      On January 21, 2023 I purchased a vehicle from Team Hayes Auto Group Purchase I traded in my 07 Chrysler 300c with a private party value of approximately $7500. It was a Saturday evening. I drove the car home and the next day I took the car for approximately a 20 mile drive and the check engine light came on. Hayes Auto Group was closed Sunday so the next business day I immediately notified ***** Hayes and brought the car in to be fixed Picked it back up and almost immediately the engine light came on.Took it in again and again they said they would fix it .This time my wife was with me and we told them we were a little concerned. And ***** and **** Hayes stated dont worry we WILL NOT sell your Trade in vehicle until we get this resolvedAgain the engine lite came on ***** said he needed to order a part and it would take about a week. They sold our trade in.After nearly 2 weeks and multiple calls and emails to the dealership **** Hayes called me and told me we cant get the part, its back ordered and gave me instructions to take the car to a specific mechanic and he would work on it. The mechanic called me a couple days later and told me he didnt feel comfortable working on this car. notified ***** and he instructed me to bring the car into the dealership and he would contact the warranty company. The following day on March 10th I dropped of the car. And for the last 2 weeks he has been telling me that he is in contact with the warranty company to have the car evaluated for a engine replacement. I took him at his word. And then on Wednesday 3/22 I text ***** and wanted to confirm that the warranty company was coming this week to look at the. At this time he responded to my text and told me they denied the claim. I decided to call the warranty company myself and realized he WAS LYING. He had NEVER BEEN IN CONTACT WITH THE WARRANTY COMPANY. . He has been lying this hold time. All text messages and emails are documented.He has LIED TO me thru over and over

      I ***********************, the ***** of complaint number ******** wish to withdraw my complaint I filed on 3/24 regarding Team Hayes Auto Group. We reached an agreement fair to both parties involved and i do not wish to pursue a complaint at this time. Attached is a copy of the complaint per your dismissal procedure 

       

      Hayes Auto Group was fair in this resolution so I would like this to be dismissed to not reflect poorly on this local business.

      I originally agreed to dismiss the Better Business Bureau complaint( complaint # ********)when Team Hayes owner, ***** Hayes reached out to me with what I thought at the time was a reasonable solution to the issues. He offered to take back the mini ****** that had all the problems and would sell me a 2013 ********** Jetta GLI. I tested drove the car and it seemed the time to run good. So I dismissed the Better Business Bureau complaint and made the deal. A week later I took the car to a mechanic that specializes in German vehicles to take a look at. I didnt think there was anything wrong with it but after everything I had went through with the last vehicle, I wanted to get it inspected. I found out this car had blown head gasket, a warped, head, along with that the water pump, tensioner, timing belt, and several other things would need to be replaced totaling over $4400 in parts and labor. I reached out to ***** Hayes and let him know what I found he offered to fix it there for $1000 (this was at the time when I thought I was just dealing with blown head gaskets not yet knowing that the engine head was warped as well) After everything I went through with the previous vehicle there was no way I was gonna let his shop work on my vehicle again. Before buying the vehicle, he told me that he had his mechanic thoroughly inspect it. I just feel that that is not true. I think any mechanic that inspects a vehicle would have noticed these issues. The mechanic I took it to took him less than an hour to diagnose these issues. **** hayes, the owners wife an office manager continues to send me harassing texts and emails including today after I had asked her to no longer call me or contact me at my place of business or on my personal number. she sent me a video, showing a mini ****** with a rag stuffed in the engine. I immediately could tell this was not my vehicle. My assumption is it is just a video she found somewhere on the Internet. While the car engine in the video looks similar, the car I had purchased from them was a ********************* works edition and has custom identifiable parts and painting in the engine compartment that this video did not have. She said the person they sold the mini ****** to found a rag stuffed in the engine, and that was the cause of all the problems. Im out the $7500 kbb value of my trade in (the one they PROMISED My wife and I they would not sell until these issues are resolved to our satisfaction and sold it for $10,900 a few days later with my car still in their shop. I owe $6500 approximately on this 2013 Jetta that I just spent over $4400 repairing. Im ok with the amount in the car I owe. What Im not on with is the $4400 repairs that I just had to pay for. I would have almost been okay with Team Hayes at THE VERY LEAST, splitting the repair cost with me. At this time I wish to reopen the complaint. I am also attaching a copy of the email **** Hayes (the owners wife and office manager sent to me today at my place of business. I again asked her in my response to again not contact me at my place of employment but she kept responding (I did not) and being very unprofessional in the things she was saying.

      ***************** has begun a campaign of hate speech all over social media, under various accounts. He has threatened many things, including getting an attorney, and causing us harm.

      Oh ****, there's so much that could be said in response to your post. I considered deleting it, but it seems like you really need to be heard, so I'll leave it so you feel seen. We see you.

      In an effort to at least balance the scales a bit, here are the facts: you purchased a 2010 **** from ** in January, and you did so without any input from us. You saw it advertised, came to the lot, bought the car, and what we know now, only because you told us, is that you did all that against the advice of your mechanic, although you opted to not have it officially inspected prior to purchase. At this time you also agreed to trade in your 2007 Chrysler 300, a car we have never intentionally purchased before, a car that we didn't care either way if you traded in. You agreed on the trade in value, you signed the paperwork, and it was at that time we realized we have friends in common, many of which are in the very motorcycle club you are posting on behalf of.

      You left, and when the car started showing signs of issues, we brought it into our shop, threw some solutions at it to the tune of about $700 in parts, and when we determined the problem was bigger than we were comfortable taking on, we advised you to use the service contract you purchased. We contact our warranty company rep in an effort to help you navigate through the process, although you've said you don't believe we did that because "when you called the **** customer service number they didnt have a record of our phone calls". They wouldn't. We're dealers. We dont call the **** number.... we call our rep that we've known 25 years and work directly with them. I digress. Regardless, a second mechanic also didn't feel comfortable working on the car, but by the time they determined that, the entire engine had been torn apart, and it was nearly impossible for the warranty company to approve a claim, as they were unable to determine the issue prior to teardown.

      At this point in the story, you contacted a whole slew of people, including the BBB. Your complaint with the BBB is not what prompted us to step in and try to find other solutions. It was the fact that you began bringing other people in, people we know from our personal lives, people we respect, people we care about, and you began getting them involved, and making it kindof weird for everyone. So, ok, our owner agreed to meet with you and a person you both respect as a mediator and you came to an agreement that involved us taking a huge financial loss, buying the **** back from you, knowing we would be putting another $5000 into it to replace the engine. An engine that would've been covered by the warranty if you would've just been patient long enough for the warranty company to assess the situation, instead of freaking out and tearing into the engine of the car prior to having a claim opened and authorized. But sure, we'll write the check to fix a situation we have no obligation to fix. Why not. We did that in the interest of not having our personal lives held hostage by our work life, not because you were loud or relentless. Certainly not because you were entitled to anything. You agreed to move into another vehicle, but we INSISTED you take the next car to your mechanic PRIOR TO ANYTHING BEING SIGNED so that you knew when you purchased your next vehicle, a VW Jetta, that it was in good working order at the time of purchase, and we wouldn't be accepting any further responsiblity for your choices.

      The Jetta passed the inspection, YOUR mechanic found there to be no issues, and we put a new set of tires on the car for you. You were so confident in the inspection that you chose not to purchase a service contract on this vehicle. Off you went. Not sure when exactly you began having issues with the Jetta, but unbeknownst to us, you took it to a mechanic, agreed to cover the cost of repairs and then texted us, letting us know what you were spending on the repairs (why?) and assuring us that you knew we were unaware of the issues when we sold the car (Um, obviously. Your own mechanic didn't find anything wrong with the car).

      And now, here we are, with you, commenting on a ******** post on our page from an account that represents far more people than just you, but also represents people we call friends, who we know dont share your sentiments. In true *********************** form, you have yet again made this about so much more than a car purchase. You insist on using areas of our personal life that aren't really yours to share in the first place as leverage to what, somehow save the world from doing what you did? Walking into a car dealership, wanting what you want, when you want it, regardless of the risk or possible outcomes, and then holding people who don't hardly know you responsible for your choices? I dont think most people do that, ****. Most people, most grown **** most functional members of society, don't use their personal lives to manipulate others into doing what they want in the business world. Most people know when they sign paperwork stating AS IS, not once or twice, but five or six times, that they are accepting responsibility for their decision. And most people, when they don't get their way, find solutions that dont make other people feel taken advantage of, uncomfortable, used, or bullied.

      You know what you did do, though? You made us not want to help people anymore, not go out of our way to try to make a situation right that we didn't even make wrong, and not believe people when they say they are going to do something they have no intention of doing. You make us want to never interact with customers again, never take a chance on anyone trying to build a better life, and never tell anyone we have any friends in common with them. Dont worry, though, we will. We will continue to step up for people we know are good, people we believe to be honest, and we will continue to make sure our hand is there if they need it, not because of you, but in spite of you. Be well. But also, please stay away.

      Later in the week after this social media post, we sold the Mini ****** to a dealer we know who was willing to work on it. We took a ******* loss, mostly because we just didnt want to ever see it again, or be reminded of what this man has put us through, or tried to. Upon examination, the other dealer found a rag shoved into the intake manifold. It is our belief that in an effort to return the car, ***************** sabotaged the vehicle so it wouldnt run and we would buy it back. Additionally, the windshield of that car alone was shot out with a gun, and we know, based on Mr ******** past, he is more than capable of causing damage with a firearm. At this point we are beginning to feel very uncomfortable by his threats. There has been an increase in vandalism to our property since this incident took place, and while we cant for sure say it is him, its still unsettling at best. He has made it clear he will do whatever he has do to hurt us. Please stop allowing this man to use the BBB as a manipulative tool to spread his hate and intimidation. We are never helping him in any way ever again. Not one cent ever. We are getting dangerously close to pressing criminal tresspassing charges, in addition to anything else we can put in place to protect ourselves. We dont trust him or find him to be mentally stable at all. 

      We want nothing to do with this person, we wont respond to any further complaints, and he is not allowed anywhere near our business or our inventory. We hope he can find some peace around this and stop harassing small business owners who he has already raped financially, and held hostage with his threats.

      I Received a message that required a response last week. However when i tried to respond to it the website froze and sent in a blank response. I called into the BBB to explain what happened. I was instructed to send my response into a resolution specialist and it would be added to the blank response. Please submit this as my response to Hayes Auto groups claims.

      There is so much untruth in the statement that **** Hayes submitted I will try to address them the best I can. I think it is also important to note that the facts that I present are backed up by text messages, paperwork, screenshot text messages etc. 

      The very first lie is the very first sentence.There has been no campaign of "hate speech all over social media." I have posted my experience on Yelp and ****** review in an effort to warn other consumers of the poor business practices and share my experience with Hayes Auto Group. They both tell the same story.  I wish I would have taken the time to read Yelp and ****** reviews prior to purchasing a vehicle from Hayes Auto Group. After reading BBB reviews Yelp, and even ****** it's amazing to see how many other consumers have had similar experiences that I did with Hayes Auto... and the consumer experiences all sound similar.  If I can help one person make a better choice than it was worth the time and effort. I'm grateful sites like BBB and Yelp exist, to share these types of experiences and hold businesses accountable who practice shady business practices.

      The claim that I am "threatening many things...including causing them harm" is a 100% LIE....PERIOD. I would counter that with "what threats" If i'm making these types of threats where is this proof? I have had no contact with them except responding to emails Initiated by **** Hayes where I have repeatedly asked her not to contact me at my place of business and I have her phone number(s)  blocked. After blocking her ************ number she started texting me from ************ which I had to block as well. I'm not interested in arguing with her or going back and forth...Just a solution. 

      In ****'s response she stated i came in after seeing an advertisement for a Mini ******...we knew a few of the same people etc...all true. And she states "i brought the car in after it starts showing signs of issues" What she is not stating is that the car's engine light came on the morning after i bought the car. It was ALMOST closing time when I walked onto the lot Saturday night, so by the time the deal was done it was after 8pm. I drove the car straight home and the following morning my wife and i took the car for a drive and MAYBE 10 miles into that is when the engine light came on. They were closed Sunday so I notified them on Monday right away.

      I'm not sure where this "$700" part came from, but regardless my intention was not to buy a car that had engine trouble. And if they were not gonna fix it the finance deal had not gone through so i could have backed out. I took ***** at his word when he told me over and over again "hey don't worry "we're gonna make this right" repeatedly. It wasn't just one time I had the car in the shop... I had to take it in 3 times over that 10 day period because they would say it was fixed, i go pick it up and usually within 24 hours the check engine light would come back on. Finally after the 3rd time my wife and i went into the office to again take the car back and I believe we had to redo the paperwork... i think the deal didn't go through so we had to come in and resign papers. At this time Sott Hayes assured us over and over again "I'm gonna fix this" and the big one... he looked at both My wife and I and told us "we will not sell your trade in until this is all resolved". With that statement I felt assured that if they could not fix the car we could just get my trade in back and move on... this is the only reason we resigned the paperwork.  We had to leave the car there because they had to order a part they said it would take 7 days to get the part(this 3 times the car was in their shop within about a week of the purchase date) And it wasn't just 2 or 3 days later that my wife noticed they had my trade in posted for $10,900. I assured her they probably have it listed but im sure its on some type of hold or something. I didn't think ***** Hayes would so blatantly lie to me like that. Approximately 2 days after that it was listed on their website as sold.

      After 2 weeks of not hearing from them while my car was in the shop. I left a couple messages both by phone and emailed ***** Hayes. I finally got a call from **** and she told me "the part we need to order is backordered everywhere, you're just gonna have to use your warranty". This is definitely NOT what we had agreed upon, i didn't feel like i should have to use a warranty to get this fixed. They sent me the contact info for a mechanic and I took it to him. He called me a few days later and told me he didn't want to work on the car. He said there were "a lot of things going on mechanically with the car, and he didn't want to take this project on". I notified ***** and he instructed me to bring the car back to his shop (4th time) and he was gonna start a warranty claim to get an engine replacement. It's important to know the car was still running and driving at this time. (no bullet holes in the window)

      I have sent it already with this complaint screenshot text messages from ***** Hayes saying he is dealing with the warranty company...and ultimately when he told me the "warranty company denied my claim." I know this NOT to be true because I had contacted the warranty company myself and they assured me on 2 separate occasions that if there was any contact about filing a warranty claim or one being open it would be documented in their system and no such claim had been filled. To further prove what I am saying I contacted the warranty company and I had to send by mail a written request, but they will be sending me a statement to further back that up. When I get it in the mail I will be submitting it to BBB.

      Also **** claims that the :engine had been torn apart" If this is true it was done either in their shop or by the mechanic they sent me to. I don't know auto mechanics and I don't pretend to, so even if i need a simple oil change i take it to a professional. I tend to think if the engine was "torn apart" it happened while it was at Hayes Auto, because i was able to drive it from the mechanic shop to Hayes Auto, I opened the hood and checked the fluids before i left and also i have a text message from ***** hayes saying his Mechanic is coming in on his day off to open up the engine so it could be inspected (see attached) So I'm not sure who she is trying to say "tore apart the engine" It wasn't me... i wouldn't  know where to start. The mechanic they had recommended to me didn't want to do the job, the engine was not torn apart when I picked it up from him...but ***** specifically told me his "mechanic is coming in on his day off to open up the engine". However I believe this to be a fabrication. I don't believe they ever had anyone come to look at it. According to my warranty company's statement to me "if we had someone coming out to inspect the engine it would absolutely be documented in our system". Again I will be submitting a statement from my warranty company to back this up.

      I'm not sure WHEN **** is claiming the windshield was shot out of my vehicle. I personally don't own a gun. And tend to NOT think it's a good idea to shoot out my own windshield. There was ZERO damage to the windshield when I took it into them the last time when they were telling me they were working with the warranty company and that was the last time I had seen or had possession of the vehicle.

      I'm also not sure who this "whole slew of people '' is that I got involved with. Again, we have some mutual associates, one of them being a (ex) member of my motorcycle club. Someone ive known for over 30 years, he happens to be my fathers best friend and i had talked to him about what was going on... i knew he knew ***** Hayes and at the time he was my club president. Actually after I filled my initial BBB  report ***** Hayes is the one that contacted him for mediation. I filed the BBB complaint to get it documented and was gonna take legal action because ***** Hayes Had lied to me about so much, I knew I had proof and i didnt want to see this happen to anyone else.

      Another thing **** Hayes keeps being dishonest about...she has stated that i bought that mini ****** AFTER my mechanic told me not to. This is a twisted form of the truth. The ACTUAL truth is my mechanic told me "if you buy a mini ********************'t bring it to me to work on it". Him, like most mechanics that are not european car specialists dont like working on them. They are very complex. He NEVER told me "don't buy a mini ****** and certainly never said dont buy THIS mini ******.

      This claim of the windshield being shot out with a firearm and " based on my past she knows I'm capable of causing damage with a firearm". I have no such crimes on my record. I have never been arrested for a violent crime or committing a crime using a firearm... all a fabrication. Which frankly im a bit surprised she would throw accusations around like that . After a bit of research on WHO i am dealing with i found she has not been out of federal prison for too long. I thought it was fraud or drug trafficking? But I can't remember what I found. I had my own indiscretions when I was younger but havent had as much as a speeding ticket for over 13 years. So imagine my surprise when I figured out this person was dealing with finance contracts etc.

      The harassment and vandalism claims are more smoke screens. I don't believe for one moment that if she truly believed that I was in any way harassing, or vandalising ***************.. she would have filed a police report. 

      There is also one more claim I would like to dispute... A couple weeks back **** Hayes sent me a copy of a short video saying "we found the problem" stating they sold the Mini ****** for some big loss and the mechanic found a rag stuffed into the motor. I truly don't believe  that is a video of the Mini ****** i previously owned. I have attached a picture of what my engine looked like and if you compare it to the engine in the video there is a big difference. This was a ********************* Works edition so it had a lot of distinctive upgraded components and the big thing that stands out is the condition of the engine. The engine in the video was a very dirty looking mini ****** engine. I really believe this was a video that was probably found on the internet somewhere and edited because the car i had also had a very distinct black and bright green paint and I just find it a bit odd that this video JUST showed a brief few seconds of someone pulling a rag out of a mini ******. I don't buy it. But again... even if it was my car and engine, to say I stuffed a rag into it so I could take the car back because of buyers remorse is preposterous. Let me be clear... I LOVED that car. And i never tried to return it. I wanted the car fixed because I loved it. The car was beautiful, unique,stylish and it was what I wanted. I just wanted the car fixed. I wanted to believe ***** Hayes when he told me over and over he would fix it. I personally really wanted to like *****, I spent a bit of time talking to him on the several occasions I had to take the car in. Even my wife, as patient as she is, lost her patients and trust with ************** before I did. I followed through when he asked me after taking the mini ****** back and giving me the jetta, dismissing my original complaint.. and would have never refilled it if he would have at the very least SPLIT the repair costs of the ** Jetta. I still don't understand how the Jetta ran fine when I drove it off the lot with no check engine lite etc and a week later take it to a mechanic (the same one they had recommended to repair the Mini) and come to find out it had SO much engine damage. But again... I refused to take it and have his mechanic deal with it not after everything I went through with the previous car. I feel like the repair bill that i had to pay for the ** was most certainly pre existing issues. With all that damage that didn't happen in a week. Warped head, blown head gaskets, water pump etc... it was really close to a complete engine rebuild.

      **** has stated that my mechanic checked out the ** and told me it was a good car. Again false. My regular mechanic has never seen either car i got from hayes. He told me he had a Jetta GLI as well and it was very dependable. He had been very ill (and has since passed away) so i couldn't take it to him before buying it ( but **** knew that i only took the car for a 20 minute test drive) I had to schedule with a different mechanic and it was i think 7 days after getting that car and being able to get it inspected.

      The amount of money I lost on this deal is ridiculous. The $4400+ in the out of pocket expense. The $8500 my trade in was valued out and not to mention the stress this put on my family. I have a toddler at home and another daughter in college. My wife and I work hard for what we have...too hard to let shady businesses take money out of our accounts like this. I can't help but wonder how many people have done stuff like this that COULDN'T fork out the money to pay the repair bills.  ************ needs to be held accountable.

      I am rejecting this response because: they have done absolutely nothing to make this situation right. **** Hayes as a representative of Team Hayes Has continued to lie and provide false information. Everything i have stated in my complaint is based on facts that i have proof of.

      I stated a few weeks ago that I would be sending in a letter from my warranty company stating there was never a warranty claim filed on my vehicle like Team Hayes Had told me several times and claimed in their BBB response. Here is that letter, please add this to my complaint.

      We will never lift a finger or spend a dime to help this customer again. We werent legally obligated to help him the first five times we tried, and we arent now. He knows this. 

      He chose the mechanic to inspect his VW, knowing we wouldnt be helping him with anything once he purchased the car. If hes unhappy with his decision, that doesnt have anything to do with us. Surprise surprise, he doesnt want to accept accountability for this choice either. Shocker. 

      He can keep sending things, he can stay mad forever, he can tell everyone how terrible we are, we dont even care anymore. What he cant do is step foot on our property ever again or well have him removed. 

      Please close this case, or leave it open. It seems this is is his last ditch effort to try and get a different result, but you couldnt pay us any amount of money to do business with this guy ever again. He is a NIGHTMARE.

      I was sold a car that they knew was a lemon. I bought the car for $7,000.00 and put a down payment of $1500.00 and made my regular payments on time for 2 years. I have had to refinance TWICE to pay for major services. The first time it was the transmission clutch which was $2000.00 to fix which had to be added to my current loan. Now it is the transmission control module with no ETA of being fixed due to back ordered parts. That is another $1100.00 to fix. The car I paid $7000 for is now back up to $9000.00 I owe more than the car is worth. The car has been down at **** for 2 months waiting on their backordered part they need. This is ridiculous. I have lost my job and I am now about to lose my apartment. All because these Team Hayes people ripped me off. This is literally robbery and I want a resolution before I am homeless. Nobody will help me and it's absolutely sickening. I have already lost my job, will I be homeless next and then be told "sorry there's nothing I can do to help"! I am on the brink of being hospitalized for anxiety and depression over this.

      There are a couple issues with this complaint: 

      1. Customer purchased a ten year old vehicle nearly 2 years ago. She was offered an after market warranty and declined. 

      2. The reason we offer warranties is because contrary to what ************ believes, we actually DO NOT have a crystal **** that tells us "this car is a lemon". We do our best to put our vehicles through a safety inspection. We have no way of knowing when a clutch will go out, nor do we have any control over backordered parts. If her car has been sitting at a franchise dealership waiting for a part, she should take up her complaint with them. Unfortunately, even if we wanted to fix the car for her, we would have even less luck getting a part that the manufacturer can't even get.

      3. At any time ************ could've called our dealership and we would've made every effort to get her into another vehicle if we could. We aren't always able to do this, but sometimes we can. I do not know if she did this, I only know that I was unaware until now. 

      4. There is no such thing as a "lemon law" in used car sales in ****** because the state of Oregon recognizes that a dealership has no control over when something will go wrong with a preowned car. To imply that we knowingly sold a car with problems is not only erroneous but offensive. Unlike many used car dealers, we spend a great deal of money fixing our cars and getting them ready to sell before they even go up for advertisement. Unlike most used dealerships, our cars do not get delivered from the auction and put directly on the lot until they have been inspected and are ready. To think that we know everything about a used car is unrealistic. While we sympathize with her predicament, we will most not be giving her a refund. If we were responsible to fix everything that ever went wrong with one of the **** cars we have sold, we would've been out of business a long time ago. We do what we can and we do more than most. No hard feelings, but we encourage her to try other methods of resolution prior to filing a complaint. We have gone above and beyond for our customers in the past, and likely would've done the same for her had we known, and assuming she was willing to work with us in a respectful cooperative way. Since this is the first time management is hearing of this issue, I can't confirm or deny whether she reached out to the sales department and what her demeanor was when she did so.

      I am rejecting this response because: I have made contact SEVERAL times and was never called back and constantly given a run around. I definitely wouldn't have declined a warranty either. This car lot is a scam.
