    From September 1, 2022 thru September 1, 2023 I was a “resident” at Garfield Avenue Apartments. The landlord/owner of the apartment building is Kristie D. G*****. My lease was a Twelve (12) month term at $1,300.00 per month. On September 1, 2022 Ms. G***** required and received from me two separate checks: a Security Deposit of $1,300.00 and a second check for the First Month’s Rent of $1,300.00, respectively. Throughout the term of my lease, I maintained the apartment premises in good order. Pursuant to my lease, I provided a 30 Day Notice of Intent to Vacate, but also hired Elva F*****, an apartment cleaning service to clean the apartment at $140.00. Ms. G***** refunded $1,200.00 but withheld $100.00 of my Security Deposit in the belief that because this was an amount she would have charged for "general cleaning of the apartment", she is entitled to keep it. However, Elva F***** has provided me written testimony via text that at no time did Ms. G***** clean my vacant apartment on August 31, 2023. Elva F***** and her employees (a team of 3 cleaners) did in fact thoroughly clean the apartment. The $100.00 inappropriately withheld by Kristi G***** needs to be returned to me with a mutual non-disparage agreement (no future recrimination) that is fair and equitable to Ms. G***** and myself. This is sensible and realistic. Barring some malicious intent misdirected towards me, I have no idea what is driving Ms. G****** critical thinking on this matter. I have tried assiduously to resolve this conflict with her only to be met with a dogmatic and inflexible defensiveness that simply makes no rational sense. I have substantial evidence to corroborate my position with preserved electronic and written communication, and available witness testimony from Elva F****** I remain available to discuss any questions the Better Business Bureau of Cincinnati officials may have of me. I'm being charged for a cleaning fee I already paid for. Sincerely, ******* *******

    As you can see, Mr. ******* signed, dated and intialed the rental agreement under the $100.00 general cleaning fee upon move out.

    Better Business Bureau:

    I have reviewed the response made by the business in reference to complaint ** ********* and have determined that this does not resolve my complaint.  For your reference, reasons for rejection are included below.

    I have reviewed Ms. G***** response, which is contradicted by her commitment to recognize that I paid $140 to Elva Foster and two other team members who cleaned my apartment at *** ******** ****, ******** ** *****. The line item referenced in the original lease is only applicable if the tenant vacates the premises without cleaning the apartment, and therefore, requires the landlord to provide general cleaning services of the vacant apartment. Pursuant to evidence presented to the Better Business Bureau of Cincinnati from Elva Foster
    In the form of a receipt for services rendered and paid for directly by me, the additional $100 Ms. G***** is attempting to collect is unsubstantiated. In other words, Elva Foster, and her cleaning team, already satisfied the contractual requirement of the lease to clean the apartment. Ms. G***** was not only made aware of the arrangements I made to contract Elva Foster, she acknowledged it by text and email. As proof, I am attaching a thread of communication between myself and Ms. Grooms. There can be no doubt in my evidentiary rebuttal that Ms. G***** agreed to mail me a check almost 2 weeks ago, and then Express is surprise after my repeated 74 mile round-trips by car to my PO Box revealed no check was received. Ms. G***** made a commitment to settle my complaint to the Better Business Bureau of Cincinnati by mailing me a check in the amount of $100. I have not received that check, and it appears from the response you received, that Ms. G***** has caused a “change of position” that any court judge would dismiss based on the evidence. In conclusion, I need to receive immediately, a $100 check from Ms. G***** to settle this entire matter.
