      I was served with a lawsuit by Javitch Block in April 2021, in the lawsuit Javitch Block alleges that I made a payment in March 2019 which is NOT factual, I believe that this deliberate lie is to reinstate the 4 year statute of limitation. They are suing me on a foreclosure in Texas from November 2010, the statute of limitations in Texas is 4 years to collect on a debt, the debt was secured by real property. This is abusive and a dishonest attempt to collect $99K. CIVIL PRACTICE AND REMEDIES CODE Sec. 16.004. FOUR-YEAR LIMITATIONS PERIOD. (a) A person must bring suit on the following actions not later than four years after the day the cause of action accrues: (1) specific performance of a contract for the conveyance of real property;

      As background, our law firm represents ******* ***** *** ******** ******** ******* against Ms. ******* in a lawsuit located in the Williamson County Court at Law, known as case number ***********. The nature of the lawsuit concerns money owed on an unpaid mortgage. 

      Ms. ******* raises affirmative defenses to the lawsuit in her BBB complaint. Respectfully, the matter cannot be litigated in this forum and the issues raised are to be determined by the Court.  

      That said, as the desired settlement by the consumer is "no further contact by the business", we will not contact Ms. ******* any further, especially as she has counsel representing her in the lawsuit.

      Javitch Block sent a letter requesting payment for $19,809.46 from ******** *******. I had already offered a settlement payment through another firm. Not sure what happened with the transfer from one firm to the other and if there was any communication of my settlement offer between them. Javitch Block sent one letter and then filed a court case!!! I was shocked. I want the case withdrawn.

      Thank you for bringing this matter to our attention. As you know, Javitch Block treats consumer concerns with the utmost importance.  As such, I’ve had a thorough opportunity to review our file and discuss with our client, ******** ******* ******** **** (“****”).

      As background, **** placed the consumer’s charged off ******** ******* Platinum card with our office for collection.  On September 8, 2021 we mailed an initial debt validation letter. As there was no response after 30 days, we filed a lawsuit on behalf of **** in the Franklin County Common Pleas Court.  We are happy to work with the consumer and try to come to a resolution.  We attempted to do so before filing the lawsuit suit, and is why we mailed the initial letter and tried calling as well.

      Even though a lawsuit was filed, we can still settle the account. We welcome the consumer to call us at (800) 837-4601 ( Option 2 ); Monday & Wednesday: 8AM-7PM, Tuesday, Thursday, & Friday 8AM-5PM, Saturday: 8AM-12PM (Eastern Time).

      They gave me a court summons with no way to resolve it before hand at the end of March and no contact before they served the summons. The "file number" given did not work on their website. I refuse to pay their court costs because they did not try to contact me before they filed. I have been trying to call their phone number and they never answer to fix this issue.

      Good morning. Thank you for  bringing this matter to my attention. Javitch Block treats consumer concerns with the utmost importance.

      As background, this office represents ********* **** in a lawsuit against Ms. ****** concerning a ******* Credit Card filed in the Carter County General Sessions Court, known as case number ********.  

      Prior to filing the lawsuit, on March 28, 2019 we mailed an initial letter to Ms. ******, but did not receive a response.  

      Regarding why the file number did not work on our website, that is because a file number will only work once a settlement is in place. Here, there is no settlement.  I apologize for any communication issues that she has experienced with our office, however we have her file marked as a "cease and desist."  In order to return any calls, we would need Ms. ****** to provide us a writing or email which specifically says that she lifts the "cease and desist" so that we can call her in hopes to try and resolve this matter.

      I never recieved any communication mail or otherwise from Javitch Block prior to this summons being filed nor did I recieve any calls. I would like them to send me an email with their contact info where I can get a hold of a real person to discuss this issue. I do not have time to sit on the phone for 3 hours to get to a person to resolve this. I certainly am not going to pay the fees they incured for their dumb lawsuit. That is on them for their lack of communication. Better Business Bureau:

      The individual refused to drop the law suit even though I agreed to pay. I would have sooner if they had answered their phone the multiple times I called over the last 6 months. Of course they didn't answer anything till I made the first complaint. Getting the court involved is not necessary especially when they did not inform me they had my account to begin with till they served me court papers. This seems to be a normal thing for them from the other comments I have seen. Better Business Bureau:

      I received a letter from Javitch Block on Sept 11 regarding a debt that I owe. The letter dated Sept 7 stated that I have 15 days to fill out the paperwork to avoid garnishment. The paperwork along with a check was dropped off at the Cleveland Hopkins post office on Sept 21. Then today, Sept 30, I received an envelope from Javitch that contained all of my paperwork, the check that I mailed and a form letter that stated that they are returning the check “as it can’t be accepted at this time”. The check had been stamped “Sept 27” and written on as if it was being processed for payment. I called and talked to a rep. who told me that someone (their employee) failed to scan my documents into my file so there was no record that I sent them in and that on Sept 27 (the same day my check was stamped) my case was sent to the court for garnishment. How is it that on the same day my check was in their hands, they go against their stipulations and request garnishment? I just want to pay.

       Thank you for bringing this matter to our attention. As you know, Javitch Block treats consumer concerns with the utmost importance. As background, we represent ** **** **** **** in a lawsuit against Ms. ****** concerning a balance due on a charged off ****** credit card. The matter was sued in the Parma Municipal Court under case number ********** on June 14, 2021, and reduced to judgment on August 3, 2021. As of the date of this response, the balance due is $3,948.54.

      As a post judgment collection effort, our office filed a garnishment of personal earnings with the Court on September 29, 2021.  Prior to doing so, and as alluded to in the complaint, our office mailed Ms. ****** a Notice of Court Proceeding to Collect Debt as required by ORC Section 2716.02. The Notice was mailed on September 7, 2021.  Pursuant to that same code section, a payment to avoid garnishment with required paperwork was due in our office by September 22, 2021. However, because that payment did not arrive until September 27, 2021, our office returned the payment and proceeded with the garnishment as permitted by law.

      With that said, our client welcomes Ms. ****** to call our office to try and work out a voluntary payment plan lieu of garnishment.  She can call me directly at 216-623-0000 ext. ****.

      I was served a Civil Court summons the first of June 2021 it is scheduled for Sept. 21 2021. And have tried several times to get in touch with them leaving message after message. They did return one call and proceeded to tell me they do not leave messages when they do return calls. Who has ever heard of that?? I explained to them how this has got to be fraud. I have never had a credit card with the amount they are saying I owe. And I have had fraud on that account before I paid it off. They did send me a fraud packet in which I asked for proof that it was me which I sent back over a month and 1/2 ago. To which I still haven't heard a word back from. I wanted to get all this resolved before court but it is looking like it is going to go to court. I have never dealt with a business that never returns calls. In fact a work as a CSR for a large Manufacturing company.

      *** placed the account in issue with our office for collection. As mentioned in the customer's statement, a lawsuit was filed to collect upon the account, and Ms. ****** was served accordingly. 

      Upon review of the issues presented in the complaint and dispute, *** has decided to close the account. As such, our office will file a dismissal with the Macon County General Sessions Court.
