      04/22/24 - ****, Plumber confirmed burst pipe in kitchen wall. He recommended and called ****** with Peak Environmental to assess any damages 04/23/24 - ******/**** came and determined the cabinets, drywall, and flooring still wet. Installed fans and dehumidifiers. They requested I pay $1000 (my insurance deductible), along with signing an emergency work authorization form. (I am visually impaired, and I did not read the form, nor did anyone read it to me). I paid deductible by credit card. 04/25/24 - ****** confirmed approval by Insurance Company to pull out refrigerator, cut some drywall, and remove corner cabinet. 04/26/24 - ****** and **** came to "open things up" . Determined there was mold. ****** contacted Insurance Company. 04/30/24 - ***** with See Claims, came to house to do assessment. ****** and **** present. 05/2/24 - ******, ****, and another gentleman came to do mold remediation. Took less than 2-1/2 hours. 3 cabinets treated and put in garage. 05/7/24 - ****, Plumber, replaced burst pipe 05/8/24 - ****** confirmed submitting estimates and pictures to ****. 05/9/24 - ****** confirmed approval by Insurance to replace drywall and floor, paint, and to fix cabinets. 05/13/24 - ****** inquired about Insurance checks. **** on vacation until 05/20/24. ****** inquired about checks several times. 05/21/24 - I spoke with **** about receiving payment, suggested only give half to ****** now, half after job completed. Spoke with ****** about this, he agreed. 05/25/24 - Received and deposited insurance check for, $12, 314.77 05/29/24 - ****** & **** took me to Bank. ****** handed me an invoice for, $12,314.77, stating he wanted full payment, despite my reminding him of paying him half, now. Bank had concerns of scam, recommended and gave me a cashiers check for, $6157.77. of which I gave to ******. I called ****. Discussed concerns & my never receiving any estimates from Peak. Made decision to terminate business with Peak, and requested reimbursement

      Hello,
      I don’t understand the issue besides the customers bank warning her of a scam potential. The money that was given to PEAK Environmental was due to us as we completed the required services and that money was paid by the insurance company. The customer overpaid us by $2818.36 and decided to not use us for the reconstruction and requested a refund of that amount. That check was sent to the homeowner the next day. 

      The services that were paid for were completed. There is no refund due aside from the $2818.36 which has already been issued in the mail. 

      below is a copy of texts sent back and forth between the customer and ****** of peak. 

      I just called my bank.  I am going to have my daughter  take me there shortly,  to deposit the check before they close.   However, the bank did say that the check may be put on hold for clearance, but won't know until they run it through their system.  If everything goes through ok,  I will obtain a check for $6000 to give you on Monday. 
      OK sounds good. I will get a hold of you Monday morning at some point.
      Please know, that I am not trying to rush you on getting this project completed, I just wanted to get a tentative  idea as to how long it will take.  
      It shouldn't take more than a couple weeks to paint the main level there and put down some sheet vinyl. I just don't know how long it's gonna take the repair the boxes however I haven't seen it take more than a couple weeks. That's where I got that date from so will be on it pretty quick once we get started.

      Hi.  My daughter took me to the Bank early this afternoon, and I was able to deposit the check from my Insurance Company.  However, when they ran the check through their system, the  check was put on hold until Tuesday.  
      No worries whenever it clears and we can get together and then we can move forward. I got with **** this afternoon and I guess that's for both the mitigation and the repairs so that's exactly what it should be so just an FYI.

      Hello, it's ****** with Peak Environmental. I'm finishing up a safety meeting real quick. We're running just a little bit behind on yesterday's holiday. I have a few stops this morning in Dayton and then I'll be heading your way. I will text you when I'm heading that way to give you a little heads up if that's OK I plan to pick those cabinets up get those shipped off and fixed and then will discuss your flooring paint and stuff like that and what we're gonna do in timelines

      OK, I'll wait till tomorrow to come up there then so it's not a wasted trip and I'll have **** write out the invoice and everything for you that way you you know what's going on I'll stop and grab some samples of flooring for you. Are you wanting to do sheet vinyl flooring or are you wanting to do snap and lock vinyl plank flooring?
      You might have a little bit more out-of-pocket if you go with the plank flooring, but it is a lot better flooring as well as will make the house value go up, but that is totally up to you

      Hello, it's ****** again with Peak hey, did you have a chance to think about what type of floor you are wanting in the kitchen and that will go throughout the kitchen laundry room as well as around the corner for your to the front door? Laminate floor is beautiful as well and relatively cheap. I can get a really good deal on some gray stuff that might be able to get with Insulation and All. It would probably run you around $600 more out-of-pocket but it's a very, very nice floor waterproof. And slip resist.

      Hello, it's ****** with Peak Environmental. We're going to be at your residence Thursday, June 6 I'll have my painter there to start the painting portion of the job. I'm going to meet him there on Monday early morning around 9 o'clock 930 if that's OK to walk him through the job and stuff and introduce you to him. And then once that's completed, we will move forward with demo repairs where the cabinet and stuff goes and discuss further pricing on that stuff

      Hello, I'm trying to call you to discuss moving forward with the repairs. Are you not wanting that done at this time now I'm really confused.
      Hello.  After much consideration, I have decided to terminate our work relationship effectively immediately.  I no  longer  need your services. Please do not continue to call me, or come to my home.   Regarding payment,  I have paid you a total amount of, $7157.77. 
          
      $1000 via Credit Card on 04/23/24, (of which was my insurance deductible) and  $6157.77 on 05/29/24 via cashier's check. 

      Today, I was able to obtain copies of the estimates that you submitted to my Insurance Company for the Water/  Mold Remediation, that totalled in the amount of, $4339.41. Thus, you have been paid in full for these services.  
      Therefore, I  am asking that you please refund me the amount  that was overpaid to you, in the amount of,
      $2818.36

      I'm really confused at why you don't want us to help you I have no issue not doing the work for you if that's what you wanna do but I'm just like I said confused at why you wouldn't want that to happen.       I am rejecting this response because:

       

      I have not received a check from you.  You did not provide any details in your response, as to the date you sent this check, or how it was sent, certified,  regular mail, etc.

      You most certainly do understand this issue, and it is more than your response of just the Management at my Bank warning me that you may be scamming me.

      -On 5/29, you demanded that you receive all of the money that was sent to me by my Insurance Company,  in the amount of, $12, 314.77.  This was despite, your agreeing to my telling you, twice earlier, that I was only giving you half this amount, until the job was completed.

      -On 5/29, after giving you a cashiers check from my Bank, in the amount of, $6157.77, and the $1000 via my credit card,  on 4/23,  you, still, were not satisfied,  and then contacted my Insurance Adjuster to complain about it.

      You NEVER gave me any written estimates,  or details of the job or its materials, that you would be providing me. 

      After speaking with my Insurance Adjuster on 5/29, I realized that you had lied to me about several things.

      Good afternoon,

      Thank you for your response.  We mailed the check for the overpayment on 5/31/24 which was the next day after you decided to terminate the contract.  Since you are stating that you have not received the check, we went to the bank today and put a stop payment on it, so if you do receive it, please shred it.  Today we got a cashiers check in the overpayment amount of $2818.36 and sent it via USPS certified mail tracking number is **** **** **** **** **** **.  We sincerely hope this resolves the issue, as we did everything to mitigate the situation immediately.  Please let us know if you have any questions.

      I was under the impression that I had 10 days from, 6/17/24, to give a response, to **** *****, with Peak Environmental.  However, it appears that you went ahead and closed my complaint.

       

      I ask that you please add my response to **** ***** with Peak Environmental dated 6/17/24.

      Today is, 6/25/24, and I still have yet to receive this "check" that you "supposedly" sent me on 5/31/24. Considering the circumstances involved in my terminating business with you, it would seem that you would have sent this "check" certified, if for anything, to have proof that you actually sent it and that I received it 

      With that being said, I did sign and receive the certified check that you sent to me on 6/18/24.  

      Unfortunately, it's  companies like yours, who appear to be nice and honest up front, but underneath,  are actually taking advantage of trusting people, and their insurance companies!
