We contracted with Moody's Remodeling, which had good reviews and A+ rating on your website on Oct 5, 2023. and paid him the required 50% deposit which was $15,000. We had just purchased this home and wanted the remodeling done before we move in. Our plan date for moving in was mid-January 2024. Since Moody's verbally stated he could start 1 of the 3 projects contracted within 2 weeks and the rest by the end of the month. Moody's got the contract because he was the only 1 out of 3 companies that could get started within a few weeks and it would meet our move in plans. He did not give me a copy of the contract that day said his office manager would email me the contract. It took several text messages before I finally got a copy of the contract only because I told him the bank needed a copy for the loan we had applied for. Received the contract on Oct 18. I contacted him on Oct 20, because the skylights in the detached building was the 1st project and the weather was changing. In a text he said he would send someone over next week, delayed due to the rain. Sent a text to him on 10/24 asking about skylights again, he texted this week they will be in. Still not done. In that text he also stated he would begin filtering in workers to start on the other 2 projects. I texted him back asking for a budget for the items we were to choose, he said middle of road, like flooring 3-3.50, faucets 175 and so on. I contacted Mark because we had an issue with our bank loan approval and needed some things completed before they would approve. The bank gave us a 2 week deadline. Mark was sick with Covid, he did come the next week and help us out, we had others that also helps us out. I am running out of characters to complete my complaint, but I have 27 pages of text messages, just as many email messages and lots of pictures. He is threating me with breach of contract and we don't want him back on our property, his work is shabby.Business response

Tell us why here.***** Contacted us through the BBB looking to have a bathroom remodeled. I setup a day and a time and went and gave them a free estimate. I was told they inherited the home from an uncle who passed away. After gaining a good understanding of what they was looking for. I sent over an estimate to remodel a hall bath with a fiberglass shower and surround, add a first floor laundry and add a half bath next to the laundry room. When they received their quote they contacted me to move forward. I scheduled time to go sign a contract and collect a deposit. At the Contract signing I told them I would do my best to semchedule the skylight panel install on the barn withing a cple weeks. I told them we were busy and was at least the end of November to start their job and it would take approximately 4 to 6 weeks.We had scheduling issues and, labor shortages around the time I was unable to get the panels installed for the skylights and notified hellen. She contacted me about the material costs so she could start looking at what she wanted. I told her because she said she didn't want nothing fancy that I priced stuff middle of the road from low price to high price. After some time passed she contacted me and wanted to meet at the house. I was unable to do so as I was sick That week and scheduled for the following week. Upon my arrival I found framing and plumbing for the half bath and laundry room was already done. I was shocked because I was under contract for that. She asked for some assistance on hanging some drywall for banks pics only. Then she wanted it removed. Her and her husband said if I did this it would be in trade for the plumbing. I agreed and pulled guys off jobs to hang drywall. After the bank did their pics I again sent guys to remove the drywall. Upon starting their job I experienced a labor shortage when the guy who was supposed to be leading their job did the demo then quit without any notice. This is covered in my terms and conditions we provided her when she signed the contract. Once I found this out I immediately started lookin for a suitable replacement. Upon coming to an agreement with a life long friend ***** ******. I took him and introduced him to the *******s. They approved and he gave them his number and schedule. Immediately after the first guy quit Mrs. ******* became very upset started complaining about everything. I asked her for a vanity choice and she went and bought one instead i included the materials on my quite. She wanted to change from fiberglass shower surround to tile surround and I told her I need a signed change order with a deposit on the difference because tile is considerably more. She refused to give any additional monies and I told without the proper paperwork and deposit I could not install the tile. At which time she became very agitated to the point that it was impossible to please her no matter what I said or done. She began tying the guys time up Complaining about me. One guy said he had never heard someone say such bad things about someone. By day 3 we received a negative BBB review that stated we was wanting more money without any mention that she was wanting to make changes to the scope of work. On day 4 we received a negative Google review also. I feel that the reviews given do not accurately depict the whole situation and by omitting certain things it appears as if my company is doing stuff that we simply arent. The following week on 12/19 st 430pm after working all day, ***** told my guy that as far as they were concerned the job is on hold and for us not to return. I never got a text, email or phone call about this and thats kinda how the whole job has gone. I've not been intimidating towards anyone and I never made any threats. I simply stated that having others do work I'm contracted for, could be seen as a breech of contract. We are more than happy to fulfill our contract and this has been communicated to them. I've deciated so much time to trying to make them aware of issues with something they was wanting to try and avoid issues down the road only to be told pretty much I didn't know what I was talking about. I told her i wasnt trying to give her what she wanted but just making sure she understood that what she wanted was not the way contractors do it. I was going to have her sign a waiver and still do it. However we have now been told not to return after just 6 days of work. I also have pics emails and the pics I have are directly from the guys doing the work and there nothing like the pics I seen uploaded. I'm not sure why they are different but there definitely wasn't wood sticking up out of the floor and such in them or the last time I was there to look it overI'd really like to speak with someone about this because this is only a small portion of the issues we have had with this job. Ive done everything to make sure they understood what to expect out of us, only for it to not be followed or be a huge issue because i run my business this way to the point of putting out reviews saying she's kept track of the hours and I've only spent about this much of the deposit. The quote was not itemized and was a finished product estimate and ive not provided her with anything for her to know what ive spent or paid out. It was such a hostile environment of nothing but negative stuff about me personally that certain workers requested not to be sent back there because they didn't want to listen to it. I have been more than open to working with them, however I've felt ever since the first guy quit they haven't wanted us there at all.This also will not allow me to upload pics for some reason

I am rejecting this response because:
*** ***** has continued to tell us anything to pacify us, meanwhile the job isn't getting done. I will send additional information. We would just like some our money back of course minus labor and materials. We really don't want this going to court, but we also don't want other senior citizens or anyone for that matter taken advantage of.*** ***** stated that his pictures didn't show what I have previously sent. *** ***** hasn't been to the property since the morning of12/18/23, when I signed the change order to go from shower surround to tile. Then he asked for additional money, but can't tell us where the $15,000 went. I told him when the job was completed we would pay, no additional money at this time.

In late September 2023, Moody's Remodeling was contacted by Mrs. ******* requesting an estimate be provided to her for some renovation work on a home that was recently inherited. **** *****, owner of Moody's Remodeling, scheduled the estimate and met with the *******'s, spending numerous hours discussing the renovations with them. Upon showing up to the estimate, *** ***** was told by the *******'s that they wanted renovations made so that any future heath issues would be accommodated. The plan was to move walls and make the main bathroom large enough to accommodate wheelchairs and walkers, to make a first floor laundry room, install a skylight in the barn, and add a new half bath. During the initial conversation, the understanding was that the *******'s wanted functional spaces, but with middle of the road materials used, as due to the age of the home and the area the residence is located in, top of the line materials and plans would not be a sound financial decision. *** ***** then explained Moody's Remodeling standard operating practices, and that he generally runs a crew of 6-8 subcontractors who will come in to the residence to complete the renovations and that he(Mr.Moody) manages the crew and the jobsite and would be there once a week to monitor the progress and address any issues, concerns, or questions. *** ***** provided the *******'s a verbal "ballpark" dollar amount for the renovations during the conversation, but made the *******'s aware that an official estimate would be provided to them with accurate pricing via email. The estimate was completed and sent to the *******'s via email from quickbooks with no itemization, Moodys Remodeling only itemizes if requested from the client, and the *******'s did not request the estimate be itemized. On October 4, 2023, *** ***** made the *******'s aware of a promo that he would provide to them that would eliminate the cost of the skylight that they wanted placed in the barn. The *******'s responded that they would like time to view a couple other estimates and would let Moody's know what decision they made. On October 6, 2023, *** ***** was contacted by the *******'s and informed that they wished to hire Moody's Remodeling as the contractor for their renovations. *** ***** then scheduled a time to meet with the *******'s to get a contract signed, go over Moody's terms and conditions, and collect a 50% deposit. At that time, *** ***** verbally expressed to the *******'s that it would take approximately 4 to 6 weeks to complete the renovations and that per his schedule, work would start by the end of November. On October 24, 2023, *** ***** was contacted by the *******'s and inquired on a price range for materials that they needed to choose for style and design. *** ***** expressed to the *******'s, that per their request to not use high end materials, that they should be looking at more midlevel pricing, such as $3.00-$3.50/sq ft flooring but that if any of their choices were out of the price range allotted they would be notified. *** ***** planned to begin the skylight installation at an earlier date than the other renovations, but did have a scheduling issue as a result of poor weather and the sudden departure of the subcontractor originally planned to complete the installation, which led to a shortage of available subcontractors( which is adressed in the terms and conditions), as they were completing other clients jobs. Within a week, *** ***** met with the *******'s and the new subcontractor to discuss the scope of work, layout of main bathroom, and schedule, all of which was approved by the *******'s. Moody's Remodeling did send two subcontractors to the residence to complete the demolition, while awaiting the new subcontractors availability.
It was at this time the *******'s began expressing anger, began making comments to the subcontractors on site that they believed things were being done incorrectly, and expressing that they thought ******** had been dishonest with them and making comments such as, "*** ***** is robbing Peter to pay Paul", "*** ***** is good at bs'ing people", etc.
*** ***** was made aware of these comments being communicated to the subcontractors, he made a trip to the residence when the subcontractors who had been on-site requested to not be sent back to the jobsite, as they felt very uncomfortable with the comments being made and by the *******'s cornering them and critiquing them. *** ***** then sent a 3rd subcontractor to the jobsite, where he met with the subcontractor and the *******'s. During this interaction there was no negative comments or complaints and everything seemed great, so *** ***** explained the job to the subcontractor and took his leave. He was notified later that day by the subcontractor stating, " They really do not like you, and I'd be really careful with them". This was very confusing for *** *****, as he was under the impression when he left the residence that all was well. The client, around this time, requested to make a change to the original scope of work that would be an increased cost. At that time, *** ***** explained the change order process to the client, and let them know that the change would require an additional deposit as the additional materials were not calculated into the deposit he had received upon the initial contract signing.
After this instance, the *******'s became increasingly hostile toward Moody's Remodeling and the subcontractors on their job. It was at this point that *** ***** determined that it would be in everyone's best interest for him to complete the scope of work that was originally agreed upon, but issue a credit to the client for the change that they wanted to make.
Moody's Remodeling had every intention of honoring the contract between them and the *******'s, despite only having one subcontractor willing to go to their jobsite.
The *******'s repeatedly have made the comment that "He isn't on the same page as them, and needs to be" despite the fact the *** ***** has made every attempt to ascertain how they are not on the same page. *** ***** would ask the client to pick out materials, such as vanities and light fixtures, so that he could order said items but the client would instead purchase the items themselves despite the original estimate being for labor and materials.
On December 19, 2023, Moody's subcontractor was informed by the *******'s that the project is considered "on hold" and he was asked not to return by the client. The *******'s failed to notify *** ***** of the status change on their project. When *** ***** contacted the client for an explanation, he was told he would receive a certified letter. Moody's has made every effort to rectify this situation but the client has not been open to communicating further. *** ***** has asked multiple times for the *******'s to contact him directly for changes, questions, or concerns but they continued to only communicate with the subcontractor, whom has no authority to make any changes or decisions in this situation.
At this time Moody's is unaware of any subpar work, or any issue that could not be resolved with non-hostile communication.
After 4 days working on the project, Moody's received 2 negative comments from the *******'s. It is the opinions of Moody's Remodeling and *** *****, that the client has been unfair and unwilling to allow Moody's to complete the job they were hired to do. It also bears being mentioned, that the *******'s told *** ***** that they had never worked with a contractor prior to this, but once work began told *** ***** that they had hired a plumber in the past who "paid for a new bathroom, because he screwed up so bad". Moody's Remodeling always strives for customer satisfaction, this client and situation is making that impossible in this circumstance, and that is not how Moody's Remodeling has ever done business.We don't understand what Mr. And Mrs ******* intentions are with this project at this time. There's been no communication with Mr.Moody via phone, text, or email. We also have not received any certified letters. We were advised by Mr. ******* to not return as the job was on hold as we were actively working on the hall bathroom. We are awaiting instructions from our legal counsel as what or how to proceed in this situation. As stated above we have not been notified directly from this customer in regards to any issues they may have had with sub par work. the only thing we have heard is their dislike of Mr.Moody and how his business is ran. *** ***** has made several visits to the location to inspect progress and make sure everything was on track and everything was being done up to Moody's standards. *** ***** has yet to find a single issue related to the sub contractors work. We have uploaded the pictures we we supplied by the sub contractor however it will only allow 5 pictures at this time.

I am rejecting this response because: When we met with *** *****, both in September for the estimate and October for signing of the contract, he never once mentioned he used sub-contractors. If he had told us he used sub-contractors other than electrical and plumbing work, we would have never signed with him. He stated he had two crews. I know most sub=contractors aren't licensed for plumbing and electrical work. With that being said we thought his crew included licensed plumbers and electricians. My other estimates provided us the names of the sub-contractors they used for this service.When 2 people showed up to the framing with only 4 2x4's and they finished in a few hours, told me they were done for the day, because they didn't have the materials they needed. I asked WHY, and stated that I gave *** ***** $15,000 he should have the money for materials. I did state what's he doing with our money using it from Paul to pay Peter. That's when Isaac told me *** ***** was his dad.
*** ***** stated in his response that Mr. ******* told ***** ****** on the 19th he wasn't to come back. If that was said by Mr. *******, why would ***** call Mr. ******* on Sat and tell him he would be at the job site on Tuesday. On Saturday, Mr. ******* did tell ***** we were issuing a Stop Work Order.
I am not getting into she said, he said, I want the documentation to show.
We have lost all faith and trust in Moody Remodeling and don't want him or his sub-contractors on the job. *** ***** covers his company well with his Terms and Conditions, but the consumer is left high and dry. Had we decided 72 hours after signing the contract that we wanted to cancel, to would have been too late because *** ***** cashed the checks the very next day.

Hello,
We are more than happy to complete the job. We was actively working on said project and was told by ***** to not return. This communication was to my guy and not to me or our business directly. I found out about the stoppage 2 days after it occured. With being told that they wanted to pause the job i informed mrs heyduct that her project would get bumped to the bottom of our list as we dont stop working once we have started. Our current schedule would not allow us to start back up on this project for 4 to 6 weeks. I tried responding to the original complaint however it would not allow me to do so. We believe these issues could have been avoided had proper communication occured.

I am rejecting this response because: All we have gotten from Moody's Remodeling is promises, excuses and work done subpar. We are more than willing for *** ***** to keep $4000 of the $15000 we paid him for the contract. Like we have stated before Moody's Remodeling being the highest of our 3 estimates got the contract because he verbally promised he could start the job within 3 weeks and be completed by mid-January at the latest, so we could get moved in and our current home on the market. The 1st of the 3 items on the contract was to take place 1st, never got done. The other estimates couldn't even start the project until March or April.We have basically completed most of the contract ourselves within the past 6 weeks and we are in our 70's. With us doing it ourselves, we have been able to get our contracted painters in and hopefully will get moved in by March.
It hard on seniors who are on fixed incomes to make 2 mortgage payments, even *** ***** stated in October that he understood making 2 mortgage payments and understood our urgency.
