      Movers stole or disposed of many items of property, including a bag with my w-2s, an original oil painting, 2 bags of emergency gear worth over $1500, a $200 trash can, a programmable mouse and more. The owner came over and looked through all my boxes to try and find items, but they were not there. Once I provided some security footage of the movers handling the items and the mouse in one guys hand, the owner stopped communicating with me. I had suggested we get together so I could show him the footage and provide receipts, but he will not. The value of the items that were taken is over $2550.

                  Re:  Collection Claim

      Dear ****************:

                  This letter is in response to your collection claim. 

      Unfortunately, you have not proven under no certain terms that anyone employed by Caseys Movers LLC took and did not deliver to your home listed above, any of the items listed on your Inventory Sheet that you completed, initialed and signed (see attached as Exhibit A).  There are two items on your list of missing items that could have possibly been matched with the inventory sheet provided to us prior to your move and signed off on after your move.  Those two items were the *************** Painting and the Shelf for Storage Rack. As you went with the .60 per pound option on the inventory sheet those two items together probably weigh 10lbs. That would mean that you would be entitled to reimbursement of $6.00.  The remaining items that you declare, were not listed on the original inventory, thus we have no idea where you came up with those items, they should have been listed on the original inventory.  The video footage that you claim shows that the possessions were taken is false, it shows the movers taking the furnishings out of the building and out to the moving truck which you also can see in the video.  This is normal course of action in a move.

      Additionally, as you assert, the owner of the company has gone above and beyond coming back to help you look for missing items by helping you look at your storage and your current home for said missing items.  No other moving company would have done this and especially without charging for their time. Additionally,your lost and/or missing **2s and personal papers you should have kept on you personally as you were informed and initialed that you read the Movers Bulletin (Contract Exhibit B), on page 4 of the bulletin it says (Exhibit C, highlighted) and advises you to never pack and/or ship your important papers on the movers truck, to carry them with you.  The mover is NOT responsible for them.





      Lastly, when our movers arrived at your home on February 6th, you were by no means ready for us to move you.  Regardless, we made the best of the situation, helped you pack the remainder of the belongings that needed to be packed, got you moved to your new place and your storage unit all that day.  We did not charge you for the extra truck or person that was used to accomplish this move.  Not only was your move completed in one day,it was done without any damages to your belongings or homes.  Any items or furniture that was taken to the dump or donated, was all at done so at your direction.

      Your demand for payment in the amount of $******** is rejected.  We will pay the $6.00 which is all we are obligated to pay.  Inasmuch, if you do file a claim with Small Claims Court be advised that we will have no alternative but to countersue to which in accordance under ****** Law ORS ****** should we prevail, you will be required to pay our attorney fees, costs and damages up to the amount of $10,000.  Also, should you continue to pursue writing to us for demand of payments, threats of illegal impacts to our credit or other derogatory comments on social media, we will have no alternative then to seek legal action against you on our behalf.

      We always strive to do the best by our clients and give more then we get back. We do hope that you will look back over all of this documentation and realize that we did the job that we were hired to do and went above and beyond for you.  That unfortunately some items went missing but not due to any negligence on our part.

      **************** sent us a demand letter and in that letter she demanded ******** and now here she is claiming even more money.  We were not going to go to her home and spend any more of our time at her home, it was quite pointless and she would just find more things to accuse us of we feel.  Unfortunately the "emergency gear" and the **2's are all her responsiblity.  She is informed of that in the bulletin she was provided and most people would know that and not want their personal information like that to be seen.

      I am rejecting this response because:


      I do not accept the fact that items that I can prove went onto the truck, never came off. Movers are not free to take or dispose of property at their will for 60 cents per pound.


      I have no desire for anyone representing ***** Movers to go through all of my belongings ever again, it was humiliating enough the first time. After opening every box in my home and storage unit, even things that were there long before ***** Movers was ever involved, the owner, *******************, went through. He acknowledged that an assortment of items had disappeared and he had no explanation for that. He stated in person and in writing to me that this was a learning experience for him on how to handle more complex jobs. He also acknowledged that the paintings I had asked for special packaging of were indeed improperly packed with no wrap or paper at all. ************ was in my home going through boxes when I discovered that. He was disappointed and apologetic. He indicated a need to talk to the crew about proper procedures. He saw the damage to my Husky workbench in the middle of the move. He also agreed to pay for the computer mouse and trash can that went missing as he stood in my living room when he had no answers about where things had gone. He agreed that he did not see the solar oven. He asked me to provide pricing/receipts, which I did, but then he started ignoring me. Somehow everything changed when I provided stills from video showing a mover with the mouse I had hidden in my laundry basket in his hand, and proof of the missing items actually being taken out of my home and onto the trucks.
      He agreed that the crew should not have helped themselves to 2 cases of soda they were supposed to be moving not drinking. He tried to track down the stools that were gone that I had explicitly labeled "no go". He had no answers as to why a brand new industrial shelving unit had been removed from my car by the crew. ************ also could not explain why two packages of HP ink cartridges had bad been torn into, (incidentally those ink cartridges were in the bag with the later missing W-2s).


      He was not happy to see that several crew members were smoking weed throughout the day. Some of the times noted with surveillance: 10:34am, 11:26am, 12:11pm, 2:00pm, 2:46pm, 2:51pm, 2:59pm, etc. ************ said it was unacceptable behavior. Perhaps that behavior caused this situation. Perhaps that is why they drove a truck into a tree across the street, tearing a huge portion of the tree off and trying to make amends after the homeowner saw what they had done on their ring camera, by taking the broken branches away that blocked their driveway. They also failed to acknowledge that my property was left unattended on the street after I gave explicit instructions to never leave the truck or my things unattended. It took me 10 hours over 2 days to go through all of the surveillance footage to capture all of the missing items being removed/loaded. They also failed to mention that I had cordoned off the items that I did not want the movers to touch (which incidentally includes most of the missing items, including my W-2s), with masking tape on the floor and a sign on the wall, but those ended up on the truck anyway...then vanished.

      That letter they wrote on March 7 is full of untruths that I can prove. This job drug on for 3 days, not one, which I paid in full for, by man and by the hour each day, for all services rendered and as invoiced by ***** Movers. The complexity or unpleasantness of the job are irrelevant. That is why I hired an professional moving company who said they were bonded and insured. They did not even include the insulting $6 they said they owed me in the **** mail they sent. No mention of the movers putting a box of original artwork and an emergency escape ladder into the stuff going to the dump. I did not say anything about the $80 mini vacuum that ************ dropped on the floor and broke when he was going through my boxes. I did not even complain about the fact that they could not unload one truck because it broke down the first night (causing me to sleep in the cold with only my coat as a blanket and pillow), or that on the second night someone decided to put the coat I was wearing onto one of the trucks without my knowledge which left me trapped outside for several hours in the night with a car full of perishable food items because my keys were in the pocket of said coat. This resulted in my having to call my work supervisor at home because I wasn't going to make it to my graveyard shift at work as a result of this negligence. I also did not mention that I had to pay for someone to come out and deal with getting my water turned back on after ************ broke the drain pipe on the water pan for my washing machine.

      I can certainly see why they would not want me to post a review or mention them on social media. And for the record, I do not take kindly to threats of legal retaliation when I have done nothing wrong. I just want my stuff, or be paid for what was in their control but is now gone. I expect acknowledgement and compensation for the mistakes that they made. I have proof things were there, and receipts for everything. ***** Movers is responsible. I tried to be civil and have a conversation about the situation several times, but they just ignored me. Now they say I can not write them or pursue ****** claims court just because they say so? I think not. These are clearly intimidation tactics that I hope the BBB takes seriously. I know I do.
