I end up paying $2,479.41 by the expired date, which was 11/06/2024. Now I'm being told that I still owe $2,491.96, WHY???!!!! I have made on time payment every week since purchase. This is ROBBERY and I shouldn't have to pay double amount for my purchases. A week after receiving my bedroom set, the bed broke. So I was given a bed that was already damage, there's no way a new bedroom set would break if it was new. I have never experience anything like this and it have been very stressful. No one is trying to listen to me nor help me.Business Response

The customer entered a Lease-Purchase Agreement (Agreement) with Kafene, on August *******. The Agreement includes an early payment amount for $2,521.31.
According to our records the customer did not take advantage of the ****** Price by the expiration date on November 6, 2024. The Early Payment and Early Purchase Options are located on page 1 and page 2 of the signed lease Agreement. Please note, this is not a loan, a buy now pay later transaction, or credit transaction, there is no interest. The lease originated in accordance with all federal and state lease purchase laws and regulations.
Additionally,a Welcome Call was made to the customer on August 16, 2024. We reviewed the call recording. During the call, our representative discussed (the "90-Day Option") and confirmed the merchandise was received in good condition.Furthermore, the customer was provided with instructions on how to access the customer portal to schedule payments or make additional payments towards the 90 day price and to obtain information about the lease.
We have spoken with the customer on multiple occasions since August 16, 2024, to discuss the lease remaining balance, and to advise the 90-day cash price option is no longer available. The customer has not contacted us regarding the merchandise damaged prior to the date of this correspondence.
The customer does have the following options: (1) may continue using the Property by making the lease renewal payments, (2) may take advantage of the Early Purchase Option (As of the date of this letter, you can purchase the Property for $2,491.96 including tax.), or (3) the customer may return the property in good working condition with no further financial obligation, except for the past due rent, any fees and taxes that are owed.

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:The company is saying that they called me when I was the one that called. I recall on the phone calls that was made, I repeatedly asked on making my last payment on 12/08/2024 will that complete the 90 day early payoff and the person on the call clearly said yes. Do they have a recording of that call? If the last payment was 12/06/2024, why wasnt that mentioned to me when I called before 12/06. They waited after 12/08 to mention that to me. My payments are always on time and I feel like Im being discriminated against by them. This is not fair at all.

I bought furniture from a store. I was going to put down $1000 for furniture that was priced $1500. The lady at the furniture store asked did I want financing. She told me different options and I did agree to do financing. She gave me a written receipt from the furniture store and thats all. I asked the lady how would I be able to reach out to this company, would I get some type of correspondence via mail. She responded yes. Nothing ever came in the mail about this company I was so called financing from. In July I noticed automatic payments coming out my account and didnt know who this company was. I called my bank and got more info about this company. It was apparently the company I was supposedly financing from. I called them to see what was going on and they proceeded to tell me that I signed a contract for leasing the furniture and that I didnt pay it off in 3 months and now my $1500 dollar furniture has now ballooned to $3600. The only thing I signed was the paperwork from the furniture store. I asked them why havent they corresponded with me via mail and all she could say was she apologized and says they sent text. I never agreed to them corresponding with me through text. They sent me some contract that *** never seen that has an electronic signature. This contract has automatic payments taken out my account by weekly. I would have never signed a contract with money being taken out my account. Theyve taken over a thousand dollars out of my account already and the only options Ive been given is to return the furniture and Im out over $1000 or pay a 2600 cash out right to keep it. I think that this company is a scam. Every other creditor I deal with mail you a bill unless you opt for another form of communication. The fact that the furniture company didnt print that contract out and let me sign it there, I think its fraud involved. Again I never seen that contract that I supposedly signed. I need a resolve,Business Response

The customer entered a Lease-Purchase Agreement (Agreement) with Kafene, on April 30, 2024. The Agreement includes an early payment amount for $1,755.18 which expired on July 31, 2024.
Unfortunately, the customer did not take advantage of the early payment option.
According to our records on April 30, 2024, the customer completed the e-sign process for the lease Agreement, which is all done through the customers phone number: **************. Also, the delivery of the merchandise was confirmed through an SMS notification sent to the customers same phone number.
The customer maintained the bi-weekly payments for the minimum amount due through August 30, 2024.
On August 12, 2024, a member of our leadership team spoke with the customer to address the lease terms, and the customer agreed to return the merchandise. Since that date we have made several attempts to contact the customer and have not been able to connect.
Regarding account communications this is outlined on page 7 section 18 that explains the customer authorizes representatives to contact through email, text message and phone calls.
Per your request, we can provide a copy of the lease Agreement or email a copy to the customer. This information is also available on the customers portal.
To assist further, please have the customer contact us at ************ option 1. We look forward to collaborating with the customer to resolve this matter.Customer Answer

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:The response from this business is unacceptable. None of my questions got answered. They just saying the same thing. I asked why the contract wasnt presented to me at the time of purchase. Theyre showing me an electronic signature on a contract Ive never seen. The only thing I signed was a sheet of paper from the furniture company. No contract. Why werent any bills, statements , or the contract i supposedly signed mailed to the address on file. I never asked for a text to my phone to be my point of contact. To the sales lady at the furniture store understanding, I would be getting something sent in the mail. I asked her because I had no idea who I was supposed to be paying. It never happened .It didnt happen because this company is trying to scam people into paying triple the amount of what the loan was. I had no reason and would have never entered a lease agreement. I was told that I would be financing not leasing. If I had any notifications from this company, then that furniture wouldve been paid off and thats what they didnt want. Someone needs to look into this company practices. I think some fraud is involved.

Kafene strives to provide exceptional customer service. We appreciate the additional feedback and look forward to addressing the customers concerns.
In an effort to further address this, we contacted our merchant partner. The merchant stated they do explain the terms of the agreement and the customer did receive the *** text link and executed the lease purchase agreement on their cell phone while in their store.
Additionally, the store provided Kafene's name and telephone number on the invoice. We can provide a copy of the invoice with the notes the merchant included. This further supports the merchants explanation of the interaction with the customer.
The customer asked why we did not mail a copy of the Agreement. We do not typically mail a copy of the agreement since it is available to the customer any time via the customer portal. The customer can always obtain a copy by requesting it from Kafene by contacting us directly. Kafene is not required to send monthly billing statements. However, the payment schedule is clearly disclosed in the Agreement. Kafene also emails receipts for every payment made by the customer. It is also important to note that Kafene provides a link to the customer portal within its communications.
We understand the customer does not feel like she was treated fairly. We have made several attempts to contact the customer to discuss a mutually beneficial resolution. As of the date of this response, the customer has not taken or returned our calls. We believe we can come to a satisfactory resolution. In order to accomplish this, it is important that we speak with the customer. Please let us know if we can be of further assistance.Initial Complaint

This complaint is about a lease to own company Kafene that was contracted to purchase furniture through Furniture World **************************************** by Salesman ****. The original lease agreement was for a bedroom set that was cancelled by me within 3 days of contract. I texted the salesman **** to inform him that I didnt want the furniture and to have him cancel the lease. And he tried to get me to transfer it to buy something and and i immediately refused and and call and left him numerous voicemails text ,etc and he stated he would handle it. Well low and behold two months later I got a text from the leasing company saying that they had debit a payment from my bank account which was unauthorized by me so I immediately called my bank USAA and had them to dispute the charges as fraud for unauthorized charges. I have since then reported this transaction to their *************************** and to their ********************************* for them to resolve this matter and clear this unauthorized proposed lease from my record but then they proceed to tell me that they couldnt do anything because I had already received the furniture and I told them emphatically that was a lie and I havent received any furniture from Furniture World and for them to provide me with the lease contract and proof of delivery to my home where they said it was delivered. But again to this date all I have been getting is the run around from the salesman **** and from my emails of complaint to Kafene and I am sick and tired of the harassment and texts saying my payment failed ; YES it failed because I put a stop payment on the company from trying to debit my account again as they did on August 1, 2024 for the amount of $225.47 and reported it as fraud. I would like the BBB to help me get this matter resolved or before I am forced to take legal action against Kafene and Furniture World. Sincerely,***********************Business Response

I purchased furniture through a local store on March 11, 2024, and Kafene was recommended for financing. The store informed me of my lease payment options, and I agreed to the 90-day terms. I started the lease and made more than the required bi-weekly payments to quickly pay off the financing. The total for the 90-day purchase option was $2,126.03. I made $1,838.62 in payments, but the last payment of $287.41 was not debited from my account. I called ********************** as soon as I noticed the payment had not been drafted. Auto drafts from this company do not appear immediately but almost a week later. When I called to verify the last payment, the agent informed me that I now owe $2,340.46. This is outrageous, considering it had only been a week. When I asked the agent if there was anything else I could do, he was unhelpful and merely suggested that I could break the $2,340.46 into two payments to be made within 30 days. This is an unethical financing practice, as one missed payment of $287.41 is now costing me an additional $2,053.05. I would like to get this matter resolved and paid at a reasonable and fair price.Business Response

On March 11, 2024, the customer entered a Lease Purchase Agreement (Agreement) with Kafene. A lease purchase is not financing, or a credit product.
The Agreement includes a 90-Early Payment option which expired on June 10, 2024. According to our records, the customer did not contact us to take advantage of the 90-Early Payment option during the initial 90 Day period.
Once the initial 90-Day period expires, the customer is able to acquire ownership at a significant discount. Both the Early Payment and Early Purchase Options are explained in Section 7 of the Agreement.
Kafene complies with all federal and state lease purchase laws and regulations.
The customer has the following options:
Continue making their payments until they acquire ownership.
Take advantage of the Early Purchase Option and acquire ownership by paying $2,340.46 as of the date of this response.
Return the property in good condition to Kafene with no future financial obligation. The customer will be responsible for any past due reinstatement payments.
The customer may contact us to discuss the options further at ************ Option 1.Initial Complaint

This is my 3rd time coming to Kafene with no problem. I have always paid 90 days and on time. We purchase on Saturday because of work and they are closed to set up payment arrangements for 90 days so I always call Monday and set up payments for 200 bi weekly or more depending the total of what I purchased. This time around I call and ask for the 90 day payment plan and well it was not applied to my account and did not notice until it was time to be done with the payments. I call they say that it never got set up and that on the recording I got distracted that thats why it was not valid. And now want me to pay 1900 more and in less than a month. When someone does a payment plan its because they can not pay that amount at once. What makes it ok to charge double for things you purchase and then hear on the recording requesting payment plans. I find it ridiculous and frustrating that they want me to pay double when I can continue to pay what I had initially agreed to pay with the payment plan of 90 days.Business Response

I bought a moped from a local dealer in ************* two days ago. I purchased it using Kafene which I didn't realize at the time was a rent to own "financing" enterprise. I do not wish to in any way pay what they are proposing I pay for the bike (twice what it was purchased for) and want to pay it off as I am in the 90 day window to do so. However when I go to their website it says: "****** ******** ***** **** ***** *** ** ************ ** ******* ****** *** ********** *** ******** ******* ******* ***."And when I call the number they say they have no information regarding an account with my phone number. I am not about to sit here and allow them to ignore me and take $300 a month for a bike that costs around $3k when I am more than capable of paying off the amount I owe.Business Response

BBB Business Profiles generally cover a three-year reporting period. BBB Business Profiles are subject to change at any time. If you choose to do business with this business, please let the business know that you contacted BBB for a BBB Business Profile.
As a matter of policy, BBB does not endorse any product, service or business. Businesses are under no obligation to seek BBB accreditation, and some businesses are not accredited because they have not sought BBB accreditation. BBB charges a fee for BBB Accreditation. This fee supports BBB's efforts to fulfill its mission of advancing marketplace trust.
