I filed a complaint previously and received a letter to file a new complaint with your office as the previous one went to Akron Oh. It is case # ******** (Details for Case #********: We had purchased from an estate a house with a propane tank on it that the executor had reported was part of the house. We then purchased an additional tank for the house. On May 19, 2020 Beck propane showed up randomly and was attempting to steal our propane tanks. When that driver called his supervisor the supervisor claimed that the former owner had rented the original tank that was sold with the house and that they were coming to "claim" the tank. As the tank had propane in it still and to our knowledge this tank belonged to us, this action was stopped immediately. To stop the police from being called the supervisor- who repeatedly stated that they were a very well established and legitimate business would wait a month for us to investigate with the executor of the estate and lawyers to determine what exactly was the case. He also reported that they would reimburse us for the gas that they were taking. This was on a Saturday. A few days later- a Beck Propane truck showed up with out any warning, phone call as to wanting to change the agreement, or anyone home at the time and removed the tank. We immediately called the company, speaking to yet a different person who identified themselves as a supervisor. They reported that yes, they were aware of the agreement, but that he "don't care." He also refused to refund the gas that they stole, instead trying to charge us for emptying the gas- which they then drove off with still in the tank. Police reported that at the point where they had already stolen the tank it was now a civil matter. We took time to calm the emotions and to consider if we should proceed with a lawsuit. With the costs involved in a lawsuit, the complicating measure of a pandemic, technical issues, and that the amount of gas they stole was approx 75 gallons- and that the matter is further complicated by the fact that there is a executor of the estate to arrange meetings with- long after the sale of the home we find ourselves here. Business response

Business Response /* (1000, 5, 2022/02/14) */ This incident occurred in 2020, nearly two years ago. The consumer received incorrect information from the seller of the home they purchased, in that the LP tank there was NOT owned, but was leased from and owned by Beck Suppliers. The tank was not part of the property they purchased, and the previous owner had no authority to sell it or represent that is was part of the sale property. The previous owner had a contract stating clearly that the tank and regulators "shall remain the personal property of the company" and this was fully explained to the subsequent consumer/buyer. We contacted the new homeowner on May 11th to notify them that they needed to sign a service agreement in their name or we would pick-up our tank. The consumer was also offered the opportunity to purchase the tank, but did not respond to that offer. When no response was received, our technician went to pick up the tank on June 9th. There was a small amount of LP remaining in the tank, but that LP was not purchased by the consumer, instead by the previous owner. We charge a reclaimation fee for pumping out a tank of $75 plus .20 per gallon. In order to avoid leaving the consumer without a heat source, we did not re-possess our blocks or regulators, nor did we charge the consumer for them even though those parts also belong to Beck Suppliers. We believe our service contract clearly explains the ownership of the tank and equipment, and the process for terminating the contract. We stole nothing from this consumer.

      Customer response

      03/02/2022

Received the response to our complaint today. First, time mentioned ("nearly two years ago") needs d in perspective. There is/ was a pandemic that was excessively time consuming for those who needed. It was also very much noted that they did not respect any of the closing or recommended tutions. Also- they claim to have contracts and other receipts and such that they were to be mailed - yet NEVER provided such. They were to mail a copy of their information PRIOR to stealing and/ or assing. This is also part of the time frame. As for other concerns with the time- the person that have entered into any contract passed a way in 2018, yet it was 2020 when Beck became

report a contact on May 11th which never happened. It was on May 19th that a truck randomly ed up. When the driver of this truck called his supervisor, an agreement was reached that they I mail us a copy of their information so this could be addressed further, and it was made VERY clear :hey were not to be on the property with out being scheduled and supervised. They then slithered I removed the tank without proving ownership- most people would call that stealing.

offer of ownership (selling the tank) was made. Actually, it was during the conversation with the r's supervisor that the question was asked by us- if they did indeed have some type of claim is there out cost. The supervisor's response was no. They reported that they were not legally allowed to ie tank.

lg this same conversation about the fuel in the tank- yes, they agreed to pay for the fuel in the tank. ctortion fees, it was simple- the fuel was ours. Regardless of who paid THEM- the fuel belonged to d either they needed to find a way to give us our gas or wait till the small amount was used if the was indeed theirs or they had some type of claim. We were also contacted by a previous party and ed that Beck had contacted them and were asked if THEY wanted the refund check. They informed at they had told them to send it to us.

r the "blocks and regulators"- their driver reported that as they were "not up to code" -they were tge, and they would not be taking those but that we should really think about replacing them. A reputable company. was consulted and reported that that was simply not true.

ral and ethical company would have honored their agreement- verbal or not. The statement that "service contract" explains anything is moot- they have YET to mail this as requested. When one yes property that belongs to another without permission- that is stealing. A warning attached to lusiness is needed to protect the public from the unethical and immoral business practices. No one Id look up during a global pandemic to find a truck with a stranger walking around them- unmasked inleashing a company that does not honor their agreements, nor respect others property.
