I am trying to sell my garden residential/commercial property **** **** ******* ********** ** *****) so that I can downsize and move to a warmer climate, I am a pre-senior almost sixty years old. Scott Varley of the Scott Varley team/Keller Williams contacted me in June 2023 offering to help me sell it, and he told me he had a large marketing department and worked with their other offices. Instead, no marketing person contacted me, and I had to work on copy and organize the photos they took, I added some of my own, they sent me a pdf file, that instead of sending the photos so that I could easily arrange them online by just clicking and shuffle. No realtor sign on my yard from them during the busiest week of sales. Scott Varley discouraged me from selling my property properly. For example, I have 200 amps electric that is up-to-date, he discouraged me from mentioning that or showing the electric box even though professional realtor advice in the news and in journals tell people that up to date electric is important. This was with some other instances. He lied to me for whatever reason(s). I gave them a negative rating online, Scott Varley offered me a bribe to remove the negative rating. I had asked them to cancel the *** listing, and I was canceling the contract with them. They withdrew the listing, but when I went to get another realtor, two realtors told me that the contract was still online on the *** system. I do not have access to the *** system, I am not a realtor, another realtor sent me an email of what Scott Varley/KW did not do utilizing highlights on a blank form. This whole issue is causing me financial distress and lost time in relocating. I cannot take out home equity from one bank because there is some timeline I have to wait after the realtor contract expires. I wanted to use funds from my property to relocate. I have never had to use financing before. This is all very depressing, time consuming, and creepy.Business Response

We have sent her a fully executed unconditional withdrawal which she attached herself to this complaint and called and in emails explained that we are not housing her listing in any capacity and she's free to list it with whoever however she pleases. I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. I believe they are not entirely truthful and taking advantage of my lack of knowledge of real estate realtor forms. I have attached two documents today. One from email dated August 2023, Keller Williams (KW) in Oneonta, NY that is closer to me, *** ******** of the *** ******** team KW said it would take six months to list my property and that means it is still listed with Scott Varley/Keller Williams since that contract ends in six months. Once again, Scott Varley lied about working with other KW departments because the local Oneonta, NY Keller Williams, ******** team did not put a sign out on my yard during the busiest time of real estate sales in June/July 2023. The ******** team tried to get one of their real estate agents Angela to sell my *** **** ******* ********** ** places, but she cancelled two days before the appointment, and I know her but she is not listed as a top seller and she probably does it part-time. I have my property up on ****** on my own under "owner" without marketing, received within a few days of posting a call from an investor in Seattle, believe KW hacked into my phone as the same time a ******** call from the Scott Varley team automated about selling a free stove. Doubt I receive inquiries, feel sabotaged or something weird. Many real agents do the work part-time and have other jobs. ******** said KW would help sell my house and relocate, but when I tried that out asking for information on a property in Bethel NY to relocate, no response. Most of the real estate agents are very congenial, but when it comes down to selling my residential/commercial property they seem quite incompetent and it looks suspicious. And the system seems rigged towards the realtor not the seller. I believe Scott Varley did not exit/terminate my contract on the *** system as two realtors told me. I cannot check it because I am not a member of the ***. I also attached a screenshot today, email dated June 2023, where Scott Varley team says they do not have a marketing department. Scott Varley told me they have a marketing department not just "skilled" real estate agents that did nothing to sell my property. We have contacted all *** in the area and with certainty we are not standing nor want to stand in your way. We hope you do find an agent that can help meet your needs at the highest level in your sale and purchases. Attached is additional information regarding my complaint #******** with two screenshots. Additional evidence that Scott Varley of the Keller Williams team is untruthful about not canceling the contract at my request in early August 2023, is the note from **** ****** from *********. I attached her note to what she sent about the *** not being correct by Keller Willams to state that the contract was terminated. Later, I saw that **** ****** is also with Keller Williams, she did not tell me that, and I do not know if she joined them just recently. I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. Thank you for allowing us the opportunity to respond to ***** *********** complaint ID ********. I have included the response from our broker to Ms. ********* as well as the response from our broker to the agent Ms. ********* is interested in working with. The other document that I have uploaded, the same one Ms. ********* has uploaded, is the form that releases the client from the exclusive right to sell listing contract. As our broker states in her email, there are many forms used across the State of NY and some of those have different wording, although they say the same thing. The form that was provided to Ms. ********* on 7/10/23 released the client from our listing agreement unconditionally and at such date she was free to list her property with any broker at any time. Unfortunately, our Unconditional Withdrawal was misinterpreted by agent ***** *****, as attached in Ms. ********** documents. This misinterpretation has, regrettably, caused more confusion.Customer Answer
