      On 3/6/2021, I made a REFUNDABLE earnest deposit toward a floor plan of choice in the amount of $1,500. After picking out options, the price of the home increased tremendously. Financing was not able to obtained and I reached out to ******** *****z with my concerns. After our conversation, I arranged for a change order form to where services would be handled by me, in order to get to a feasible amount. She ASSURED to me that if I could not secure funding that I would receive my full earnest deposit. In May, I confirmed with *******r that it was not attainable at the moment. She informed me that I could cancel the agreement and sign a release form to receive the deposited funds. I emailed the release form back with my signature. I received a check for $150, instead of $1,500. I called ******** and couldn't get in touch with her for weeks. I mailed the check back to the sender's address. I received a call back from ***** or a gentleman with a name starting with a K stating that they made payments on my behalf. I informed ***** that there was nothing made on my behalf and that ******** told me that I would receive full reimbursement. The alleged reasoning for keeping my deposit was for surveying costs. I informed ***** that the change order form stated that surveying, etc. would not be included in the final costs and would be the buyer's responsibility. I paid $1,650 of my own funds for the survey needed for the permit, as well as other land adjustment, water, septic, electric, home removals, etc. I asked ***** for my $1,500 and he said no. I told him that I was informed of full reimbursement and I wanted my funds back. ***** offered me $1,500 credit until 1/1/2022. I feel taken advantage of, due to the fact that I was told on a recorded line lies just to get railroaded because of things outside of my control. I am asking for my $1,500 back as soon as possible.

      The customer made a deposit of $1,500 with the purchase agreement. Schumacher Homes incurred an expense of $1,350. The customer was well aware that this was his expense. He later decided not to build a new home at this time. We refunded him the difference of $150.00. In addition we told him that we would refund the total if he decided to move forward with his contract.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      The customer did not incur any of those expenses. The merchant should refund the compete $1,500 deposit amount instead of merchant credit. The alleged expenses were not a part of the contract between the merchant and customer. All expenses made on behalf of the merchant outside of the contract should have been handled by the merchant alone.  

      The attached documents are in support of my complaint. The merchant went from detailing an alleged expense to claiming that they incurred “expenses” after showing contractual proof of the amount owed. The merchant will not inform the customer of the alleged expenses and was not authorized to make any expenses on behalf of the customer, unless it was covered in the contract. If the merchant cannot provide an accurate description of the expenses and does not provide the signed contract that gave authority to spend, then the deposit shall be refunded completely. This has dragged on for months and the customer service shows that they’re not a business that reflects professionalism and commit unethical practices because they feel that the customer doesn’t have the intelligence to pinpoint when they’re being taken advantage of.

      The expense was incurred for the survey of the customer owner land. This is addressed in the purchase agreement by and between the parties.

      We've been in our new home since 2018 and have had nothing but major issues during the construction and now we are dealing with expenses we should never be having. Our first year we experienced a roof leak into our living room which was corrected by the home warranty person. Last week we experienced a second roof leak in the laundry room and had to pay a roofer to find and correct, money I should not have to spend if the work was done correctly in the first place. Shoddy workmanship! The second BIGGIE is the septic. Two years in the home and our septic backed up???? Paid a plumber over $400.00 to clean out. This month it happened again, my husband cleared it this time. Assuming the septic was installed correctly we should NEVER be experiencing this in a new home. Need septic system repaired. Looking for refund of $403.52 for Plumber and $160.50 for roof repair.

      So the business told me that the septic system was the responsibility of the home owner so I called a Septic System specialist to educate myself on it.  

      Apparently, every 3-5 years we should have it pumped.  Ok, well we are only here 3 years and after 2 years I have a backup in the kitchen sink and have to call a plumber to clear it out.  Almost a year later to the date, last month, we are backed up again only from the master bathroom toilet.  Total opposite end of the house.  I'm planning on having the Septic System Specialist come out to inspect the system (costing me another $400.00) and if it's determined to be a Schumacher issue he will be able to tell me that.

      We built a home through Schumacher out of their North Columbus Ohio location two years ago. Right from move in, we noticed how bad the siding was on our garage. It is rippled, waving and discolored. I have been sending their service dept emails for 2 years about this, they would send out a service technician to fix it and it would only make it worse. I’d notify them again, they’d propose the GM would call. No call ever and now the service department will not return emails. I then contacted a woman from the sales group who was responsive during the sales process and she promised the service rep (******** would be in touch. It’s been a week, still no contact. They take your money during a draw through the build process and hire the cheapest labor they can find resulting in horrible results and then will not deal with it on the service side. I have emails going back two years about this issue. This needs fixed ASAP, I will not work with *******. Someone else needs to handle this issue.
