      Dear ******,

Thank you for reaching out and I am sorry for the negative experience you've had with our platform.

An item is not won unless a bid is placed and although I understand it might have been by mistake, whenever you register to a sale, you are agreeing to their terms.

In order to better assist you, can you provide an invoice number to ************************ to look further into what happened?

I made bid on an auction house through LiveAuctioneers. There were problems with the transaction with Bakers Antiques and Auctions that needed mediation from LiveAuctioneers. The auction house was non-responsive and unhelpful. All of my calls and emails to the auction house remained unanswered despite calling during EST business hours, leaving voice mails and emails explaining my situation. They have not responded in any useful way, thus I sought the help of LiveAuctioneers bidder support. While they have contacted the auction house, they were unable to settle the matter with the auction house, and due to this, they have responded back to me by saying "It would be best to try reaching out to them during business hours for immediate assistance in completing the transaction"-- basically, they have thrown the problem back to me and have not been able to help settle the matter at all. The reason I reached out to them in the first place was precisely because I could not contact the auction house, and now LiveAuctioneers, as the middleman, is telling me they cannot help and that I am on my own in this concern. This is IRRESPONSIBLE and POOR CUSTOMER SERVICE, especially since they have acted as a platform for an auction house with shady and poor business practices. They are doing their customers a disservice by 1) allowing such an auction house to keep using their platform, and 2) not doing more to help their customers with disputes. The overall experience has not only been infuriating but also immensely disappointing as LiveAuctioneers prides themselves in the fact that customers can "shop with confidence". Because of this experience, I can say that one CANNOT shop with confidence on LiveAuctioneers because their customer support when transactions do not go smoothly in SEVERELY LACKING. I will not be recommending this platform to anyone.

      Dear ********,

We are truly sorry for the negative experience you've had with us. We can only try to mediate things but can't force an Auction House to close a dispute. Would you be able to provide further information on what happened here to try and assist you? We hope to earn your trust again.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

      [Your Answer Here]

The business is asking that I explain the situation further.

I encountered an auctioneer who has been unresponsive to me from the very beginning and has filed a dispute against me for non-payment. Settlement of payment can only be done through phonecall, and even though I am overseas, I have attempted calling twice and left voicemail as well sent emails for which I received no response. How am I expected to settle payment through phone when they are not answering their phone? When this issue was brought to the attention of LiveAuctioneers, I initially received a response to supposedly help me, however LiveAuctioneers has hit a wall with the auctioneer. Thus, LiveAuctioneers has thrown the matter back to me, telling me to settle the issue by calling the auctioneer. The problem stands-- the auctioneer does not answer. And so to throw this problem back to me when it so clearly needs mediation on the part of LiveAuctioneers as the 3rd party provider is bad customer service. I reached out to ****************** precisely because I could not settle this without their help, and now I am being told I cannot be helped? Is this really genuine concern for clients?

If you cannot remove the dispute against me because only the auctioner can do that, then why allow an irresponsible auctioneer to use your platform? Your first and foremost concern should be your customer. I have proven in my message threads to you how this auctioneer cannot be trusted, and yet you still allow them to use your platform to prey on customers who apparently have misplaced trust on LiveAuctioneers. LiveAuctioneers should have the duty to screen those who auction on their platform, and they are complicit to rude, irresponsible and dishonest sellers by allowing them to use LiveAuctioneers.

I am not receiving the mediation that I need from your end. Your mediation has told me that I should contact the business myself, in which case it is not so much mediating as it is passing the burden back to your customer. This is besides the fact that your current mediation has been SLOW and UNFRUITFUL, and has accomplished nothing except to establish that even you are unable to fix the problem with the auctioneer.

      Hi *******,

Upon reviewing your previous contacts with our bidder support team, LiveAuctioneers is unable to cancel a sale, or close a dispute without the auction house's approval. The shipping terms were clearly indicated when you registered for the auction, and it is the bidder's due diligence to ask for a shipping quote prior to bidding and to abide by the auction terms and conditions they had agreed to.

Unfortunately, accounts with pending invoices and open disputes cannot be closed until these are resolved. Card removal can only be done when all invoices are paid as well.

Please contact ************************ if you have any other concerns or questions.

They have scam auctioneers, scam shippers, scam everything. They do NOT have a business license, nor do most of the **********************, they do NOT pay taxes on their income, nor do their auctioneers, they refuse to give me documents, hacked my accounts, tried to steal my money, have violated just about every law in ** for online sales, are selling information, and violate several trading laws, I reported them to the *** as well. How does Live Auctioneers LLC in ******** have an A+ rating? The numerous complaints and reviews filed should have weighed in on your rating, as per your own guidelines. This business should have points deducted on items 1-5,8 etc. Please review your guidelines and update their profile immediately. I am not only a victim of their scams and fraud, but they have resorted to fishing scam phone calls pretending to be a "$700 ****** charge out of ****** ** and to verify this purchase on your card,"Then their ****** Voice number you call back ************ declares it is ****** Auction in ******** with a man's voice for the voicemail.I spoke with the manager at ****** Auction House and reported the scam, she affirmed they have never worked with Live Auctioneers or their platform, and have been in business since ****, which I verified on their website. Live Auctioneers either sold my information due to my refusal to purchase, or completed the scam themselves. Live Auctioneers is in ********, and they took advantage of a very reputable company in order to gain access to an individuals information and credit card information. As soon as I said 'but wait, there couldn't be a charge on my ******** card because I just got a new one and haven't activated it yet. "The young lady with an accent you find typical when calling ****** asked me to verify my name, and then when I told her about my card she said "OK hold on one moment" put the phone down (I could hear muffled voices) and then she hung up on me.

I did my own research and the company is out of business and no longer in incorporated. LA has failed to get back to me and when they do they just say the same thing going back to the drawing board and goin in circles, clearly trying to avoid a resolution and wasting my time. Hello *****,

Thank you for reaching out to us about this. We have checked your complaint with this auction group and we apologize for the trouble this has caused for you. The auction house has now been removed from our site and is no longer associated with Live Auctioneers. As for the refund, you have mentioned that the payment was made to the auction house directly through check, and not our payment system, which is Live.Payments. Unfortunately because of this, we cannot issue a refund from our end because the payment processor is not ours. Refunds should therefore be processed by the same method that the payment was made. Should you wish to talk to the auction house, please contact them directly through the contact details on the invoice that they sent you. For further assistance on the matter, you may email our bidder support team at ************************

Live Auctioneers is knowingly allowing and encouraging fraudulent behavior on their website. I raised concerns about this after winning an item from one such auction house. Instead of helping me or trying to resolve the issue they shared my allegations and personal data with the auction house (Morningstar eArt Group). This auction house is posting items using the same information and images as another auction house. Every single review for this auction house is for items sold on the same day and amount ($10) as another auction house. How is it possible that two auction houses would sell the same exact items for the same amounts using the same descriptions and images? This auction house also has a fake phone number, fake address, and is using the name of a representative of the auction house that it is reposting items from. After finding this information, I explained to Live Auctioneers customer service that I did not feel comfortable contacting or sending this auction house unsecure payment (which are the only methods of payment that they accept). After conducting research into the location and phone information I also found several reviews stating that this auction house and the one that they are impersonating both sell fake works of art that they attempt to pass off as legitimate. I want Live Auctioneers to cancel my bid and delete my account. I also want them to stop sharing my personal data with this fraudulent auction house. The customer service person who shared my data is **** *********

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

I have emailed Live Auctioneers and two different customer service representatives have refused to assist. The first customer service representative refused to help (stating that he could not help) and shared more of my private information with MorningStar eArt Group (the fraudulent auction house). The customer service representative that responded to me today stated that I had to contact the fraudulent auction house directly to resolve the issue. I do not feel comfortable contacting MorningStar eArt Group as they are clearly scamming Live Auctioneer's bidders and I do not want them to have any more of my personal data.

Today I did some additional research on MorningStar eArt Group and found that they are also reposting items using the same photos and descriptions as items sold by New Castle Art & Antique Gallery going back to at least 2018. Here is one example of a current auction:

Current necklace offered for auction by MorningStar eArt Group: ****************************************************************************************************

Same necklace listed with same description and photographs sold by New Castle Art & Antique Gallery in 2018: ************************************************************************************************

I can provide many other examples where MorningStar eArt Group has taken exact images, item descriptions, and item titles from other auction houses.

MorningStar eArt Group is also using an identical auction house description (with only name and location terms changed) as two other auction houses, "New Castle Art & Antique Gallery" and "********** ***********":
Castle Art & Antique Gallerys page: ***********************************************************************************

      ********** ***********: ***********************************************************************

      MorningStar eArt Groups page: ***********************************************************************

Each of these auction houses' descriptions start out as "[name of auction house] is a recently opened auction house which locates in [state name]. But our specialist team in global network has many years of experience in the art and antique business. They served in reputable association in antique and art business, such as top auction houses, museum and private collection...." All three auction houses are using the same exact description. New Castle Art & Antique Gallery and ********** *********** are both the most frequent sources of MorningStar eArt Group auction photos and descriptions as shown through the above examples. I can send more examples if needed.

I do not feel comfortable reaching out to MorningStar eArt Group because of this and many other reasons.

Please delete my Live Auctioneers account. I no longer trust Live Auctioneers and I want my personal information and credit card removed from the Live Auctioneers website immediately.

      Sincerely,

      ***************************

      Dear ********,

Thanks again for reaching out. As mentioned by our Bidder Support Team, LiveAuctioneers is the facilitator for the auction and we are not able to delete an account with open disputes.

In order to delete your account, you must resolve the dispute with the Auction House.

The cancellation of a sale is at the sole discretion of the auction house. I encourage you to reach out to them so they can offer you the solution to the removal of your dispute. LiveAuctioneers won't be able to remove the dispute without the auction house's consent. My apologies.

      Regards,

      LiveAuctioneers

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

The issue here is that this auction house is committing fraud using your platform. You are allowing them to commit fraud and forcing people into situations where they have to contact a place that is going to use their private information against them. Do you not care that this auction house is reposting content from other auction houses and that their reviews are all faked? Do you not care that all of this auction house's information is fake? Why do you not do anything about those issues. I just want you to stop sharing my personal information with this fraudulent auction house, which is why I want my account closed. Are you not concerned that allowing fraudulent auction houses to use your platform makes your platform unreliable? It's clear that I am not the only person who has experienced this. Fortunately I realized that this auction house is fake before I sent them any money. Others using LiveAuctioneers have not been as fortunate.

Please delete my account immediately and Stop sharing my private information with this fraudulent auction house. I do not trust LiveAuctioneers and will never use it again.
