Fiverr removed my gig which broke no policies. my fiverr email is **************************** It is called "help grow your spotify algorithms with targeted spotify ads"This unfair removal is causing me thousands in damages and I will lose MANY clients. I have more than 20k impressions from this gig alone in the past 3 months and have revenue of over $10k from it. It has more than 25 5-star reviews with not a single complaint. Fiverr stated, "We had to remove your Gig as the service you are offering is prohibited by our Community Standards." I run the promotion directly on Spotify by using Spotify advertising, this is not against any policies of Spotify or Fiverr. Spotify encourages artists to run advertising with their Spotify ads studio and this is what I do for many music artists. How is this prohibited? I also do not promise a set number of streams or listeners or growth. I just promise to reach a set amount of impressions with the ad which is easy to see in the Spotify advertising as you can set a Cost Per Impression!There are no fake streams or anything of this sort. I have reached out to Fiverr and they are refusing to return the gig saying it is against policies.I want my gig to be restored right away! If you have any questions on how the promotions are running just ask I can show you proof of how each ad is running on spotify ads studio. Fiverr is under the impression that these are artificial streams and other forms of promotions. This is not true, What I offer is a promotion with Spotify Ads. this is 100% within fiverr polices. Your team does not review anything no matter what I write on BBB or in the Fiverr chat support. ALL of my gigs are done with Spotify advertising, Pay Per Click Ads methods. How is any of this against your polices? I do not promise set amount of streams, all I offer is an Estimated number of Reach from the ads. Again this is not aginst any polices on Fiverr platform, and it is easy to give ads reach estimate for PPC ads. We reviewed ****'s complaint and unfortunately, we won't be able to cancel their orders. Our policies explain that there is a 14-day grace ****** which we may cancel an order, these orders have been completed for more than 14 days and we cannot cancel them. Buyers have absolute control over when an order or a milestone is marked as complete. Marking or allowing an order to be marked as complete is an acknowledgment of their satisfaction as they are given the option to reject a delivery within 3 days of receiving it and request revisions, this buyer never rejected the orders, therefore, we cannot cancel them at this moment. This includes any purchase or other activity that endangers the integrity of Fiverr and the safety of its users by trying to avoid or abuse any of the systems on the site. On November 11th, I purchased a book to be written on Fiverr. As of today I still haven't seen a word of it, but they consider my order to be "Completed". I placed an order on Fiverr from seller ********* for a 10-minute Amazon FBA Skype mentorship call for $5. On December 2nd, we had a phone call that was 27 minutes and 46 seconds. Approximately 18 minutes was spent on the mentorship conversation, and 8 minutes on up selling to a $295 mentorship. He claimed if I purchased the upgraded mentorship, we would work together researching products, designing a logo, and researching suppliers. He claimed he would help me find 3 products and that the mentorship would last as long as I needed, and that many last 1 to 1 1/2 months. I thought I needed to buy the standard package and he said to forget about that, and he would send me a custom gig and that the mentorship I asked about was included in this custom gig. I accepted and paid $311.23. The standard gig includes a 60-minute phone call.On December 9th, we had a call for ************************************************************ to sell. He did not teach me how he found them. On December 10th, we had a call for 6 minutes. He sent me links to 2 of the 3 product descriptions with keywords and the links to Alibaba.com to purchase the products. He did not teach me how he came up with these descriptions or keywords or how he researched the suppliers. He also did not provide the logo or teach me how to list, rank, market, etc. That day he posted the files on Fiverr and marked it as delivered.On December 11th I attempted to cancel my order. He called me and we talked for 9 minutes, and he refused to provide a refund. I reached out to Fiverr that same day to cancel my order for a refund and provided files. Dear Fiverr, I am writing this complaint as we have been a victim of scam on your platform from the buyer "elliottjacksn" on the order: ************. We have already talked with your support but they cancelled the order without proper investigation on the order. I would like to mention Fiverr's TOS which were not followed when cancelling this order: "Orders are not eligible to be cancelled based on the quality of service/materials delivered by the Seller if the service was rendered as described in the Gig Page. You may rate your experience with the Seller on the Order Page, including the overall level of service quality received." but Fiverr itself violated its TOS and provided the buyer a full cancellation without any prior notice and not taking proper investigation into consideration. Also, the buyer has taken all of the delivered work and also changes the password from his end which is clearly a scam. The relevant team has already provided the buyer with proper work and delivery through Fiverr's internal delivery system but the buyer has given no proper explanation and hence asked Fiverr's support to cancel this order. When buyer places an order on the fiverr they agree to the following TOS: "Requirements submitted are accurate and complete, any additional deliverable out of the scope will be subject to extra cost and requires sellers approval." This being said, we provided with deliverables according to the buyer's requirement. The support has not taken into consideration proper investigation and hence provided the buyer with full refund when he was already provided with the full work according to the initial requirements submitted by him and he also used abusive language. Dear Fiverr,
Thank you for your response regarding the recent investigation into the cancellation of the order. However, we must respectfully disagree with your assessment of the situation.We do not believe that this alone is a valid reason for the cancellation of the order. As we have previously stated, the buyer requested a specific theme for the work. However, upon further review and testing, it became apparent that the requested theme was not compatible with the desired functionality requested by the buyer.
To address this issue, we provided the buyer with a live server link to their website and demonstrated that the requested theme was not compatible with the desired functionality. Despite this, the buyer was satisfied with the overall results of the work and did not request any further changes and did asked for the migration.
It is important to note that the use of a different theme was necessary in order to deliver the work as agreed upon (with the requirements that he provided initially in the requirements section) and to meet the buyer's desired functionality. We believe that this is a valid reason for not using the requested theme and that the cancellation of the order was not justified.As we have previously stated and important to take into consideration, the buyer received the migration of their website as requested. However, after the migration was completed, the buyer changed the passwords for the website credentials and requested that the order be canceled.
We believe that this request for cancellation was not justified as the work was completed & migrated as agreed upon and the buyer received the migrated website as requested. It is important for both parties to honor their commitments and work together to resolve any issues that *** arise.
The buyer did requested a specific theme for the work, but the seller's use of a different theme without prior approval does not necessarily constitute a breach of the agreed upon terms based on your policy under Payment Terms: orders are not eligible to be canceled based on the quality of service/materials delivered by the seller if the service was rendered as described in the gig page. In this case, the seller provided the work as described in the gig page and therefore the cancellation of the order was not justified This being said, it is nowhere written in our gig that we will be following a specific theme, we *** use a different theme to provide the required functionalities buyer requested. It is also important to mention that the theme on WordPress website is just a base, the overall functionalities and design is customised using Elementor.
Additionally, we would like to point out that the cancellation of the order was not in line with your policies if the work is delivered according to our gig description and gig packages. These policies are in place to ensure that orders are fulfilled as agreed upon according to the description, package deliverables purchased and requirements submitted by the buyer and to protect the interests of all parties involved. We understand that investigations can be complex and it is important to consider all available information.
However, based on the evidence provided, we strongly believe that the cancellation of the order was not justified and we request that the investigation be reopened to further consider all relevant factors mentioned in this response. On November 21, 2022 I entered into an agreement with a Fiverr seller to complete front and back end development of a mobile application (Order# *************. The seller delivered the work on December 1st as an **** which is only accessible on an Android device. I explicitly stated to the seller before purchase that I would need to view using IOS or web-based platform. Nonetheless, I proceeded to borrow an Android-based device to download and open the **** which unfortunately did not work. I let the seller know I was having problems and would need it as an IOS-based version. The seller responded with a it worked for me sent a few Googled instructions which Id already tried and then filed a complaint after I requested a delivery extension so I could troubleshoot on my own to figure out the problem. Essentially, the seller believed they should be paid regardless of whether I, the customer, could access or use what was sent.. When I responded to the complaint, Fiverr informed me that I would have to show proof of said communication in order to be eligible for a cancellation and refund. I have sent the requested documentation and yet Im still being told I cant cancel and be refunded. When completed, this order will end up costing thousands of dollars and instead of Fiverr trying to rectify the situation, ** told that not being able to access something I paid for is my fault. Fiverr did not provide me with due process. I clearly explained to Fiverr that the alleged violations that I was accused of committing were influenced by my disability and because I was under duress. Technically my fiverr account should not be disabled because I had requested a refund of the order in question. This means the order was never fulfilled so because the order was never completed or fulfilled, I should not be penalized. Second due to my ADHD disorder, bipolar disorder, ADD disorder, and stress and anxiety disorder I did not understand the fiverr rules and guidelines and I was coerced into agreeing to the fiverr guidelines. Although I respect the fiverr guidelines, I at no time was aware that I wa supposedly committing a violation. Also, Fiverr denied my appeal with prejudice and discrimination towards my disability. I explained to fiverr that the violation was committed as a result of my disability and fiverr told me we don't care about your disability. I respectfully request my fiverr account be restored immediately. The document in question was owned by me. I did not technically violate the fiverr guidelines as the order did not consist of me altering the document it instead consisted of me concealing sensitive information, which is legal. As stated, before I was never provided a warning.
