Passenger front tire was flat valve stem was broken couldn’t drive the truck home

      Business Response

Relentless conducts a field condition report at the time of repossession. In this instance, the right front tire was flat at the time Relentless repossessed this unit which was noted in the condition report attached hereto. Moreover, the attached photos show the unit dollied with the front tires lifted in the air. You can see the front tire is flat in the field and also on our lot. This is a fruadulent complaint and this customer knows his tire or stem had issues prior to the repossession. Relentless will not repair anything we did not damage.

The lender is not trying to help in any way as I’m on medical leave battling stage three colon cancer . so I said fine do what ya gotta go with the car I’m to sick to deal with this . So today I go to recover my stuff out of my car. Guess what I get a text saying it will cost me 50 to get my stuff. I replied to the company and told them nope that’s extortion and against the law I told them that I would be there at 11:30 my appointment time with the police to get my things back . I went to the tow yard they had went through my car cleaned it out I didn’t even get to look at my car to make sure nothing else was left in there . I have a roof rack that is $300 I have a key to remove the rack they refused to give me my roof rack ok I was clam and said that’s fine I will contact the police . The office lady was a rude person and said I had to get it from the auction when my car goes there . If you look at previous complaints the auction will not give personal items once they get the car . She refused to give me my rack After I sent them the statement from the Ohio attorney general showing it’s illegal they replied and said we will wave the fee. The police have documented everything so that I can take them to court to recover my $300 roof rack system which is an not after market its removal . This could have been avoided I was civil and respectful I even offered to give them the key to unlock the rack she refused to help us. So now I will I will be taking them to court In addition to that I have shared my experience and will continue to so other lenders know not to use this company.

This customer is wrong. Ohio is one of many states that have no statutes that address post repossession fees. Normally, lenders allow repossessions companies to bill them back for these post recovery fees and then they add them on to the total repossession fees found in the customer's purchase agreement/ien with their lender. The Fair Debt Collecton Practices Act allows repossession companys to charge a reasonable fees for property redemptions. What repossession companies cannot due is withhold personal property when fees are not tendered. That is not the case here. When this customer objected to paying the property fee, the matter was escalated to management who waived the property fees. Again, this customer received her property free of charge.

Relentless cannot remove fixtures from vehicles. Moreover, our staff believed this was a factory roof rack. Notwithstanding, this customer can contact her lender to inquire if they will provide her with a release to go to the auction and retrieve the roof rack. If this customer intends to redeem her vehicle from the auction, the rack will still be mounted. This is the first time a customer has ever filed a BBB complaint or otherwise when their fees were waived.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  The roof rack that is locked on there with a key that was bought to be able to attach or luggage container to . For a company that deals in automotive you should have knowledge of this and i also advise contacting the attorney general on the laws you stated because your still wrong you have to give me my personal property in which you did I believed you waved the fee because again you have to in the date of Ohio .

This customer filed a direct complaint with his lender on January 16, 2025 regarding this complaint. The lender denied his claim that Relentless Recovery damaged his garage door. Moreover, this customer's vehicle was up for repossession and Relentless does not door knock for keys nor are we required too. This customer's claim that we did not verify his vin is ridiculous.

Finally, there were two garbage cans placed between the customer's vehicle and the garage door. Our agent hook and pulled the vehicle away from the garage and did not push the vehicle toward or into the garage door. Finally, had our agent pushed the vehicle into into the garage door, the door would have been pushed in and possibly knocked off the track.

My car was repossessed Christmas Eve 2024 & I went to pick up my belongings/ personal items 1/2/2025 and my passport was not returned to me. I specifically kept my passport inside of my arm rest console & upon picking it up, It was not returned. I don’t have to go into the severity of this issue because that’s a government issued ID & people use them for all sorts of criminal activities. If it is not returned to me in a timely matter, I will be taking matters into my own hands and involving the powers that be.

On January 2, 2024, I directly emailed this customer to determine the last six of the vin on this account, which cannot be pulled up by his name. It has been 24 hours and I have not heard a reply back from this complainant despite the alleged severity of this issue. Time is of the essence since this involves missing property. This complaint should have been filed directly with our company. At this juncture, we cannot associate this name to an account, so I can provide no further information unless this person can confirm the last six of the vehicles vin or direct the maker on this loan to file the complaint directly with Relentless. This matter is concluded.

My car was taken by a E 5th Columbus Relentless Recovery and later given to ********* **** ******* ********* I have a certified letter from my bank saying I had 15 days to collect my things and talked with the tow company and they told me to come back. I did and they told me they already switched my car to the auction before the time was up. They left half my possessions in the car and said to contact the auto auction to get them. ***** sunglasses, ceramic cup holder stones, all the stuff in my trunk, a cd in the holder. I called the auction company and they told me they got into my vehicle but there wasn’t anything in it. They are lying and either stole my stuff or threw it away and I will be suing in court for my possessions if I am not given them back right away. I filed a complaint with the auction and also your company as well per what my bank told me to do.

Relentless repossessed this unit on November 29, 2024. The customer scheduled a property redemption appointment on December 3, 2024, but no showed. A few days later, the customer showed up at our Columbus lot without an appointment at 5:00pm. Our staff instructed her to schedule another appointment, but that is she had any further scheduling issues, just to come back before 4:00pm to get her property. On December 11, 2024, this customer's vehicle was transported to auction at the DIRECTON OF HER LENDER, NOT RELENTLESS RECOVERY.

The customer showed up on December 13, 2024, without an appointment, but our staff accomodated her and provided her with her personal property. Moreover, this customer was informed Relentless had no access to her trunk or any property contents contained therein. This customer was also informed that Relentless received a hold harmless from her lender since we had no access to the trunk (no keys) which is attached hereto. All the property located inside the vehicle was returned to this customer, less whatever was inside her trunk. Her complaint lies with the auction, Columbus Fair Auto Auction, whose stated policy is to discard all property located inside the vehicles upon their arrival at the auction, a violation of bailment laws in Ohio.

I got a little behind on my car payments & the lender put it out for repo. Relentless Recovery is the company who came out to get it. If they would have simply knocked on the door, I would've given them the keys & let them drive it away or go ahead & tow it! Instead, they drove their tow truck through my yard, tore up the grass, & broke a small piece off the concrete pad it was parked on! When I realized my car was gone, I checked my cameras & found it was Relentless who'd taken it! I called them to find out if I could get my personal belongings. There was a recording that said to text a different number to schedule an appointment! I sent a text, but didn't receive a response! I didn't know what to do & didn't know who to ask! I mentioned it to a friend who let me know that they have to give my belongings back! I visited their website & it allowed me to choose an appointment day/time. However, the next day, I received a response denying my appointment saying they were unable to accommodate because they had released my car to America's AA Columbus Fair Auction with my personal belongings in it. I did contact the auction as well, but was told only my Lyft sign & empty trunk organizer was in the car when they received it! I had a lot of stuff in my car & would really like it all back! I'm not sure how to proceed? A friend recommended I give the camera footage to an attorney to get back my personal belongings & file for damages to the property, but I was hoping not to have to go that far! Can you help? I have 5 videos showing them taking my car & damaging my yard, but it would not let me upload them

The customer's lender had their car sent to ******** **** **** ******* on November 11, 2024 by *** ******. Relentless repossessed this vehicle on November 4, 2024 and received a Hold Harmless from this customer lender on November 6, 2024 due to no access ot the unit. (see attached) As such, the all personal property was left inside the unit. It is the policy of ******** **** **** ******* to throw away any and all personal property inside the vehicles upon receipt. This is contrary to bailment laws and ******** **** **** ******* is liable for the loss of this customer's personal property. This customer needs to hold them accountable and maybe they will stop throwing out personal property in contradiction of bailment laws.

My vehicle was towed unexpectedly due to an error with my financial institution. Less then 24hrs I got my vehicle back and my check engine light, ABS and traction lights came on. The person who towed my vehicle dragged it from the front of my house after me and my neighbor yelled at him to stop. I was told by the dealer due to that is why the abs and traction control lights came on. Marc M**** replied back to my complaint via email and closed it out and advised “ I have investigated your complaint and determined the following: Whenever a vehicle is towed, diagnostic lights may come on, but they will reset. Moreover, your vehicle was dollied once it was removed from your driveway. The marks in your driveway will normally disappear within 2-8 weeks. This process is accelerated by precipitation, UV rays, freeze-thaw cycles, de-icing salts, and continued driving and use of the driveway. Finally, your tires were not damaged. I have closed out this complaint.” I reset the battery and did every step he advised and none of it fixed the issue. I am currently waiting on an appointment to pay $210 through the ******** dealership to try to fix the issue and the company has no phone number to actually speak to someone and I’ve gotten no reply back via email to solve the issue. I want to be reimbursed for the internal damages

      Business Response

      Date: 07/15/2024

Relentless Recovery repossessed this unit on June 27, 2024. The unit was parked in the street, very close to a curb, and had to be pulled away in order to dolly it. The vehicle since it was AWD, and was hooked from the front end. Once there was room away from the curb, the unit was dollied. This customer redeemed his vehicle the next day, June 28, 2024. On that same date, the customer filed a compliant directly with Relentless claiming the same issues as presented in this BBB complaint. The customer has a 2016 ******** **** ******* which is now 9 years old.

When most AWD or FWD vehicles are towed/dollied, usually, the check engine lights come on but reset shortly thereafter as no damage is done to the vehicle during the tow/dolly. Relentless has reviewed this claim with our operations manager and in-house-mechanic. I have attached a picture of the sensor located behind the tire and rotor. This item is plugged in and screwed down and could not have been damaged by Relentless and its towing equipment (please look at pic and location of sensors.)

It's a bad sensor, not mechanical damage related to the tow. This issue more than likely pre-existed the tow since it was not the result of the tow, but is the result of a bad sensor.

Wheel speed sensors, also known as ABS sensors, are often mounted on the axles of vehicles that are equipped with ABS. On a ************* *******, you can find the rear wheel speed sensor on the rear axle housing or wheel cylinder, and the front wheel speed sensors on the wheel hubs, near the brake rotors.

So how does damaged occurring to the hub or wheel bearings? Some hub bearing assemblies contain internal wheel speed sensors while others use external sensors. Some of the problems that can arise and cause damage to the sensors include:
      Excessive bearing end play
Corrosion, affecting the air gap spacing and weakening the sensor’s signal strength
Road debris blocking the sensor, rendering it inoperative or causing mechanical damage
Particles of metallic debris attached to a wheel speed sensor magnetic encoder ring
      Contaminated wheel speed sensors

Finally, Relentless repossesses about 19,000 vehicles annually. In the seven (7) years I have been handing complaints, there has never been a complaint regarding a faulty sensor. Relentless is not responsible for this bad sensor. There is no mechanical damage to his vehicle.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

My vehicle has been up to date with maintenance and has not had any issues until it was towed by relentless recovery, after having a diagnosis done by a well known and proficient dealership such as ******** at that, this issue occurred due to the towing. I also have a notary written statement from the mechanic advising this was due to the towing and is very common. Also relentless recovery has a history of damaging vehicles and not paying or fixing damages but avoiding the issues and several court cases regarding that as well. As for your comment towards my vehicle being too close to the curve and that’s why it was dragged is a lie. I have a video talking to the tow truck gentleman as well as my neighbor saw and we both yelled at him to stop and he apologized to us both and i was on a call which was  actually being recorded at the same time with ******** ********* who also heard the gentleman and Westlake were so kind to send me the audio via email where the gentleman apologized for dragging the car with the video of him implying he didn’t know. Also charged me $175 for a flat bed fee for dollys, not to mention I’ve had my car towed in the past from the back and no engine lights, traction control or abs has ever appeared until your company towed the vehicle. For the two years I’ve had the car I’ve never had any issues until then. Marc M**** ignored my complaint and closed my issues as I tried to be civil to resolve the issue and billed me for $920 for the towing as well. No contact number to speak to an individual, sent the diagnosis to him as well just to ignore me after being told by BBB to try to resolve the issue with this business. Very unprofessional. Then to avoid the issue to try to accuse me and make assumptions that this issue must’ve have been before the towing the dealership has records of my vehicle maintenance and it’s been well maintained with no issues. I need to be reimbursed for the damages.

      Regards,

My written statement is through ************* at the ******** dealership at **** ********** ** *********** ** *****. Marc M**** has replied via email already showing and proving he refuses to fix any issues or even communicate after asking for the diagnosis just to ignore the issue that I was advised by BBB to try to resolve through the towing company relentless recovery. If it needs to be addressed or shown to my attorney to have it settled as a civil matter then that might be what’s best but I’ve asked for a reimbursement or to wave the repo fee and I’ve received no communication on the matter.

On May 21, 2024 my car was repossessed from my home. This company did the repossession and never reported it to the correct authorities or to my lending company. Over a week later then I hear back from a complaint officer named **** who said they didn’t inventory it so it wasn’t there after I explained it was under the seats. I have not had help getting my items back at all.

      Business Response

      Date: 06/05/2024

Relentless Recovery repossessed this vehicle on May 21, 2024. Relentless reported the repossession to the Cleveland Police Department on May 21, 2024 at 4:54am as required by law. The customer redeemed her personal property that same day and never mentioned anything about a missing ******** ******, only that she had money in the unit which was returned to her in a yellow envelope. No ******** ****** was photographed or inventoried by Relentless. On May 23, 2024, the customer's lienholder had the unit transported to the AAA Toledo Auction.

On May 24, 2024, the customer filed a complaint stating she was missing a ******** ****** and indicated it was under a seat. Since the unit had left for the Auction the day before, Relentless could not go back and look for the ******** ******. Moreover, pursuant to bailment and case law, bailees are not liable for property that is not in plain view or located in hidden compartments or locked trunks. Relentless directed the customer to the Auction to see if they could look for the item.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

There item was not in a hidden compartment and the response a week after I requested that they look in my vehicle. There was no inventory or pics took of my vehicle and also my car was stolen because they didn’t take the proper procedures when taking my car. Someone here stole my item and now the company is trying to cover it up because they sent it to the auction.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]

Business took repossession of vehicle, business did not even attempt to allow recovery of belongings or keys which I have on camera on recording. I’m currently disabled in the hospital but someone was home to take care of this now my belongings are being held ransom and there trying to charge me for not turning in keys they never even attempted to recover this company is a scam and doesn’t follow legal guidelines when operating there business this is also made clear by there reviews. I have photos and videos but BBB says there to big to upload the proof they also damaged the vehicle.

      Mr. ****,

I just received your BBB complaint. I have attached instructions on how to schedule a property appointment online or by text. If you turn your keys in, you will not be charged for a new key cut. But we must have them within 3 business days of recovery. I will also make arrangements to cancel the key cut if you are turning them in or redeeming the vehicle.

We do not knock on doors for keys nor are we required to knock on doors during a repossession. This only creates a situation for a breach of peace or possible violence to****s our agents. More the 6 repossession agents have been shot and killed in the last six months.

Be advised Relentless only holds personal property 45 days from the date of repossession. Your vehicle was repossessed today, February 21st , 2024. You can schedule a property redemption appointment online at www.relentlessohio.com or by texting ************. No vehicle redemption appointment can be scheduled until Relentless receives a vehicle redemption release from your lienholder.

If you have any further questions, please respond directly to me at [email protected].
