I canceled my membership in the gym. It was in December. I fulfilled my one year contract obligation. I actually had the membership over a year. I was told there is a 30 day cancellation policy. I paid the additional 30 days. My account was never cancelled. I filled a complaint against the company with my credit card provider. They quit allowing withdrawals from the company. The gym is now saying I owe $140 and they are still going to be taking the money out. I called their financial services looking to get it rectified. They refuse to remove the charges and are claiming I never canceled. The gym is saying I never went in there. I asked how I would’ve known about the 30 day cancellation clause. They said they don’t know but they have no record of me canceling the membership. The picture below shows the date December 14th 2022 where I text my wife to let her know I canceled the gym membership. That’s the only documentation I have. Nothing was provided to me at the gym aside from verbal communication.Initial Complaint

On August 26, 2022 I joined Anytime Fitness Club with the General Manager, Jakob ********* I supplied him with my medical insurance number to join for free, however he said that $40 per month would give me one on one with him and personal weight loss program. He gave me a brochure with suggested menus. I asked him to show me how to use the equipment. He showed me a couple and acted like it was an inconvenience. So I set up an appointment to come the next day. He cancelled and was not at the cub. I called and rescheduled. He sent me a text that he over booked and couldn’t meet me. I drive to the club at the time of my appointment and there he was sitting with other members talking and laughing. His over booking never showed. I walked over to him and asked him about my appointment and he shrugged. I had also observed him and other make members make fun of female members when they left. When I got home a printed the contact which stated that I had 3 business days to exercise my right to cancel the contract. The contract said I needed to deliver a written cancellation notice in person. I went to the club on August 30th, 2022 and Jakob was not there. No one knew when he’d be back. So I put a copy of the letter under his office door and duck taped a copy to his door. I then went immediately to the post office to send a registered certified letter of cancellation. Several days passed and nothing. I received a call from Roslyn, the Amherst Post Master General, who said the post person had attempted to serve Jakob and he refused to sign. She said she would drive there herself and get his signature because she had a similar experience with Anytime Fitness. So on September 8th, 2022 she was able to get his signature after he refused to sign and she said she wasn’t leaving. The certified receipt was post marked August 30th, 2022 before midnight. The cancellation notice requested a full refund per the contract. So when my credit card showed a payment of $40, I called and left a message for Jakob requesting proof that my cancellation had been honored and a refund was coming. He never called. I checked my credit card state for September and October,2022. There were no charges. However, there was a $43.76 charge for November, 2022 for Anytime Fitness. I called on 12.06.22, the Advance *** ********* ******* and was told it was an automatic deductible. After a lengthy conversation the auto deduction was terminated but I was told any refund had to come from Anytime Fitness. I called Anytime Fitness on 12.06.2022 and was told Jakob no longer worked there, that Alex is now the General Manager. He told me to come in and he could cancel my member ship and refund my money. On 12.06.2022, I went to Anytime Fitness and met Alex, who insisted I keep my membership. After some time passed an Anthony ********, the Regional Manager said he couldn’t refund and that I needed to re-reenroll. In summary, I have no idea if my membership is cancelled. I returned the key fob and requested my refund in the amount of $83.76. I was told that my membership should have been free due my health insurance program.Initial Complaint

I had a gym membership there for approximately 1.5 years. I physically went in to the gym to cancel my membership in June. The first time, I had sent him a text message as it was unstaffed and that is what the door sign advised to do. I never received a response. I then went in again, was rushed out by the manager, and told my membership would be canceled. He collected my key fob, rendering me unable to return to the facilities. The next month, I was charged again for my membership I had been told was canceled by the manager, Jake. I called him again and was told it was canceled and that was a "grace period". I was charged again in August. I contacted the Anytime Fitness financial company, and no one ever got back to me. I once again contacted Jake to request something in writing stating what he was telling me, I never received anything.
