We are sorry to hear about the issues you have encountered with your vehicle. We would like to clarify some important details regarding your purchase.
You purchased the vehicle on November 11, 2024, with the understanding that it was sold "as-is" with no warranty, as outlined in the agreement you signed. At the time of purchase, you also declined the option to purchase an extended warranty. Additionally, on January 11, 2024, we provided a complimentary service to replace the serpentine belt and power steering pump at no cost to you, as part of our commitment to customer satisfaction.
However, after your insurance was cancelled on December 2, 2024, and your payments became overdue, the vehicle was repossessed. It was only after this event that you reached out to the BBB with a complaint, despite having had the vehicle for over four months.
Please note that we have attached all relevant documentation, including the "as-is" agreement, the waiver of benefits for warranty, and proof of the cancelled insurance. We always strive to be transparent and fair in our dealings, and we hope this clarification helps to resolve any misunderstandings.
We regret that you're facing these challenges and wish you the best in getting the situation sorted. Should you have any further questions, feel free to reach out to us directly.

[BBB Transcription via *******]Consumer purchased a vehicle the supplier said was in good working order. Shortly after purchasing the car it broke down. The supplier took the car back but would not refund the money she had paid

The customer purchased the vehicle on 09/17/24 after a test drive and was informed that the vehicle was sold "as is" with no warranty. They opted to purchase a monthly warranty through Cars Protection Plus but failed to keep up with the payments. Two months after the purchase, the customer contacted us, stating the car had broken down. We reached out to the warranty company and were informed that the warranty had been canceled due to missed payments. We notified the customer that they were responsible for any repairs, and we did not hear from them again until 12/13/24, when they sent us a letter. We forwarded all relevant documents to our lawyer, who took over the matter from there. We will include all "as is" paperwork, the warranty cancellation, and the lawyer's response.

***** has been extremely rude and unhelpful when we told him that our tire shredding wasn't the only issue. He told us he fixed the tire and nothing else was wrong with the car but when we were coming home the tire locked up and we spun out in the middle of a busy highway then hitting a wall with two small kids in the car. My boyfriends neck is in pain and my back hasn't been right since we did not go to the doctor right away because the shock didnt wear off until a day later. We have already asked for an exchange for a same value car or getting our money back and giving them the car. We honestly dont feel comfortable trying to drive it again as its getting cold and icy out and we cant put the kids in ***** way.

***** completed the job as requested by replacing both rear tires. The vehicle was sold as-is with no warranty, and we fulfilled our obligations. Beyond that, we cannot be responsible for how the vehicle is driven or maintained after leaving our care.

Thank you for reaching out to us. We understand how unexpected repairs can be frustrating, and wed like to help clarify your warranty coverage.
The 2010 **** Edge was sold as-is, meaning we do not provide in-house warranties or coverages. The three-month warranty you purchased was through a third-party provider, and they set the terms, coverage periods, and limits. We apologize for any inconvenience related to the coverage or its limits.
We recommend contacting the warranty provider directly to discuss your claim and any questions about coverage. If theres anything we can help with in supporting you through this process, please dont hesitate to reach out.
Thank you again for bringing this to our attention.

I purchased this car about 5-6 months ago and have had problems ever since. The alternator caught fire I replaced that and then the fuel pump went out and I paid the car lot $400 to fix it and they told me it was a brand new part and come to find out the car was fixed and ran for about 2-3 weeks and broke down again and I replaced the fuel pump brand new and seen the pump they put on was from the junk yard and it was not brand new. They got me out of $400. I pay my note faithfully and never been late. Also, on the 4th of July my car broke down again and I ended up getting stuck in Detroit getting rained on because the van had no power to roll up the windows and a few days later I ended up in the hospital with pneumonia. I was hospitalized for 4 days and in the meantime I called the car lot to tell them about the problem and how I had to get my uncle to tow it to Saginaw to get it looked at and the car lot came and picked it up for no reason after I paid them this month for my car note. I need help getting a better car or to violate how they treat people so grimy and dirty.

Our customer purchased her vehicle 2/6/2024, we have attached documents that she signed acknowledging that this vehicle was sold AS-IS. She was also offered an extended warranty to help with future repairs however the customer declined that at the time of sale. We do good business here so when the customer called in complaining about her vehicle we tried to help her by picking up the vehicle via tow and replaced her fuel pump. Her vehicle broke down again and she called saying she had to move due to someone shooting her home up here in Toledo. She told me she was in Michigan I told her we would try to help her but since she took the vehicle out of state that she would have to get it towed back here on her own. We never heard back from her until she took the vehicle all the way into Saginaw Michigan and she called us saying she no longer wanted it. We immediately got it looked at the mechanic stated there was caramel in gas tank coming out of the fuel injectors and the fuel pump. So clearly the vehicle was vandalized which has NOTHING to do with the repairs done on the vehicle and everything to do with our customers situation personally. We have tried everything we can to help this customer and she has been completely ungrateful yelling and threatening staff so we will no longer be dealing with her. IF she chooses to claim her belongings she must come with the authorities this is NOT negotiable!

First choice auto finance towed my vehicle and will not let me retrieve my belongings I have a 1 year old child that I take care of and all of our belongings are in the vehicle including my ID work ID Social Security Card Birth Certificate and Bridge Card and my mothers ashes. I have not been able to get to work because I have none of the belongings and items I need for work. I have already given the company the key back and they are being very rude and unprofessional about the situation. They are trying to charge me $200 dollars and no where in the contract does it say I am obligated to pay $200 to retrieve my things.

    Business Response

    Date: 07/12/2024

Unfortunately this customer chose to avoid us at all cost not only lying about her address but not making one single payment on this vehicle after being out for repossession for almost two months. Once the vehicles are repossessed other fees and charges may be applied. We have attached the signed contract showing that the customer did indeed agree to these terms. Once this customer realized she wasn't going to get her way she stormed into our office yelling and screaming at staff. She is no longer allowed on the property without the authorities to ensure staff safety and a safe place for our responsible customers to conduct business.

I am rejecting this response because: I have made payments on this car multiple times and I never not one time stormed into this establishment or even raised my voice at a employee as far as my address I just recently moved and have proof that when I got the car I was still at the address they have on file. This is completely absurd and lies and very unprofessional. First choice wanted me to sign a paper stating I received all of my belongings out of the vehicle and when I expressed that I would not sign that paper they became upset and got even more rude. A employee even snatched something out of my hand because I would not sign the paper stating I received my belongings.

    Sincerely,

    ********** ******* *****

First and foremost she has missed two payments. The only payments that were made were the down payment and 1st monthly payment, you can see this in the payment history I have attached and in the scheduled payment book she was given. There is no argument here, you can sign the document and pay the fee to get your belongings or you can not pay or not sign the document. As explained in the contract you signed we can charge a belonging fee. And just so we are clear we will not tolerate the yelling and screaming you brought to our office on 7/9/24. IF you choose to come back to retrieve your belongings you MUST come with the police because we will not deal with this situation again.

I am rejecting this response because: This information is completely false. I will pay the money for my belongings in just a few days. The contract states that I have 35 days to retrieve my belongings from the vehicle.

Constituent states they bought a 2013 Dodge Avenger from First Choice for $8500. They stated the car
was in good working condition. Less than 4 hours later the whole front bumper fell off, its started running
hot, and there was a nail in the tire. He bought a warranty for the car, but the salesman states it only
covered the engine and the transmission.

    Business Response

    Date: 03/05/2024

Our customer came into our office stating he went through a car wash and his front bumper came off. While we were discussing the matter the car wash contacted our customer and notified him that they had his front bumper and their machine had ripped it off in the car wash. We helped the customer out and repaired the front bumper. Our customer left happy. This vehicle was sold AS-IS I have attached the paperwork, our customer is fully aware of the terms in which we sold him the vehicle. We do NOT offer exchanges, transfers or refunds.

My husband speaks English as a second language, and this company took advantage of him, he called me to assist him with payment on the vehicle on 9/22/23, I went on my lunch to assist him, he paid for a 6 month warranty, I paid for the purchase with my credit card, he left the dealership and the brakes had an issue, My husband reported they are going to fix it, the owner ***** said they would. The brakes are still in need of repair, then there was issue with the transmission, all within 2 days! They want us to pay for labor,

    Business Response

First I want to make it known that we sold this vehicle to *************************. She clearly purchased this vehicle for her husband who has been coming to our office and calling our office non stop to communicate on her behalf. His English is perfectly fine. We sold ************************* this vehicle AS IS NO WARRANTY. She did purchase an extended warranty for any future problems. Her husband came to us with the brake problem and immediately we took care of it free of charge. Then he came back to us days later complaining about the transmission, we gave the customer several options to resolve the matter. We are currently waiting on the customer to come back to our office so we can find a solution to this matter.

I purchased a 2009 GMC DENALI from First Choice Auto and five weeks later the engine locked up. I called First Choice Auto and the lady was very rude to me when I told her about my problem. She told me that I would have to get it towed to the car lot on my dime. She kept saying that I signed a as is contract which I did but she also insisted that she offered me an extended warranty which she did not. All she did was push the paperwork through the opening and said sign where she marked it. I take some of the blame for not reading what I signed first. After I sent it back to them she said that they would offer free labor but I would have to purchase the engine for $4000 and still pay them the $9000 balance remaining. That was unacceptable due to the fact that I didn't do anything but get the oil changed and put gas in it. They were not willing to put me in something else or anything. It's a shame that the City of Toledo has businesses here that are preying on the public and selling people bad automobiles. I also traded in a running car along with a $1775 cash payment. Now I have nothing.

On 7/22/23 ****** ******* came in test drove vehicle and chose to purchase the 2009 GMC Yukon. Attached to this response are the documents he signed acknowledging that the vehicle was SOLD AS IS and when offered the warranty he declined our offer and signed a waiver acknowledging this. Per the paperwork he signed there are NO EXCHANGES, NO TRANSFERS, NO REFUNDS. All vehicles are sold as is this is why we sell the extended warranty, clearly this vehicle was NOT like this when he purchased it.

    Complaint: ********

I am rejecting this response because: She said that she offered me a extended warranty which is a lie. I admit it was my fault for not reading what I was signing but what happened was she put all the papers through the opening in the glass and told me to sign where she had marked and I did not knowing that I could've purchased a extended warranty. If she had've offered it I would've taken it. Also I gave them a car on the trade in. Now I have nothing to get around in. I'm a amputee and it's sad the way that they are doing people. I've done my research on this business and they're numerous complaints on them about the same thing that they did to me. I offered a solution to this problem and they rejected it. Which was. Put me in something else and you can continue to do business with me but they're response was that I bought the vehicle as is. Again I only had the vehicle for five weeks and one day.

    Sincerely,

    ****** *******

They had a HIDDEN down payment fee, when I purchased the car on 6/2/2024 for $700 down. I never agreed to put down 1,000, $700 was the agreement. They are trying to add extra charges. I’ve paid my first car note that was due my insurance and everything. As far as I am aware and what I AGREED to and SIGNED that was ALL I was supposed to pay for a down payment. Now they texted me saying I owe a deferred down payment of $425??!? threatening to re po my car and make me get a new one when I never knew about this. I only agreed to pay $700 down plus a payment of $250 dollars a month. This was not in my understanding. I lost my wallet and phone out of town, someone stole all the money out of my account, so even if I did have to pay this right now I wouldn’t even be able to!!

    Business Response

    Date: 06/28/2023

First I want to say that every vehicle on our lot has price tag with the down payment written out and it specifically says PLUS TAX AND TITLE. Secondly we go over all future payments and down payments at the time of sale. Not sure if you were not reading the documents presented to you but you signed a contract agreeing to these terms. I have attached a copy for your review. On the day of sale we SPECIFICALLY ask you if you are able to pay tax and title with your down payment and in your case you said you didn't have it so we were willing to defer that payment for you as a courtesy for 25 days. We ALSO explained to you that this payment is FIRM on the due date and there are NO EXTENSIONS. We ALSO give you a payment book that you so kindly took a photo of to REMIND you of the due date. This definitely NOT a scam or hidden information we even called to give you a reminder and sent a text message as a courtesy however we still have a policy to follow so if you cannot afford this payment you are welcome to bring the vehicle back and sign off so you will no longer be financially responsible for it.
