Back on June 20, 2023 I applied for a loan at my local bank. The bank wanted an abstract on my land, through various phone calls with the final one being on August 9, 2023(along with a text from *************************) it has been discovered that when they(United Land Investments) filed my deed with Pottawatomie County on January 11, 2021 the deed had someone else's name on it instead of mine. It was on August 9, 2023 I asked ******************** to please file a corrected deed with the county and his response was to text him a copy of the deed and he would let me know what his office said. On August 10, 2023 I received a text from ******************** telling me to have my attorney to call their attorney(*************************** ************) and they have not spoken to me since.My attorney has forwarded me every email he has sent to ******************* the latest being on August 28, 2023 showing him the names that need to be on the deed and this needed to be resolved. He even created a "Special Warranty Deed"(blank except for the legal description) for ********************** that to me looked like all he had to do was print it and fill in the correct information.As of today there has been no response from anyone. I have even offered to pay the fees for typing up a corrected *********** it from their office in ************* then to the courthouse in Shawnee and pay the filing fees there even though none of this is my fault.I'm wondering at this point if I will ever get a deed in my name or if the name on the deed is going to show up at my door someday and try to throw me off my own property because his name is on the deed.By searching the internet I have discovered this company is doing business under: United ************* Pioneer Realty, ********* Communications to name just a few and alot of the reviews in ****** are describing similar situations ie: survey markers on a property do not line up, someone driving thru their property and they were not made aware of easements, etc.Business Response

Our company is called United ************* LLC, not United Land Investments referred to in the complaint. I have never heard of that company or any of the names or parties referenced in the letter. This is the first time I have heard anything about any of this, and I am the owner of 23 years. We were certainly not a party to any of the documents referenced, as we deal solely in oil & gas properties. You obviously have the wrong company. On 8/9/2023 Ms. * contacted Mr. * (********************** *and salesman) stating she would like a new deed with her name only as her husband was deceased. She then suggested ********************** *and draft another deed, sign it and she would come to our office to pick up and record with the county. We advised her to seek legal counsel as the property had already been deeded to both her and her husband. The original deed recorded with the county in 2021 did have Mr. & Ms. * as Grantees; however, there was an additional section several paragraphs down that contained a different name (Mr. *** It was a complete oversight and ********************** *and's fault. We were not made aware of this until 8/22/23 when Ms. *'s attorney spoke to ********************** *and's attorney. Our attorney tried repeatedly, as did ********************** *and, to contact Mr. * and were unsuccessful for several weeks as our attorney advised Mr. * needed to sign a quit claim deed to ********************** We were finally able to get in touch with Mr. * and he came to our office to sign the deed prepared by ********************** *and's attorney on 9/14/23. It was then sent to the county to record on 9/15/2023. On 9/18/23 the county rejected the deed citing ********************** *and needed to pay documentary stamps and returned to ********************** *and; however, it is exempt from paying documentary stamps because the consideration is less than $100. The mail was on an employee's desk, unopened on 10/2/23. Once this was realized, the original deed was mailed to ********************** *and's attorney on 10/2/23 for him to record with *ottawatomie County.Customer Answer

I am rejecting this response because: I never asked that a new deed be created in my name only, this is a complete lie. What I asked for was a deed in "our" name. I had already filed an affidavit of survivorship with Pottawatomie County.The reason this issue was not noticed until 2023 is - foolishly - I did not read the "Special Warranty Deed" after it had been recorded(in 2021) and a copy sent to me I simply put it with "important papers" and placed in the safe. I would have thought when a business produces legal documents that deals with someone's life they would at least have someone proof read it before it was filed with the county.
I had no idea United Land was doing all the things mentioned in their response because they refuse to communicate with me and want everything done thru an attorney. I also wonder about a business who receives mail and leaves it unopened for 15 days on someone's desk especially when they could obviously see it came from a county/legal office.

I am rejecting this response because: First of all no one notified me *************************** had signed a quit claim deed - which United Land showed as the owner on the original Special Warranty Deed - the quit claim deed was reacorded with the county on 10/4. Where is the warranty deed? And why wasn't it filed at the same time? No communication is the big issue here.

All correspondence was between our attorney and Ms. *** attorney versus her directly. Due to the nature of the issue, we thought it best to use a legal expert. We are not able to provide a response as to why her attorney did not communicate with her as our attorney said there were 44 email exchanges between the two attorneys. An email is attached from her attorney citing: "it might be better to have ********************************* a separate quit claim deed". We cannot help that her attorney did not communicate that to her. Our attorney received the recorded deed 10/13, as it was mailed to him from the county, and he emailed her attorney a copy (email also attached). Our attorney was to then mail it to Ms. ** This deed corrects the clouded title on Mr. and Ms. *** property. There is no other warranty deed to be produced. If there is, she will need to have her attorney reach out to our attorney as the original deed was recorded with the county several years ago. We are unable to re do a special warranty deed due to a deceased spouse several years later. That would need to be handled with her attorney as the property is already in Mr. and Ms. *** name.Customer Answer

I am rejecting this response because: yes the quit claim deed has been filed but what is still unresolved is the abstract which reads: Upon Buyer's payment in full of the Puchase Price, Sell will execute and deliver to Buyer a Warranty Deed conveying the Land to Buyer, less, except and subject to the Permitted Title Exceptions, less and except the Prior Mineral Conveyances and subject to the improvements. Seller will pay up to, but not more than, $300.oo to assist in closing cost; however, seller will provide a base aabstract if one has not yet been built.The property has been paid for since December ******************************************************************************************************* default of for almost 3 years.
