Owner, *********************** negotiated a landscaping project for $1,900 (cash, no taxes/invoice) to plant 3 trees, 2 shrubs and 2 dahlias. Planting took place on 6/26/22. The next day, 6/27/22, I ordered one more tree and the cost was $450 (cash, no taxes/invoice). Less than 2 weeks later, the leaves drying up, falling off and crumbling, despite following his watering comments. Multiple texts with pictures and telephone calls to ****************** about the condition of the trees. All other plantings were thriving. ****************** assured me that this was normal and that everything was fine. April 24, 2023, I contacted ****************** stating that the trees have yet to bloom. Initially ****************** suggested my neighbor poured bleach on them, then suggested that they may have been overwatered. I informed ****************** that my neighbor didn't pour bleach on anything as 1) the other plants were thriving, and 2) my neighbor plants her own plants on the opposite side of my fence where he planted the trees/shrubs. ****************** then said that overwatering was unlikely as the globossa plants like a relatively dry soil so they weren't overwatered. ****************** stated that he provides a 3 month warranty (guarantee) and these trees were planted last June. I informed ****************** that I alerted him to the issue less than 2 weeks after he planted the trees/shrubs. He suggested to split the cost for new trees and I informed him, again, he knew about the issue less than 2 weeks after he did the planting. We scheduled a meeting at his nursery on Monday, May 1, 2023 around 9:30 a.m. to discuss and he agreed. I texted ****************** that we were at his nursery at 9:40 a.m. but he was not there and we were told he left 5 minutes ago. I again texted ****************** asking if he was coming and received no response. ********************** manager called him and left a voice mail. At 10:20 a.m., I left. ****************** left a voice stating that he was at the nursery but by that time, we were already over the ************** going home.

    Better Business Bureau:

After sending a demand letter to the business stating I would file a small claims court action if I was not reimbursed the cost of the trees and the cost of the removal of the dead trees, I received a few telephone calls for 1) me to reconsider splitting the cost of purchasing new trees with the business and allow them to plant the new trees, and, 2) that the dead trees were my fault due to "overwatering" (which was not the case as the leaves were brown and brittle, not yellow).

It should be noted that the owner stated that they provide a 3-month warranty on their plantings and since these trees were planted over 9 months ago, they don't feel it is fair to them to pay for new trees.  The issues with the trees began less than 2 weeks after planting, which the owner was informed of via telephone calls and text messages with pictures.  After additional telephone calls and text messages throughout the following weeks, I was assured that the trees were fine and that they would bloom in the spring.

I ultimately received a check in the amount I requested in my demand letter hand delivered by the owner.

At this time, my complaint, ID ******** regarding Gerardis Farmers Market has been resolved.
