      On 8/11/2023 ****, from OGW LLC, Showed up, unannounced, first thing in the morning, before i woke up that morning, and proceeded to use his Rock Hound, to cultivated and do whatever else he thought was going to happen, but instead, proceeded to do exactly what i told him was going to happen to begin with, and spread a lot of gravel around my yard, that i had spent the last year, removing by hand.. He had to drive it around a riding lawn mower, that was sitting by the road, because i didn't know he was coming that morning, and then he also left lines in my whole yard, that were an inch to an inch and a half tall, from one end of my yard to the other, which ended up being 8 to 10 of them, from the road to the house, that went from my driveway to the street. Basically, he left my yard worse than it was when he started.. I tried calling him a couple of times and got no response or call back,.. Then his 2 workers showed up with a truck that had straw and seed. However, after talking with them and explaining that my yard wasnt ready for any of that, i sent them away. And then **** called me a couple of minutes later, and did his best to manipulate me into allowing them back on the property to seed and straw, after me telling him repeatedly that it wasn't ready. He may of either thought i didn't know what he was talking about, or didn't care but, he insisted that everything would be ok with all of the gravel that was thrown around my yard, and that those mounds of dirt would dissapate after sometime, and i wouldn't notice them...and none of that was true. I'm not even mad that 1 day later, we had a thunderstorm that washed away 50% of the straw and seed, and i had to spend more money on straw and seed to replace what was washed away, and i never did hear from him after that, to make sure that everything was ok with my yard, which it wasn't. I spent an extra $275 for straw and seed, and had to work a few hours to rake up the older straw and reseed and replace all.

      To whom this may concern:

      This is a direct response to the complaint as written. The date we showed up is incorrect, it would have been the 22nd. I did proceed to knock on the door with no answer. It is standard for us to let the customer know a date range on when we would show up. Our business is weather depending as you can imagine. Rock hounding did take place. I had educated *** on our process of completing this job for him. I stated we would be out to rockhound then seed and straw. I explicitly remember a discussion with him about what rockhounding was and the benefits which I will explain again here. Rockhounding is a process where we take a rockhound attachment on a skid steer and run over the entire bare soil area. This piece of equipment has little tines that spin and pick up rocks. It is industry standard to seed over what the rockhound won't pick up. I will admit that *** had done a fabulous job of removing rock from his soil. Some might ask why would we even rockhound if he has done a great job of picking up rocks. The answer to this would be the added benefit of a "dust" seed bed. When the rockhound is in motion, it leaves little "dimples" in the soft soil. This is a great seed bed when we broadcast seed. Is ***s case, the soil was perfect for this, the rockhound left perfect "dimples". Yes I will also admit there are some small lines that this rockhound attachment can leave in soil as good or soft as his. With the small "dimples" in the soil, the seed will fall into these when broadcasting seed. Once the rain or sprinklers water the soil the soil will typically flatten out over the seed creating great seed to soil contact. The small lines of dust soil will also settle over time. The statement made by *** of spreading rock around his entire yard in my opinion is completely false. I do agree there was a lawn mower left in the middle of the yard which I had to go around since no one answered the door when I knocked. In the area around the lawn mower there was some small gravel in the yard. This gravel was 57 size or smaller. This was visibly the only area that had any gravel. This area was small, approximately 10'x10'. Again, what the rockhound doesn't pick up is industry standard to seed over, especially with this being small gravel. I did miss a couple of phone calls from *** while I was on another job. I then received a call and spoke to my employees, who told me that *** had turned them away when they showed up to seed and straw. I then proceed to call *** right away. After a discussion with ***, again educating him on industry standards he proceeded to let us seed and straw the area. I think the terminology of "manipulating" him into allowing us to do the work is incorrect. I had asked *** if he thought every single yard that grows grass doesn't have any rock. The answer to that question is NO. Almost all yards have rocks found in them. Some are worse than others. ***s however was very clear of rocks except for a small area as stated above. As for the washout of the seed and straw in 50% of the area, this is not under our control or responsibility. I had driven by ***s property on the week of 9/18 which showed great success in the job that was completed. Now, one might ask what should a lawn look like a few weeks after this was completed. A yard a few weeks after a job like ***s should have grass coming up throughout the area, which was the case here except for the washout spots. This again is not in our control. I'm not sure if his expectation of his lawn was to look like the 18th hole at Augusta, but this is never the case, not even with a sod install. The job of producing a nice thick turf area takes time. His yard was seeded at a perfect time of the year. The grass came up and is producing strong roots to make it through winter. After our job of seeding, we are not responsible for the care of the turf. All properties that we do this type of work on, we recommend reseeding the following year to thicken up the turf as well as start a fertilizer program. 

      His desired settlement of not wanting to pay anything or just pay for materials is asinine. He agreed and signed an estimate for this work, he was told exactly what was going to take place, we did exactly what we said we were going to do.

      We have made multiple calls to *** for payment since the job was completed with no prevail. He did answer a phone call from me on 11/6 with my hope of solving the situation. During this phone call I heard his concern and tried again to educate him on the job we did for him and industry standards. He proceeded to interrupt me multiple times while I was talking, then the call was dropped. I am assuming he hung up on me, I did call back two times immediately following, the second time I left a message stating that I was willing to listen to him again and have a conversation man to man, which he clearly doesn't want. He has on multiple occasions posted to social media negatively about Ohio Green Works LLC. This can result in a defamation lawsuit. *** was placed in collections for his $2122.74 debt (minus late charges) to Ohio Green Works LLC on 10/30. We wish to settle this case amicably.

      I am rejecting this response because:  He did not try to resolve anything before he started talking down to me and saying that he was educating me.... I have been working on this yard for over a year, and have a few hundred hours working,by hand, to get rid of several tons of gravel, and have researched enough to be able to stat my own lawn service, so i don't need some high school bully, trying to intimidate me, and manipulate me into believing his B.S. And how dare you to call me and try to harass me, after sending me to a collection agency. Educate me? Is that how you talk to people? Not in my world. You are one of the most disrespectful people i have dealt with in a long time. After you intimidated me, manipulated me, and coerced me, into believing that everything would be fine, after you came and destroyed my hard work, which by the way, the 1000sq.ft. to 1500 sq.ft. section , that you didn't spread all of my gravel on, which doesn't have the hideous dirt tracks in, actually grew grass just fine, which leads me to believe that you  were just using the excuse of the rockhound, to make more money for yourself. So, beside the fact that you gave no prior notice to showing up, like maybe a phonecall the day before, like everyone else in the world does, and your workers, driving their 1 ton+ vehicle through my yard, for no reason, because your straw blower didn't even work, which you had already (groomed) with your machine, and left deep enough grooves in that you could twist an ankle in, and the fact that they only did one round of seed in my yard, until i mentioned that there definetly was not enough coverage of seed ,before they decided to do again, and i also then noticed that there were  spots of dirt that had no seed on it whatsoever... and then barely threw any straw on top of the seed, until i pointed that out, and had to help them spread straw, which in the end, was still not enough coverage, but i was tired of watching them stand arolund watching me, while i kept getting bit by the flies that they brought with the straw.

      This is infuriating me, that one guy can be so unaccountable for his actions, and when caught red handed, is denying having ever done anything wrong! I have way too much integrity in me to think that i can not at least try and stop you from being able to use the BBB name, to make any more money with. It is bad enough that you use the 100% gaurantee or your money back bit, but can't even stick with it! I would of had no problem paying that money for a job well done, and would of even given a healthy tip, because i had already worked hard enough in this yard for the past year, and wanted a break, and thought a professional business would be able to come in an finish the job but, i still had to do work to finish it plus buy more seed and straw. It is a slap in my face and i don't appreciate that, or the fact that you have to talk down to people to make yourself seem what, more important, or better?... You made yourself out to look like a fool after our conversation when you intimidated me to get the guys to come back, and i swore, and even told one of your guys,, that that was the last time i was ever going to talk to you, and i kept my word until you called  back to harras me some more the other day... oh no, as you stated, again, to educate me...You made yourself look dumb and i was dumber by the time i hung up the phone! You don't talk to people like that, you should  be ashamed of yourself but, i know you won't be, because i l know guys like you and they just go on being bullies until they grow up and realize that it is too late to go back and you end up finally regretting the choice.

      You need toi educate yourself for a change... and definitely your workers! Things sure would of been different had i known you were coming, so i could of picked up the rest of the gravel, moved the lawn mower, and well, your guys still would of left crevices in my yard and you still would of left dirt mounds throughout my yard but i would of had so much more work to you, at my expense.

      You can bet from now on, i will not be lazy again, and expect anyone else to do what i should of done in the first place, all because you have horrible work ethic, and your bully attitude. It's dispicable and i hope one day you look back and regret the way you treated people. I should not have to pay for your poor work ethics!

      I am rejecting ***s response due to the fact that I did not, nor would I have talked down to a customer. *** has not given us the chance to talk to him personally, he has hung up the phone or failed to return calls or emails. He has refused to work through this amicably. For him to start name calling my self or Ohio Green Works is asinine. In my opinion this is a black and white case. I did try to educate him on industry standard practices and he rejected this information. I did not in any way, shape or form try to intimidate, manipulate of coerce him. We would like to move to arbitration. Thanks!
