The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On Jan. 28, 2025, the Ohio Attorney General's Office filed a civil lawsuit in Delaware County Common Pleas Court against defendants Starfleet Cars LLC and Jonathan Paul Kirkham, individually and dba Starfleet Cars, LLC aka Paul Kirkham aka Jon Kirkham, with the principal place of business last located at 525 N. Sandusky St., Delaware, Ohio 43015 operating as a used motor vehicle dealer, and defendant Kirkham believed to last reside in Powell, Ohio, alleging violations of the Consumer Sales Practices Act and Certificate of Motor Vehicle Act. The lawsuit alleges that defendants in some instances did not have physical possession of the titles and/or the vehicles were not titled to the defendants on the dates the vehicles were sold to consumers, failed to file applications for certificates of title within 30 days after the assignment or delivery of motor vehicles, failed to obtain certificates of title on or before the 40th day after the sale of motor vehicles, and as a result defendants alleged conduct, retail purchasers were unable to obtain certificates of title to their used motor vehicles.
The state is asking that the court to order the defendants liable for reimbursement to all consumers found to have been damaged by the defendants alleged unfair and deceptive acts and practices, to impose civil penalties, and to enjoin the defendants from engaging in consumer transactions as a supplier in the State of Ohio until they have satisfied all payments, civil penalties, court costs and have made full payment to the Title Defect Recision (TDR) Fund, and prohibit the defendants from maintaining, renewing, or applying for an auto dealer or salesperson license.
The matter is pending.
