      We are not satisfied with the some of the material used or the workmanship. They did not add any new base material after they removed the old driveway and there are areas with large chunks in it. An area of cracking occurred about a month after install. We were told once they filled the cracks and applied the sealer we wouldn't see them. That is not true. We can see every one of them. Recently another area of cracks developed. There are areas where water pools longer than 2 hours (my husband was told as long as it drains within 2 hours it's not an issue). The driveway is supposed to be 2-1/2 inches thick. There are areas that are not even an inch thick, yet it is so thick near the house that one of our steps is completely covered by the asphalt so there is now only 1 step. This issue with grading is also causing water to pool near the garage and at times seep under the garage door into the garage. The day they sealed the driveway it had rained the night before, and then poured down rain about 2 hours afterward. They did come out a week later to re-seal it, but it looked like only certain areas were re-sealed. Some of the asphalt or sealer was splashed onto our vinyl siding. They tried to clean it, but we now just have brown streaks on our cream-colored siding because it wouldn't come off so it just smeared. I sent a letter in with my payment for the sealing detailing these concerns, which had all been reported at various times over the summer. We have been trying for a year to get these issues resolved. After leaving a message with *** this morning (the last person to come out and finally acknowledge that there are issues), that we are going to consult legal I received a call from the owner today. He said he was not aware of any of our concerns. This only reinforces my feeling that the company does not care to make things right. We feel like we paid $5,000 for a driveway that doesn't look much better than the one that was replaced.

      Jennite knew about the issues discussed. Please see our response below.
      Our proposal clearly states that Jennite is not responsible for shrinkage cracks due to existing subgrade. We did fill cracks initially at no charge to the customer.
      As per the sealer. We are sorry for the inconvenience, but a pop thunderstorm caught us off guard. We did our best to clean the sealer off the siding. *** ****** spoke with your husband, and he said that you had some leftover siding. *** ****** proposed to supply the labor to install your matching siding.
      Jennite came back out and re-sealed the entire driveway. We did not spot seal.

      As per thickness. We installed our 2.5” average, which would continue throughout the driveway. We feel that your report off less than an inch is inaccurate. We would encourage the homeowner to provide core samples on asphalt thickness.

      As per the puddle. We had a long stretch of dry weather. We finally had some rain and *** ****** went back out to check the driveway. We did see a small puddle near the garage. *** ******* was then notified to contact ****** to discuss options. Very early in the conversation ****** said she was going to contact her attorney. At that point, *** ******* said to let the attorneys sort things out.

      I am rejecting this response because: I do not see that they are agreeing to come out and repair anything. Also I did not bring up potentially taking legal action until the day after I was told *** ******* would be stopping by on the 14th after he was done at the job down the street and he did not do so. I called *** ****** the morning of the 15th to let him know Mr ******* never showed up. When Mr ******* called me on the 15th he said he wouldn’t be coming to look at things until 7-10 days when they were back at the job down the street, and that he was never made aware of our concerns. He said if we couldn’t give him 7-10 more days to come take a look I should just go ahead and pursue llegal action. There was a puddle in front of the garage on the 14th (I sent a pic to Mr ****** per his request). The issues with the siding and our bottom step being covered by asphalt and the grill sinking into the driveway and the incorrect grading causing the puddle in front of the garage door were all things he could see without it having rained. I was skeptical that he would actually come down in 7-10 days since he did not show up the first time he was supposed to. On June 20th I emailed Mr ****** asking for the cracks from last year that have opened up again plus some new cracks that have appeared be filled while we worked the other issues out. He said he would forward my email to Mr *******. I never heard back from either of them. I do have a voicemail from last year saying cracks would be filled at no charge.  This can be resolved by the siding being replaced (and we feel we should be compensated for the cost of that siding), the issue with the improper grading near the garage door causing the puddle, the steps being covered and now the grill sinking into the driveway. We do not really want to have to pursue legal action but do not feel the company has taken our concerns seriously. I had even sent a letter outlining these concerns with my final payment.

      We obtained proposals from (3) reputable Toledo ****** contractors with instructions to provide us with a proposal for resealing our driveway and any repairs needed. There was confusion on my part regarding Jennite Company's proposal and which section of the driveway was being removed and replaced. I did talk to ****** in the office on 5/9/2023 prior to signing the proposals. By the time I realized the mistake, their crew was already removing this section of the driveway on 5/17/2023 . I assumed the parking spot section on the left side of our garage was being replaced, but this was not the case. Lesson learned to have the salesperson walk me through the proposal next time. I obtained quotations from (2) other companies (****** ****** **** **** and **** ******** ****** & ********) for the resealing work and neither indicated this section of driveway needed to be removed and replaced. Our salesperson, *** *******, reduced our invoice by $300. To us, this did not resolve the issue for work that didn't need to be done. Any further conversations with *** have resulted in him yelling, cussing and blaming me for not understanding the proposal. I would not have agreed to Jennite’s price of $10.53 per sq ft for remove and replace when compared to ******’s price of $2.11 per sq ft. Again, this is my mistake for not digging into the details and speaking with the salesperson. I feel like the work done by Jennite is a waste of $2.370 and that Jennite took advantage of me.

      Cus*tomer received Estimate from Jennite and in the Estimate #***** it states the Sawcut approximately 2’x108’ on east side of drive.  Remove and replace with 2 ½’’ of 448-1 asphalt.
      The work was accepted by the customer on 5/9/2023 @ 2:54pm customer agreed to work. 

      On May 15, 2023 the work was completed, on May 17th the customer made Jennite aware of her concern of  the area that was done on the East Side of Drive, that was stated in the proposal that she agreed upon to have completed.  Jennite did a deduction of $300.00 to help with the customer concerns, and to attempt to rectify any misunderstanding.  The customer did supply Jennite with all the other contractors proposals and upon review each proposal is a different scope of work.  The comparison of pricing between ****** and Jennite, is not for the same scope of work to be completed.  The language of each contractor is different Jennite says Sawcut/Remove/Replace and ****** says Resurface.  **** **** is Crack Filling and Seal.

      Following is my response to Jennite Companys response on 06/22/2023 to complaint ID ********.

       

      Customer received Estimate from ********************** and in the Estimate #***** it states the Sawcut approximately 2x108 on east side of drive.  Remove and replace with 2 of 448-1 asphalt.
      This is a correct statement. However, the proposal was not reviewed with ***** and ***************************, homeowners at **************************************************************. There was confusion on the part of ***************************** on area of driveway being completed.

       

      The work was accepted by the customer on 5/9/2023 @ ********** customer agreed to work. 
      The work was accepted on 05/09/2023 by *****************************, but only after ***************************** called Jennite Company and spoke to ****** in the office to confirm work area and whether grading would be completed to prevent water from pooling between existing driveway and area where work was being completed. See file titled Estimate ***** from JENNITE COMPANY - Remove & Replace Mistake and Cancel Resealing with response from ****** confirming there was a phone conversation but does not include details of the conversation.

       

      On May 15, 2023, the work was completed, on May 17th the customer made ********************** aware of her concern of the area that was done on the East Side of Drive, that was stated in the proposal that she agreed upon to have completed. 
      The work was completed on the morning of 05/17/2023 and not on 05/15/2023. ***************************** reached out via email on the same day work was completed to cancel resealing work and to memorialize she was not happy with work completed.

       

      Jennite did a deduction of $300.00 to help with the customer concerns, and to attempt to rectify any misunderstanding.
      The $300 deduction was not acceptable to ***** and ***************************** for the following reasons:

      Jennite was the only company advising this section of the driveway needed repair out of (3) proposals obtained from local, reputable companies.
      *******************, failed to walk homeowners through the proposal and the area of the driveway being torn out and repaired. Noting only the "east side of the drive".
      ***************************** called the office on 05/09/2023 and spoke to Laruen with questions on the area and grading prior to signing the proposal.
      A seasoned asphalt and driveway professional inspected the work performed by Jennite and advised this area of the driveway will fail in the next couple of years.
      During a telephone conversation between *********************** and *********************, ********************* advised he did not care if we paid the invoice.
       

      The customer did supply ********************** with all the other contractors proposals and upon review each proposal is a different scope of work.  The comparison of pricing between Allied and Jennite, is not for the same scope of work to be completed.  The language of each contractor is different Jennite says Sawcut/Remove/Replace and Allied says Resurface.  ********* is Crack Filling and Seal.
      The only guidance provided to Jennite, Allied and *********. by homeowner was to provide homeowners with a proposal to reseal and repair driveway as needed. Complete proposals are attached from each of these companies. Jennite was the only company to advise the section on the east side of the driveway needed to be torn out and replaced. In addition, homeowners had a seasoned asphalt/driveway expert review the work completed by Jennite on 05/17/2023 and the expert advised homeowners to not pay Jennite Company as this area of the driveway will fail within the next couple years.

       

      Homeowners made several attempts to discuss with *********************, Jennite salesperson, and *********************, Jennite owner. ********************* was not helpful and extremely rude advising *********************** his wife ***************************** was an idiot for not understanding the Jennite proposal. In addition, ********************* advised he would not come out to inspect the work completed and that he didnt care whether we paid the invoice.

      ***** and I are in receipt of the Mechanics Lien # ********-0022242 filed by you on July 17, 2023, in the amount of $1,975. Please be advised that the Mechanics Lien # ********-0022242 has been improperly filed. You indicate The first and last day which labor, work and materials were performed or delivered, were May 18, 2023, and May 18, 2023. This is incorrect. The actual date of work performed and completed was May 17, 2023, as documented in the attached email correspondence between me and *********************************** on May 17, 2023 and on the attached Jennite notes provided to the Better Business Bureau (BBB). Based on the work being performed and completed on May 17, 2023, Mechanics Lien # ********-0022242 was not filed within the 60-day ORC legally required timeframe and instead was filed 61 days after the work was performed and completed.

      In addition, you noted the work was completed on May 15, 2023, in your BBB response to our claim (snip from BBB website below).

       

      Therefore, Mechanics Lien # ********-0022242 needs to be properly removed by Jennite Company from the public and legal record. Please note that anything short of an error on your part regarding the incorrect date stated in the lien can be deemed as an act of fraud as you were under oath when you prepared and signed this document.  To avoid further legal action, please remove this invalid lien by September 8, 2023 and provide us with proper documentation of its removal.

      We will not be making payment on the attached invoice for the following reasons:

      6. ***************************** filed a complaint with the BBB that Jennite did not respond to.
      None of the above items have been resolved and our position on payment to Jennite remains the same. In addition, the Mechanics Lien # ********-0022242 filed by you on July 17, 2023, in the amount of $1,975 has not been removed. This lien was filed fraudulently using incorrect information. Please refer to my email correspondence dated August 8, 2023.
