BBB found an ad appearing in the Tulsa World Classifieds on January 24, 2016 that contained a BBB Code of Advertising violation. On January 26th and February 4th, 2016 Better Business Bureau sent correspondence to T-Town Tree regarding the company's advertising. The company's advertising contained an underselling claim that violates BBB's Code of Advertising (COA). Specifically, BBB found the business's advertising violated the following BBB Code of Advertising guideline:
BBB challenged this underselling claim: "Best prices in town"
Advertisers can lessen the potential for consumer confusion by appropriate qualifications to any lowest price claim, such as by stating that the advertiser will beat a lower price. Whereby, the offer must clearly and conspicuously disclose fully any material and significant conditions which apply including, if applicable, what evidence a consumer must present to take advantage of the offer and those terms cannot be unrealistic or unreasonable for the consumer.
BBB's Code of Advertising states, "The primary responsibility for truthful and non-deceptive advertising rests with the advertisers. Advertisers should be prepared to substantiate any claims or offers made before publication or broadcast, and upon request, present such substantiation promptly to the advertising medium or Better Business Bureau." To-date the business has not responded to BBB's correspondence regarding this matter.
