Alert

On July 30, 2024, Better Business Bureau investigated Oregon Asphalt LLC’s business practices. This investigation was prompted by complaints alleging that Oregon Asphalt LLC is going to people’s doors offering a deal on leftover asphalt material, no contract is signed or presented before services are rendered, and consumers are being charged more than the price agreed to verbally before the job began. Oregon Asphalt LLC advertises on their website, https://oregonasphaltpavingeugene.com/, that “all of our work is warranted” but has responded to BBB complaints stating that “there is no warranty when we sale recycled asphalt.”

On July 30, 2024, and August 16, 2024, BBB sent an email inquiring about these allegations and the advertised warranty. As of September 13, 2024, BBB has not received any response from Oregon Asphalt LLC.

Based on the information detailed above, BBB cannot state with confidence that it has a clear understanding of Oregon Asphalt LLC.

Advertising Review

On July 30, 2024, and August 16, 2024, Better Business Bureau contact Oregon Asphalt LLC regarding advertising claims found on their website, https://oregonasphaltpavingeugene.com/. Specifically, BBB asked Oregon Asphalt LLC to substantiate or modify the following claims:

  • “all our work comes backed by a warranty”
  • “all of our work is guaranteed”

BBB’s first basic principle of the code of advertising is that “the primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any object claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB.”

BBB’s code of advertising states that a business should only advertise a satisfaction guarantee if the business refunds the full price of the product or service at the consumer’s request.

BBB’s code of advertising also states that “advertisers must not claim that a product or package contains recycled content unless it is composed of materials that have been recovered or otherwise diverted from the waste stream, either during the manufacturing process or after consumer use.”
