I was involved in a vehicle collision that resulted in my car being totaled. I had a three day window to purchase a new vehicle with my settlement before my insurance no longer covered a rental car. Kamil Auto Sales sold me a 2014 Nissan Sentra on March 6, 2024 for $6900. I put down a $500 deposit on March 2, 2024 and paid them the remaining balance after my settlement arrived on March 6. Prior to putting down this deposit, it was never advertised to me that the vehicle had a rebuilt/salvage title. All dates mentioned can be confirmed with paperwork I have. On April 27th (just over 7 weeks after purchase), the transmission in the vehicle went out and I was left helpless on a busy road. The repairs for the vehicle would cost $8700, $1800 more than I paid originally. I have been provided with an inspection report from Luke’s Auto Repair to confirm the faults with the vehicle sold to me. As a college student at the time, I feel very taken advantage of by Kamil Auto Sales as I was in a desperate situation when purchasing a car from them.

    Dear ******* ******,

Thank you for bringing your concerns to our attention. We understand the frustration you must feel, especially given the circumstances you outlined. However, we would like to provide clarity on the situation.
When you purchased the 2014 Nissan Sentra from us on March 6, 2024, it was clearly communicated to you that the vehicle was being sold "as is," with no warranty, and with a rebuilt title. This information was documented in the paperwork you signed at the time of purchase. We have attached copies of these documents for your reference.

As a reputable dealership, transparency and honesty in our dealings with customers are of utmost importance to us. We make every effort to ensure that all pertinent information about a vehicle, including its title status, is disclosed to potential buyers before any transaction takes place. We believe that our records will confirm the accuracy of this process in your case.

Regarding the transmission issue you experienced approximately seven weeks after the purchase, we empathize with the inconvenience it caused you. However, as the vehicle was sold without a warranty, any subsequent repairs or maintenance would be the responsibility of the buyer.

We also want to address your concern about the timing of the purchase in relation to your insurance settlement. While we understand the urgency you may have felt in acquiring a replacement vehicle, we want to assure you that at no point did we withhold any information about the car's condition or title status.

Please feel free to contact us directly if you would like to discuss this matter further or if you require any additional assistance. We value your business and are committed to resolving this issue to your satisfaction.

    Sincerely,

    Kamil Auto Sales

    Complaint: 21738489

I am rejecting this response because I put down a $500 on March 2nd and the information on the rebuilt title was not advertised to me until March 6th. An unsafe vehicle was sold to me and I was put at risk and in danger. I also attempted to call the business on four different occasions in which I was told I would receive a call back in a few hours. This never happened.

    Regards,

Thank you for bringing your concerns to our attention. We understand your dissatisfaction, but as you are aware, the vehicle was sold to you on an "as-is" basis, and you signed a document acknowledging its rebuilt title status.
We take customer feedback seriously, and while we regret any inconvenience you've experienced, we stand by the transparency of our sales process. As stated, the vehicle's condition was disclosed to you, and you had the opportunity to inspect and test drive it before purchase.
Should you have any further questions or require assistance, please don't hesitate to reach out. We appreciate your understanding of our policies and hope to move forward positively.

    Customer: ******** ********

Kamil Auto Sale & Service sold a 2013 Kia Optima with 142,597 miles, AS-IS, to ******** ******** on December 31, 2023. Ms. ******** came to our dealership and took the Kia for an extended test drive.
Upon her return, Ms. ******** decided she wanted to purchase the vehicle but did not have the full amount to pay for the vehicle. The agreed upon terms were that Ms. ******** would pay $5500 that day and the balance of $500 by January 6, 2024.
Ms. ******** contacted our dealership after the 6* of January to tell us the vehicle needed a battery.
She did not express concerns or complain about any other issues. As a gesture of good will toward her, we told her she could use the $500 she still owed and purchase a battery. Ms. ******** was extremely happy and thankful. We have not heard from Ms. ******** since that conversation.

All our vehicles are sold AS-IS, customers are required to test drive the vehicle and inspect them before purchasing. Ms. ******** did both. This is an 11-year-old vehicle with 142,597 miles at the time of sale.
Kamil Auto Sale & Service cannot predict when a vehicle will have a mechanical issue, what issue a vehicle may have, how many miles a customer drives and vehicle, or how a customer drives. While we understand Ms. ********' frustration regarding the issue, Kamil Auto Sale & Service did not misrepresent the used vehicle and does not feel responsible for servicing the vehicle or refunding Ms. ********.
    Respectfully Submitted,

Kamil Auto Sale & Service LLC

I CONTACTED MY CREDIT CARD COMPANY AND FILED A DISPUTE AND THEY RULED THE DECISION IN MY FAVOR, NOW THE RESOLUTION I AM SEEKING IS TO RETURN THE VEHICLE TO THE DEALER AND TAKE MY NAME OFF THE TITLE!

This is in reference to a used car sold "AS-IS" from our lot. There was no misrepresentation nor fraud. The car was in operating condition when purchased, and the customer signed off on all legal disclosures. A complaint filed with the Attorney General's office has already been addressed. If the customer claims to have disputed the charges with his credit card company, then they would have awarded him a refund. The title is in the customer's name, and it is well within his right to sell the vehicle.

    Complaint: 19507993

I am rejecting this response because:

Thank you for giving me the opportunity to explain why I believe Kamil Auto Sales should issue a refund for my recent vehicle purchase. I purchased a used car from Kamil Auto Sales in Columbus, Ohio, and unfortunately, the vehicle has significant mechanical issues that were not disclosed to me at the time of purchase. Despite multiple attempts to resolve the issue with the dealership, they have not taken any responsibility for the problems and have refused to issue a refund.

Additionally, Kamil Auto Sales has a consistent pattern of fraud and misrepresentation when selling vehicles. I have found numerous reports online from other customers who have experienced similar issues with the dealership. They have been accused of tampering with odometers, failing to disclose previous accidents, and selling vehicles with salvage titles without informing the buyers. I believe this behavior is unacceptable and the dealership should be held accountable for their actions.

Regarding Ohio Lemon Law, it does not apply to used vehicle sales. However, Ohio does have laws that protect consumers from fraudulent or deceptive practices when buying a used car. Under the Ohio Consumer Sales Practices Act, dealerships are required to disclose certain information about the vehicle, including its history, condition, and any known defects. If a dealership fails to disclose this information, they can be held liable for any damages that result from the non-disclosure.

In my case, Kamil Auto Sales failed to disclose the mechanical issues with the vehicle I purchased, and I believe they should be held accountable for their actions. I would appreciate your assistance in resolving this matter and obtaining a refund for my purchase.

Thank you for your attention to this matter.

    Regards,

All cars are sold "AS-IS", and all customers are required to sign off on this document, as well as many other documents by law, including odometer statement and certificate of title. All legal disclosures are in writing and are signed off on by the customer. Our cars are purchased from auction and prior history is not disclosed to us. It is the customers' responsibility and right to do do their own research on the car, if they choose. Any and all used vehicles sold are in working order when sold, and the customer assumes the risk when purchasing ANY used vehicle from any dealer or private party. This vehicle in reference was a 1987 Volkswagen... You can't expect it to be perfect.
