    Met with ***** (venue owner) on January 1st 2023 and gave her a 500 deposit to use the venue on August 12,2023. On March 7 she stated that other people were interested in my date and she requested the rest of the balance. She said it was in the contract. I asked for the signed contract and gave her the remaining money (2000). March 11 she messaged me asking me to come out and sign the contract. Fiancé and I went to venue on March 26 to finalize the venue. The contract was never presented. We assumed we were good. July 3 we had the final walkthrough at the venue. ***** mentioned a variety of new fees, rules, and regulations which we have not heard in the past. ***** said it’s all in the contract. I asked for the signed contract and she later realized I never signed it. Fiancé and I decided to leave the venue for those reasons and the inability to trust her professionally. ***** is refusing to give me a refund. To restate, we never signed a contract therefore we cannot be bound by those terms. There was never any verbal consent to the additional fees and rules on that contract. We feel extremely wronged by this business considering we gave them 2500 and we aren’t even utilizing their venue anymore. They have no ground to keep all of the money.

    Re: Contract for Reservation of Wolf Creek Retreat for Wedding on August 12, 2023
    Dear ******:
    I represent The Wolf Creek Retreat, LLC. On January 1, 2023, you reserved the date of August
    12, 2023, for your wedding at The Wolf Creek Retreat. On Saturday, March 11, 2023, you received a text
    message from ********* ******* to schedule a meeting to sign the contract if you were in Brookville the
    next week. You texted a reply that you could come on Friday or Saturday with you fiancé. See attached.
    On March 14, 2023, you paid in full to reserve the venue, as shown on a receipt you were given. While it
    is unfortunate that Ms. ******* sent a copy of the contract to an incorrect email address, you also had
    the opportunity to tell Ms. ******* that you had not received an email with a contract from her.
    Regardless, Ohio courts enforce oral contracts every day. Nilavar v. Osborne, 137 Ohio App.3d 469, 487
    (2nd Dt. 2000).
    Under Ohio contract law, you exchanged promises with The Wolf Creek Retreat by paying the
    fees and The Wolf Creek Retreat reserved August 12, 2023 for you and agreed not to accept any other
    reservations for that date. You and The Wolf Creek Retreat had a “meeting of the minds” on the essential
    terms of an oral contract. As I understand it, Ms. ******* has offered to pay the liability insurance and
    the performance deposit for your wedding. By canceling your wedding at The Wolf Creek Retreat, you
    have materially breached the oral contract. The Wolf Creek Retreat has not breached its contract with
    you. Given the nature of the wedding venue business, it is not possible to refund your money unless
    someone else reserves the venue for this same weekend, which is highly unlikely at this late date.
    Ms. ******* sent you a termination form that you have refused to sign. Should you and/or your
    fiancé and/or anyone else acting on your behalf disparage The Wolf Creek Retreat, LLC or *********
    ******* in any way, including on any social network or digital platforms, my client will consider legal
    action against you for defamation. In Ohio, truth is an absolute defense to any defamatory statements. If
    you have questions, please have your attorney contact me. I cannot and will not discuss this matter with
    you since you have told Ms. ******* that you have an attorney.

    The letter from the lawyer was not relevant to the issue. It was a threat. I need a solution.
