    I signed a construction contract for a new townhome in a B***** townhome community in 2022. Before I agreed to purchase, Matt B***** assured me that our small backyard would be mowed by the HOA - which had not yet been established. This was a requirement for my wife and I because our new townhome would be used part-time only. Our townhome was finished in May 2023. Our lawn was mowed - as promised - throughout the summer. I was at the townhome this weekend after weeks away. When I noticed our backyard was overgrown. I emailed Matt B**** and Mike W***** at B*****. When Mike asked Matt to let the guy who had been mowing our grass about the issue, Matt responded "The back yard of ****’s is specified as private space in the hoa. We did a few free cuts but he should work out a price and or agreement w USA landscape (joe) or whoever cuts the grass in the future." I responded to Matt telling him that this response was not what he agreed to do before I agreed to purchase a townhome from him. I have not heard back.
