    On 9/13/2024 a check was sent to Toledo Pole Barn to initiate the building of a pole barn at ******************************************************************. This was after ten weeks of working with ***** ******* to get permits from ************. At the time ***** indicated it would take four to six weeks to get the permits from ************. I was also told it would take two weeks to frame the building and build it out. Lucas County wasnt the source of the ***********, is December 19, 2024. Eastman has received a total of $65,435.65 from me and has not attempted to construct the pole barn. Material arrived on site at the beginning of December but hasnt been touched since.Since that day I have been getting the run around on when the construction will occur with the last cancellation being Wednesday, December 18, 2024.I have asked ***** ******* for a complete refund of my money which I have documented via text messages or the completion of the building of my pole barn. At this point Im not getting a response to whether he will refund the money or start the building process.This process has not gone anywhere close to average. I have been given different dates that havent been met on five occasions. This is my last attempt to resolve the situation before it is turned over to our legal counsel.Looking at the website of Toledo Pole barn you would be under the impression that they manufacture pole buildings and assemble them. In my case they have outsourced the building of components as well as the assembly process. They indicate **** has built pole barns since he was 14 on their website, where in fact he is a salesman and owner. In researching ***** ******* it looks like he was in the finance business until a couple of years ago, yet on their website it shows him only being in construction for two to three years.

    Sept 13 - initial signed contract
    sept 23 - updated signed contract
    Sept 25/26 - ***** works with **** with Via texts to get location of building for permits
    Oct 1 - Permits Submitted
    Oct 15th - I asked if he got his zoning permit. He did not. 
    Oct 21st I submitted the **** slip and Zoning permit he gave to me
    Oct 21st He mentioned he was going to ******* the first or second week of Nov.
    Nov 5ish - permits approved
    Nov 17th - **** called and asked for update
    Nov 18th - sales to project management hand off meeting
    Nov 20th - **** reached out and asked for another update
    Nov 20th **** talked to **** for 9 min 34 sec
    Nov 25th - material was ordered
    Nov 26th **** was onsite for a preconstruction meeting with the customer over the phone
    Dec 2 - Material was delivered and customer paid milestone invoice
    Dec 5th Customer becomes rude with project manager and ***** calls customer
    Dec 6 **** updates **** via that his desired start date that he set was not possible, and we were able to start the following week of Dec 16th
    Dec 6th **** becomes aggressive and rude via texts messages. However we assure him that we will build his barn and give him a quality structure.
    Dec 11th we let him know that the rain delayed the crew and they would be there on the 18th.
    Dec 11th Customer demands his money back
    Dec 12th - ***** tries to call ****, but will only communicate through text
    Dec 12th **** says the only solution to resolve the problem is to give him his money back and take back our custom ordered material
    Dec 13th ***** asked if we should proceed with sending a crew. He said if I send a crew to build his barn, we will bare the consequences
    Dec 13th I tried to get him to say Yes or no if he wants us to build his barn. His response is I Would like a complete refund of my money and for you to pick up your material. That cant be more clear
    Dec 18th **** said I failed to hold up my end of the agreement by not sending a crew
    Dec 19th- ***** demands a call with ****. Call is recorded.


    We are actively trying to find a resolution with the customer, but he has made it clear that if we fulfill our end of the contract, we will bare the consequences, and he does not see it ending well, and many other comments that would indicate that he is going to make this difficult. This makes me uncomfortable with sending crews out there to work on his project, and if I would ever get paid the contractual amount.

    I have very clear notes, screenshots and call recordings that validate my defenses. Although the overall process was not flawless on our end, our time frame and communication has been reasonable and fare. There was no mention or promises from our end of when the build would start until our communications on Dec 11th about the job starting on Dec 16th. Customer did mention that he was leaving for Florida the first or second week of Nov, but never demanded the building be built before then.We do not have any notes, texts, CRM documentation, or contract language stating a time frame that the build would be complete. 

    I would be happy to provide any and all communication to prove that we are a great company and that we responded to the tough situation we were put though in a professional manner.
