    INTRODUCTION:
NLPA is responding to the complaint filed by ****** ********* for the services which NLPA was hired to provide for ***** ***** ****. As you will see from this memorandum, the allegations made against NLPA are without any basis in fact whatsoever.

    II.  STATEMENT OF FACTS:
Inmate **** was convicted in ****** County in the State of *****. Inmate **** was convicted at trial and sentenced on June 1, 1995 of capital murder with a deadly weapon/firearm and received a mandatory life sentence. Inmate **** filed an appeal to the Court of Appeals which was affirmed on November 26, 1997.

****** ********* signed an Agreement with National Legal Professional February 27, 2023. A copy of the Agreement for Services is attached hereto as Exhibit A.

Pursuant to the terms of the Agreement for Services, NLPA completed an analysis of inmate ****' case. The fee for this case evaluation was $2,450.00. During the period from June 16, 2022 to March 6, 2024, *** ********* paid a total of $2,257.00 with the balance of fee written off.

In order to keep the evaluation on an attorney-client privilege, we provided the names of three potential attorneys to choose from, who would be willing to receive a copy of the case evaluation and offer him a second opinion free of charge (Exhibit B). Inmate **** selected attorney **** ****** and the case evaluation report was sent to inmate ****, ****** ********* and attorney **** ****** on December 28, 2023 (Exhibit C).

NLPA was hired to prepare a case evaluation which was completed and sent to all parties - nearly a year ago. Attorney Pitzer then quoted a fee of $18,500.00 to represent Inmate ****. *** ********* requests a refund because she cannot afford to hire counsel for the post-conviction motion that NLPA suggested in the evaluation. Inmate **** could hire any attorney to represent him or ask the court appoint him counsel. NLPA never stated we could represent Inmate ****. In fact, our agreement states:
    d)

III. NLPA is not representing you as counsel and, therefore, cannot file documents in court, and that no representations concerning NLPA's services, other than those outlined herein, have been made to You. You understand that only your attorney can file pleadings in the appropriate court on your behalf. If You already have counsel representing You, NLPA's lawyers will assist your retained lawyer. If you want new attorney, NLPA can refer you to a new counsel who will reduce their fee to represent you. If You are indigent, NLPA can assist You in preparing a motion You can file with the Clerk of Courts asking for a court appointed attorney. In this way, the filing fees, court costs and representation fees will be waived by the Court.

July 11th of 2023, I reached out to National Legal Professional Associates. In regards to them helping me with my sons case. I spoke to Mr. W** R******* who assured me that him and his team will do everything they can to help get my son home. After speaking with Mr. W** he begin requesting that I send him and his partner K**** G*** any information about my sons case. As well as me going to my Local court house to collect documents they were needing which I had to pay an additional $150/200 for these documents. My son requested a new lawyer. Mr. W** and Ms. K**** stated there's some forms that my son and I could fill out and send to the courts. I spoke with Mr. W** and I asked him what did I pay the $2450 if they're not gathering any information and they're not researching my sons case like he stated. I told him I ******** R********* is doing all the work you guys haven't supplied me with any new information. A week after speaking with Mr. W** on the phone and emailing him, I receive something stating they have completed they're research and I should be receiving something from Ms. Karen. After receiving the document I asked the both of them Mr. W** and Ms. K**** about getting my son a new lawyer. I had more paperwork that they wanted me to complete. I was tired of dealing with all of that and requested a partial refund. Ms. K**** said no because I signed an agreement. I told her I signed an agreement and the agreement was for them to do work on my sons case. I feel like they scammed me out of $2450 to do nothing, they didn't start or complete the job. It was me ******** R********* doing all the work. I'm very disappointed and I feel I'm entitled to a refund. Please help. Thank you again, ******** R*********.

    to me

Good afternoon *** *******, I ******** have read the statement for NLPA. I don't want to make to many comments where my sons case it open to the public, because his case is still open. My son was not found guilty of any gun charges, that charge was thrown out. Yes, he was found guilty of robbery. Had Mr. Wes and Ms. Karen did a thorough research on my sons case. Im thinking they would have spoke to some of the people who served as a juror on my don case. They would have found out more information. Mr. Wes and Ms. Karen gave three different attorney names. Two of the attorney's who doesn't practice criminal cases pretending to PCR case. The other attorney I never heard from him, I never received a call or an email from the attorney they're speaking about.

I'm so sorry for emailing you so late! I can't check my messages until I'm off work because I work in a prison. So again I'm sorry!

But if you look at the attachments I have sent to you with the dates on there you will see they never once mentioned anything about me speaking to an attorney. They clearly say and tell me, I or my son ***** has to fill out paperwork for an attorney. If you're requesting help from a company who says they research cases. You would expect for them to go a little deeper in the case and do their own investigation or something. They did nothing like that. They probably felt since I stay in another state. They wouldn't have to do too much. I'm very disappointed. Thank you for taking the time out to take on my complaint. Thank you *** ******* and I hope you're having a great evening.

If you look at it they even clearly have his name spelled wrong. which is another reason im asking for the money to be refunded. They did do a case evaluation and it has multiple errors. just like this has errors. it says jury trial. he had bench trial. the lawyers never would even answer so we could speak to them about this matter. but mr wes r******* told me and my husband that he would have lil ****** attorney and that was never true. all of this goes to show that its false and they just take money. i would be happy if they just gave me half of the money back. im willing to negotiate that even though i should get the full amount. also was never no phone calls set up between nlpa and mr ******. how is he going to tell them anything about his case if he never had a phone call with them? they promised to do time served which i sent that screenshot yes i understand that a judge has the final say but dont say you will get him out of prison on time served if you cant even get the case evaluation correct. that is why i want my money back. please all im asking if give me half of the money back if cant give me the full amount. that way i can pay for an attorney who will work and get this case in front of a judge without errors and have a court date for my husband.

Mr. Robinson. Request that I pay 500 to his business to help my fiancé with his criminal charges. We had already hired an attorney. Mr. Robinson was very persistent and adamant that I hired his company and basically said that if I don’t hire him, my fiancé won’t get any help with his criminal charges. My attorney stated that I cannot hire his company and her at the same time per her policy. I never signed any paperwork For Mr. Robinson he requested I sent him the money and then fill out the paperwork to retain his company. I requested a refund before and he has never gotten back to me and he keeps sending me emails saying that I need to stay with his company he’s very persistent, and it’s starting to be very aggressive at this point stating that he will help us but Doesn’t do anything he only does research but there is no research to be done. He basically took my money and I have contacted his office multiple times requesting a refund and no one gets back to me. He won’t respond to my emails when I stay I want my money back because if I hire him I will lose my attorney. I never signed any paperwork. All I did was pay the money and I am requesting my refund back because I cannot have his company and my lawyer per my lawyers agreement

I reject the motion because it didn’t make sense to me. I didn’t understand what they were saying. I requested a refund countless of times. And never signed any documents. I was pressured into paying the company early and didn’t sign any paperwork. This company hasn’t done anything to help me in anyway. He continues to send documents of people he’s helped in the past but nothing about him helping me. Since I paid him he hasnt returned calls or sent any messages about helping. He has done nothing for me. He stated he contacted my lawyer to review documents, etc. Our attorney has never heard about him or hasn’t received any phone calls or anything regarding his company or anything helping us he claims he’s doing research but hasn’t done anything for us. He hasn’t even sent out any emails to me regarding anything he has found.

Good afternoon, I am ****** ********* ******* fiancé. I am filing a complaint for him because as of now he is incarcerated. Marvin and I decided to go with The National Legal Professional associates (NLPA) back in September 2021 to seek help and answers for his freedom. They stated they will review his case, provide a case analysis and they would provide help with a lawyer with the amount paid ($2650.00) As a credit towards the lawyer. We asked them several times, that we wanted to a lawyer from our area (Virginia). They kept insisting that we use a bad reviewed lawyer from their area (Cincinnati Ohio). We were suppose to get 3 to choose from & at the end they were stuck on just one specifics lawyer. When we decided to go with that one Ohio lawyer, the “credit” we were entitled to was never used. They still kept asking for more money to review the analysis they had themselves conducted. At the end we asked we didn’t go through with the one lawyer, so we asked to use a public attorney in VA instead. The head CEO & founder of NLPA (Mr. ********* was going to help us with the process. Point blank, We never got the help we needed. On top of that they charged us ($57.35) to ship back our transcripts, which I asked them to use the “credit” we had but they said they couldn’t. I ended up paying the shipping, because I needed those transcripts back before it was too late & I never heard from them again. We are just so fed up, and want to file a complaint to a full or partial refund back to us. We want a bad review on their end with the BBB. They state they are 100 percent, but I feel is a fraud. I have heard many complaints on this organization from other prison families. I strongly feel is a scam and they take advantage of people. They call promising false hopes for incarcerated individuals and families & that’s not ok. So please let me know if you need anymore information. Thank you.

We hired National legal Professional Associates on March 16, 2021. They were suppose to help us get a attorney and get needed paperwork. Wes had said that if we pay him 2600, that 2600 hundred would go to the attorney. I thought this did not sound right so I repeated myself at least 3 times. Wes R******* insured me over and over again that it was the case. Wes R******* kept saying we are going to get your husband out. We were having trouble getting some of the court paperwork. I did get what i could to him. So than we waited to for the report that took 6 weeks to write. When we got the report there was just a brief of what we already knew. We had asked him to help us correction presentencing investigation and that did not get done either. So we are left with no money to hire another attorney and still in the same position we was a year ago. my husband still incarcerated. Wes R******* got our hopes up that my husband would be home and made promises he could not keep. We are now left with a summary of our case and no will use this paperwork. Even the attorney Wes R******* referred is too. The attorney is going to charge us 15,000 with a year of research.

    I.
    INTRODUCTION:
NLPA is responding to the complaint filed by ***** ********, regarding the services for ******* ********, a state of ******** inmate, which NLPA was hired to provide (Exhibit A). As you will see from this memorandum, the allegations made against NLPA are without any basis in fact whatsoever.
    II.
    STATEMENT OF FACTS:
Inmate ******* ******** was convicted after a jury trial of three counts of criminal sexual conduct in the third degree (CSC-III) and two counts of criminal sexual conduct in the fourth degree (CSC-IV) upon a child related by blood. Inmate ******** was sentenced on December 3, 2019, as a third habitual offender, to 16 and 30 years for each count of CSC-III (Exhibit B). As the attached information will clearly document, NLPA was hired to prepare a case evaluation of inmate ********'s case. The signed agreement for NLPA's service as well as the case evaluation is attached hereto (Exhibit C & Exhibit D). Pursuant to the terms of the Agreement for Services, NLPA completed an analysis of inmate ********'s case. The case evaluation report was sent to inmate ********, ***** ******** and attorney ******* ******* on October 7, 2022. NLPA prepares case evaluations for incarcerated individuals to determine what, if any thing, can be done to reduce an inmate's sentence. We cannot guarantee anyone's release from prison - only a Judge can order an inmate's release.
Our evaluation, which *** ******** signed clearly states:

    III.
You understand that the purpose of the evaluation is to have NLPA's lawyers review the case and provide to counsel their thoughts and recommendations as to what can be done to assist the defendant. NLPA cannot make any guarantees as to the outcome of this evaluation and whether options available to the defendant may already be time-barred or that the evaluation will identify new issues or information that was not previously known to the defendant. I further understand that due to the passage of time or due to the fact that I may have filed numerous prior post-convictions and appeals that in order to be able to resume my pursuit of post-conviction relief, the evaluation may point out to me that may need to obtain new evidence or may need a new rule of law to occur. Should new evidence be necessary, I agree to assist NLPA in locating the individuals who might be able to provide new evidence to help me. However, NLPA does agree to conduct a full review for counsel of all issues that could potentially assist the defendant in the preparation of the case evaluation. I also understand that the case evaluation may not provide me with any new information already known about my case.
    CONCLUSION
*** ******** signed the agreement and NLPA has complied in full with its contract providing all parties with a complete evaluation of what can be done to help inmate ******** in his fight for post-conviction relief. Therefore, we respectfully request that the customer's Complaint be closed as such has no merit whatsoever.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, reasons for rejection are included below. If the case evaluation is to help the attorney than the attorney should not have to spend a year doing research. That is what we paid nlpa. Now all the attorneys we want to hire has to do research and waste another year and charge us more. They did help us get all the paperwork.
