- Advertising Review:BBB sent correspondence to James Chrysler Dodge Jeep Ram on January 2, January 23, and January 31, 2025 requesting more information about a mailer sent out by the business in December of 2024 featuring "PLAY THE $100,000 Lady Luck GAME NOW!" which included the statement "All Winners Have Been Mailed".
According to BBB’s Code of Advertising #33. Contests and Games of Chance or Skill
33.2 Contests, drawings or other games of chance that involve the three elements of prize, chance and consideration constitute lotteries, in violation of U.S. federal and state statutes and must not be conducted. Canadian law contains similar prohibitions.
In the copy of the mailer that was provided to BBB, the consumer has matched 3 diamonds across to win. Next to the game it states there are 10 possible winners of $1,000 cash if 3 diamonds across are matched and the odds of winning are 10:750,000. This would indicate that this consumer received 1 of the 10 mailers out of the 750,000 that has won $1,000.
BBB did call the number on the mailer and used the confirmation code and was only told via a recording that a prize had been won and to go to the prize headquarters to claim my prize.
Next to each prize's cash dollar amount is an (*).
Additional information is provided in the footnote of the mailer based on this (*) in small print and states "must bring flyer and/or game piece to event location during the sale dates listed on the advertisement to compare your serial number located on the mail panel to the prize board to claim prize."

An asterisk may be used to impart additional information about a word or term which is not in itself inherently deceptive. The asterisk or other reference symbol must not be used as a means of contradicting or substantially changing the meaning of any advertising statement. Information referenced by asterisks must be clearly and conspicuously disclosed.

Based on the value of the prizes advertised, it appears that this game of chance may need to be registered with the New York State Secretary of State. BBB asked the business if this has been done.
According to NYS Attorney General Letitia James, "In a similar way, if a dealer is sponsoring a sweepstakes or other similar promotions, state law requires proper registration with the New York Secretary of State, along with information about the rules and odds of winning."
